"The #WashingtonPost reports that a retired #Philadelphia man, Jon, 67, found himself in the government’s crosshairs after he emailed a lead prosecutor at the Department of Homeland Security, #JosephDernbach, who was handling the deportation case of an #AfghanRefugee, identified as H, asking him to consider that the man’s life was in danger from the #Taliban.
" 'Mr. Dernbach, don’t play Russian roulette with H’s life,' Jon wrote from his #GMail account. 'Err on the side of caution. There’s a reason the US government along with many other governments don’t recognise the Taliban. Apply principles of common sense and decency.'
"Later that day, Jon received an email from #Google notifying him that an administrative subpoena had been sent to them from the Department of Homeland Security 'compelling the release of information related to your Google Account.' Federal agencies can issue such subpoenas without an order from a judge or grand jury, and Google gave Jon, who withheld his last name to protect his family from the government, one week to challenge it.
"Laws are supposed to restrict the use of administrative subpoenas, but DHS has used the tool against dissent protected under the #FirstAmendment to the #Constitution. Jon could not find who in the agency issued the #subpoena, let alone a record of it to show an attorney.
"Days later, DHS agents showed up at Jon’s door. A naturalized U.S. citizen originally from the #UK, Jon was worried about potential violence. The agents showed him a copy of the email and asked to see his side of the story. They didn’t know about the administrative subpoena but said they received orders to interview Jon by #DHS headquarters in Washington, D.C.
"Eventually, the agents agreed that Jon had committed no crimes after he told them he found Dernbach’s email address through a simple Google search. Jon secured pro bono representation by #ACLU attorneys, who argue that the government is violating a statute that limits how administrative subpoenas can be used for '#ImmigrationEnforcement' and that the government targeted Jon for #ProtectedSpeech.
" 'It doesn’t take that much to make people look over their shoulder, to think twice before they speak again,' said Nathan Freed Wessler, one of Jon’s attorneys. 'That’s why these kinds of subpoenas and other actions—the visits—are so pernicious. You don’t have to lock somebody up to make them reticent to make their voice heard. It really doesn’t take much, because the power of the federal government is so overwhelming.'
"Both #Google and #Meta received a record number of subpoenas in the United States during the first half of 2025 as Trump’s second term began, with Google receiving 28,622, a 15 percent increase over the previous six months. Jon was fortunate to have his case picked up by the ACLU and later reported on by a national media outlet. How many others in the U.S. haven’t been so lucky and face legal challenges for exercising their right to free speech?"

Man Feds Killed in #Minneapolis Was an #Observer, Eyewitness Says
The killing marked the second fatal shooting by federal agents in the city in less than a month. Neither victim appeared to be the target of immigration enforcement.

"Minneapolis Police Chief Brian O’Hara said at a press conference Saturday that the victim was a 37-year-old resident of Minneapolis and is believed to be a #UScitizen. The Minnesota Star Tribune identified him as #AlexJeffreyPretti.
"According to the paper and a public records database accessed by The Intercept, Pretti had a #Nursing license issued in 2021.
"The shooting came just weeks after an Immigration and Customs Enforcement officer shot and killed Renee Good and a day after hundreds of thousands of people braved subzero temperatures to march in Minneapolis against weeks of rolling immigration-enforcement raids by ICE, Border Patrol, and other federal agencies.
"A video of the incident, which surfaced on Reddit just before 10 a.m. Central Time, shows a number of apparent federal agents in tactical gear wrestling with a person on the ground and striking them multiple times before a shot rings out. As many of the agents scatter from the person, at least nine more shots ring out and the person slumps to the ground.
"A spokesperson for the Department of Homeland Security confirmed the shooting and claimed that the man was carrying a handgun, attaching a photo of a Sig Sauer weapon. The Intercept has not been able to independently verify the Department’s claims. [AND CAN WE BELIEVE ANYTHING FROM THE #DepartmentOfHomelandInsecurity?!!]
"Minnesota allows open carrying of firearms by people with valid permits. O’Hara said Saturday that the victim’s only known law enforcement interactions were over traffic tickets, 'and we believe he is a lawful gun owner with a permit to carry.' "

"Peter Yazzie, #Dine', was on his way to work in Peoria, in the Phoenix Valley, at 4 a.m., on Monday, when ICE grabbed him, ignoring his tribal ID and the fact that he is a U.S. citizen, reports Arlyssa D. Becenti, at the Arizona Republic.
"Peter Yazzie told ICE agents where they could locate his Certificate of Indian Blood, birth certificate and other documents proving that he was both a #USCitizen and #NativeAmerican. It made no difference. They aggressively placed him in the back of their vehicle and drove away early the morning of Monday, Jan. 12.'
"Yazzie was unaware that ICE was expanding operations throughout Phoenix and surrounding cities. Parked at a QT gas station between Peoria and Sun City near his job site, his morning began as usual, waking at 4 a.m. for his 5 a.m. shift."

Attys said clients who received notices also included #spouses of #UScitizens, who were actively trying to legalize their #immigration status.
Rosa, a #UScitizen in NY, said her Honduran husband was fined $5k. Her husband wasn’t able to leave the country after being granted voluntary departure in 2018 because she was diagnosed w/uterine #cancer. She hopes once she explains the situation, that the fine may be waived. If not, he will have to work many extra hours to pay.

"#Trump administration officials are suggesting their immigration crackdown could expand to include deporting convicted U.S. citizens and charging anyone — not just immigrants — who criticizes Trump's policies.
"Why it matters: Such moves — described by officials in recent days — would show how U.S. citizens could be impacted by the growing number of tactics President Trump is using to, in his view, improve national security.
"They'd also be certain to ignite new legal battles over how far Trump's team can go in fighting illegal immigration and responding to #dissenters.
"Zoom in: Here are three tactics the administration has teased that legal analysts say would challenge Americans' rights:
1. Sending convicted U.S. citizens to prisons abroad.
This has been floated as a spinoff of Trump's deal with El Salvador, where a high-security prison is holding about 300 U.S. immigration detainees that the administration says are suspected criminals and gang members.
"Homegrowns are next," Trump said during an Oval Office meeting with Salvadoran President Nayib Bukele last week, referring to sending Americans convicted of crimes to serve time in foreign prisons.
"We always have to obey the laws," Trump said, "but we also have homegrown criminals that push people into subways, that hit elderly ladies over the head ... I'd like to include them in the group of people to get them out of the country."
Trump's suggestion — echoing a similar proposal Bukele made to Secretary of State Marco Rubio in February — drew a storm of criticism from legal advocates, who called it unconstitutional.2. Putting critics of the administration's policies in jeopardy.
Some officials say U.S. citizens who #criticize administration policies could be charged with crimes, based on the notion that they're aiding terrorists and criminals.
"You have to ask yourself, are they technically aiding and abetting them, because aiding and abetting criminals and terrorists is a crime," White House senior director for counterterrorism Seb Gorka said in an interview with Newsmax.
Trump's team also has questioned the legality of civic groups providing #immigrants with "#KnowYourRights" trainings on how to respond to federal agents. Border czar Tom Homan suggested that such seminars help people evade law enforcement.
"They're trying to use terrorism laws to attack people for their speech and for their political activism, and that's an authoritarian effort," said Kerri Talbot, co-executive director of the Immigration Hub, an immigration advocacy group.3. Questioning the authority of court orders.
The administration's resistance to returning Kilmar Abrego Garcia — who was legally in the U.S. with an order not to be deported back to El Salvador, but deported to the prison there anyway — has raised questions about how far Trump's team can go in trying to skirt court orders.
The White House says the decision to return #AbregoGarcia rests with El Salvador because the U.S. Supreme Court told the administration only to "facilitate" his return, not "effectuate" it.Advocates worry the resulting confusion has laid the groundwork for Trump's team to send a #USCitizen to a foreign prison, then claim that person couldn't be returned.
A federal judge raised this concern in Abrego Garcia's case.
"If today the Executive claims the right to deport without due process and in disregard of court orders, what assurance will there be tomorrow that it will not deport American citizens and then disclaim responsibility to bring them home?" wrote Judge Harvie Wilkinson III.
"And what assurance shall there be that the Executive will not train its broad discretionary powers upon its political enemies?"What they're saying: Michelle Brané, former executive director of the Biden administration's Family Reunification Task Force, echoed Wilkinson.
"If they can send a noncitizen to a prison in El Salvador without due process ... why would a U.S. citizen be safer?"
The White House didn't respond to a request for comment. But officials have argued that they have an electoral mandate for stricter immigration enforcement, and that opposition to their policies is against the will of voters.
Trump's handling of immigration polls well in public surveys.
But sending immigrants to El Salvador's prison without criminal convictions or due process does not — about 60% were opposed in a recent YouGov survey.Between the lines: U.S. citizens have been mistakenly detained by Immigration and Customs Enforcement (ICE) before, including cases this month in Arizona and Florida.
"People are realizing that this is going to impact all communities," Talbot said, "and that if one citizen can be picked up, then any of us can be picked up and put into proceedings, or labeled a #terrorist, or removed to a foreign prison."
