Under the #EU jurisdiction, every large online platform (#VLOP) or very large search engine (#VLOSE) needs to provide annual reports on risks associated with how their respective is designed, and works in practice.
Topics are, among others: preventing harms to fundamental rights and to election processes; gender-based violence.
It's been mandatory for three years now. The European Center for Not-for-profit Law (#ECNL) has analyzed those reports, and found recurring issues:
- Vague risk statements
- Insufficient attention to fundamental rights
- Irrelevant or missing data
- Limited stakeholder engagement
- Neglect of EU diversity

Let's embark today in the analysis of risks assessments reports that very large services (#VLOP Platforms and #VLOSE Search Engine) have to publish under the #DSA.
Here are some of my key takeaways!
The first thing that strikes me is the disparities in evidence, readability and explanations in the different reports. If, for instance, Google presents a clear and detailed methodology, other services can just dive into their own propaganda of mitigation measures.

Meta’s messaging app WhatsApp will be the 26th online platform to face transparency requirements under the EU’s platform rules.
The platform has reached 46.8 million monthly average users in the EU, over the threshold of 45 million active users to be considered a Very Large Online Platform (VLOP) under the Digital Services Act (DSA).

For every #moderation decision that restricts or removes content or accounts, the #EU's "Digital Services Act" (#DSA) obliges #platforms to submit a "statement of reasons" (SoR) to a "DSA Transparency Database".
As of today, this affects 23 designated Very Large Online Platforms (#VLOPs).
(Don't get excited, SoRs by law must not contain any #PII – also, there is no "case number" that you could cross-reference to moderation decisions affecting your posts. It's more of a "Statistics Database" than a "Transparency Database").
A study that became available last week ("DSA Transparency Database: Auditing Self-reported Moderation Actions by Social Media.") looked at the database, with not so surprising findings:
»Our analyses reveal that (i) the platforms adhered only in part to the philosophy and structure of the database, (ii) the structure of the database is partially inadequate for the platforms’ reporting needs, (iii) the platforms exhibited substantial differences in their moderation actions, (iv) a remarkable fraction of the database data is inconsistent, (v) the platform #X (formerly #Twitter) presents the most inconsistencies.«

When is a platform a #VLOP or a search engine a #VLOSE under the new EU #DSA? In principle, if the number of "average monthly active recipients of the service in the Union" is higher than 45 million (Article 33(1) DSA).
How these numbers were to be calculated was very unclear.
