Lundi, il a rejeté le recours de @LaQuadrature, Access Now, @article19, @ecnl, @edri et @Wikimedia_Fr contre le Règlement européen de censure des contenus terroristes (#Terreg). Nos organisations dénoncent la confiscation du débat juridique qui aurait dû se dérouler devant la Cour de justice de l'UE (CJUE).

🇬🇧The importance of the terrorist content online regulation #TERREG was hyped at the time, but with less than 400 removal orders and hardly any cross-border removal orders I can’t see this regulation having a significant impact on the thosands of pieces of propaganda online.
Where videos of interest are removed, they reappear elsewhere, e.g. on Telegram, and readers are pushed to channels which bring them even closer to terrorist networks. There were also false removal orders on non-terrorist propaganda.
Thus piecemeal content removals aren’t the key to countering terrorist propaganda online. It’s much more effective to use fact-checking, testimonies by drop-out former members who have quit, and information and support to those supporters who may yet want to quit.

🇩🇪Die Bedeutung der #TERREG-Verordnung über terroristische Online-Inhalte wurde seinerzeit hochgejubelt, aber mit seit Beschluss weniger als 400 Löschanordnungen hat diese Verordnung kaum signifikante Auswirkungen auf die Tausenden von Propagandaposts im Internet.
Wenn begehrte Videos entfernt werden, tauchen sie an anderer Stelle wieder auf, z. B. auf Telegram, und Interessierte werden in direkte Kanäle verdrängt, die sie noch näher an terroristische Netzwerke heranführen.
Es gab auch falsche Löschanordnungen völlig legaler Inhalte.Fazit: Inhaltelöschungen sind nicht der Schlüssel zur Bekämpfung terroristischer Online-Propaganda. Viel effektiver ist es, Propaganda mit Faktenchecks zu korrigieren, Zeugenaussagen von Aussteigern zu posten und Informationen und Unterstützung für künftige Aussteiger anzubieten.

Le Conseil d'État est donc formellement saisi, mais nous lui demandons de transmettre l'affaire à la Cour de justice de l'Union européenne, seule juridiction pouvant invalider le #TERREG.

Pire, il étend cette censure à l'ensemble de l'Union européenne. Une police hongroise pourrait par exemple censurer des contenus hébergés en France. Tout ça sans passer par un juge avant la censure, ce qui laisse un grand pouvoir à la police. #TERREG

Ce règlement européen oblige les plateformes à censurer en 1h les contenus que la police estimerait être à caractère terroriste. Certaines devront aussi mettre en place des mécanismes pour prévenir l'apparition de ces contenus, par exemple avec des filtres automatisés. #TERREG
