A Law Commission of India report recommending retention of India’s 153-year-old, now-suspended law on sedition relies substantially on a 2018 book that makes the same argument, mainly on grounds of ‘national security’, even though sedition criminalises ‘disaffection’, not against the nation but the government. Though the report credits the book 11 times, we found paragraphs produced verbatim, paraphrasing of authors’ conclusions, selective omissions and no evidence of “extensive consultation”, as the Commission claimed.
