Heute zum Thema: Amtsgericht oder Landgericht – wer ist eigentlich zuständig? ⚖️🤔
Ob Zivilverfahren, Strafverfahren oder Familiensachen: Nicht jedes Verfahren landet beim selben Gericht. Und selbst unter den Amtsgerichten gibt es Unterschiede: nicht jedes hat beispielsweise ein (Jugend-)Schöffengericht oder ein Vollstreckungsgericht. Für manche Zuständigkeiten ist vielmehr ein gemeinsames Gericht für die Bezirke mehrerer Amtsgerichte eingerichtet.
Wer für was zuständig ist, zeigen wir euch am Beispiel des Landgerichtbezirks Konstanz.

- Gemäß § 23 Nr. 2a GVG sind die Amtsgerichte für Streitigkeiten über Ansprüche aus einem Mietverhältnis über Wohnraum ausschließlich und damit unabhängig von der Höhe des geltend gemachten Anspruchs zuständig.
- Ein Familiengericht, das beispielsweise für Scheidungsverfahren zuständig ist, gibt es erstinstanzliche nur beim Amtsgericht.
- Für Strafverfahren wegen Mordes ist eine Strafkammer beim Landgericht als Schwurgericht zuständig, § 74 GVG.
- Für Betreuungssachen ist eine spezielle Abteilung bei den Amtsgerichten zuständig, § 23c GVG.
- Berufungen gegen amtsgerichtliche Urteile werden sowohl in Zivil- als auch in Strafsachen vor dem Landgericht verhandelt.
- Jugendschöffengerichte gibt es nur beim Amtsgericht.
- Für den Erlass eines Haftbefehls ist im Ermittlungsverfahren gemäß § 125 Abs. 1 StPO ein Richter beim Amtsgericht zuständig.
- Gemäß § 1 ZVG ist für Zwangsversteigerungen als Vollstreckungsgericht das Amtsgericht zuständig.
- Das Landgericht ist gemäß § 71 Abs. 2 Nr. 9 GVG für Arzthaftungssachen ausschließlich zuständig.
- Die Zuständigkeit der Amtsgerichte für Nachlasssachen ergibt sich aus § 23a Abs. 1 Nr. 2, Abs. 2 Nr. 2 GVG. -
