The hearing did not go as prosecutors had planned. Judge Quraishi grew frustrated with the office’s head of appeals, Mark Coyne, who had not formally disclosed that he would appear, & fiercely interrogated a more junior prosecutor about whether the former interim #USattorney, #AlinaHabba, still had some role in operating the office.
Judge Quraishi eventually threw Coyne out.

US District Judge Matthew Brann said that a trio of #DOJ lawyers who have been leading the office since late last year had been unlawfully serving in their positions. AG #PamBondi appointed them after Brann disqualified #AlinaHabba, #Trump’s previous choice for #USattorney in NJ, in August amid similar questions over the legality of her appointment.

Federal #judges have found a number of US attorneys whose appointments were the result of unusual legal maneuvers by the #Trump admin to be serving unlawfully.
Along with Sarcone, they include #AlinaHabba, who was the acting #USattorney in NJ, & #LindseyHalligan, formerly the acting US attorney for the Eastern District of VA, as well as a handful of others.

The decision Monday affirms a ruling by Matthew W. Brann, the chief judge for the Middle District of Pennsylvania, who concluded in August that #AlinaHabba had been serving as NJ’s #USattorney without legal authority since July 1.
The state’s federal courts have since been operating in limbo. The confusion has now extended for nearly 4 months & has slowed certain types of criminal cases & halted some grand jury proceedings.

In July, judges in the District of #NewJersey declined to extend Habba’s term & instead tapped a veteran prosecutor, Desiree L. Grace, to lead the office. That led US AG #PamBondi to disparage the judges, fire Ms. Grace & elevate #AlinaHabba to the role of acting #USattorney through a complicated series of maneuvers that were at the heart of the appeal.

#AlinaHabba, 41, had represented #Trump in several #civil cases [which she lost] & played a public role in his 2024 presidential campaign. But she had NO experience in #criminal #law before the president named her in March to a 120-day interim term as #NewJersey’s top federal prosecutor. Trump nominated her to take on the role permanently, but her appointment was doomed by opposition from the state’s 2 Democratic senators, Cory Booker & Andy Kim.

The challenge to #AlinaHabba’s authority may be the first to reach #SCOTUS, though a similar case involving the #USattorney in #Virginia, #LindseyHalligan, may be expedited by virtue of being entangled with #criminal cases against Trump’s [perceived] enemies.
Last week, a federal judge found that Halligan, too, had been unlawfully appointed by the #Trump admin, but the #DOJ has vowed to appeal.

#JayClayton, a former corporate lawyer who served as the #SEC chair during the first #Trump admin, was nominated by the president to be the #USattorney for the #SDNY in January, but his confirmation was blocked by NY’s senior Democratic senator, #ChuckSchumer. Clayton was then appointed on an interim basis in April, & in August, the judges of Manhattan’s Federal District Court appointed him to the post, meaning he could serve for the rest of Trump’s term.

#Trump pick to be the top #federal prosecutor in #NYC will stay in the job, even though he hasn’t been confirmed by the US #Senate, after a group of #judges voted Monday to allow him to continue in the position.
The judges’ decision to approve #JayClayton as the #USattorney for #SDNY is a victory for the Trump admin, which has resorted to unorthodox maneuvers to keep some of Trump’s other nominees for US attys in place after they failed to advance in the Senate.
