  16. Rights on Paper

By Cliff Potts, CSO, and Editor-in-Chief of WPS News
Baybay City, Leyte, Philippines — August 18, 2026

    The Problem Being Examined

Intellectual property protections do not fail only when laws are absent.
They also fail when enforcement is selective, delayed, or asymmetric.

This essay examines how intellectual property rights in China have often existed on paper, while enforcement in practice favored domestic firms, state priorities, or strategic outcomes.

The issue is not whether China has IP laws. It is how those laws are applied.

    What the Law Says

China has built an extensive framework of intellectual property statutes, courts, and regulations.

    On paper, these include:

    • patent protections
    • trademark enforcement
    • copyright law
    • specialized IP courts

In formal terms, these structures resemble those found in advanced economies.

That resemblance has often been used to argue that concerns over IP theft are outdated.

What Enforcement Looks Like in Practice

In practice, enforcement has frequently been uneven.

    Foreign firms have reported:

    • slow-moving investigations
    • narrow interpretations of infringement
    • limited damages awards
    • difficulty enforcing judgments
    • pressure to settle rather than litigate

By contrast, domestic firms—particularly those aligned with state priorities—have often faced fewer barriers and faster resolution.

    Delay itself becomes a tool.

    Why Asymmetry Matters

Intellectual property protection is not binary. It is not “present” or “absent.”

    It functions through:

    • speed
    • predictability
    • remedies
    • neutrality

When enforcement is slow or uncertain, the value of IP collapses even if statutes exist. Knowledge diffuses. Competitive advantage erodes.

A right that cannot be enforced in time is not a right. It is a formality.

    How This Supported Technology Transfer

Weak or selective enforcement reinforced earlier mechanisms of technology transfer.

Once proprietary knowledge entered joint ventures, supplier relationships, or regulatory processes, the cost of misappropriation was low and the risk manageable.

Litigation rarely restored lost advantage. At best, it arrived after the damage was done.

    Who Paid the Cost

    The costs were absorbed by:

    • foreign firms that lost exclusivity
    • workers displaced as competitiveness declined
    • home countries that lost industrial capacity
    • future innovators whose incentives weakened

These costs accumulated quietly, spread across industries and decades.

Why This Matters for the Philippines

The Philippines is expanding its role in:

    • electronics manufacturing
    • software and services
    • research and development

IP enforcement asymmetry elsewhere offers a warning. Legal frameworks matter, but enforcement reality matters more.

Access without protection is not partnership. It is exposure.

    Why This Fits the Pattern

Bad faith does not require the absence of law. It often operates through law applied unevenly.

When enforcement aligns with strategic goals rather than neutral standards, markets stop being markets.

    They become instruments.

    What Comes Next

The next essay will examine state subsidies and market distortion—how government backing reshapes competition while remaining formally within global trade rules.

    The record continues.

  17. A Campus is a City – An Architecture for Innovation at Scale

A concept note on how a large university campus can build innovation and entrepreneurial mindset at scale – not through events, but through empowerment.

Entrepreneurship is a mindset, more than a result or an outcome. An innovation program that aims to inspire over 10,000 lives on-campus has to not just target, say, 2500 start up ideas that come out of it like a funnel, but plant a seed within all, so students succeed in their lives with an innovation and entrepreneurial spirit – albeit in jobs.

10,000 students cannot be impacted in one go through a centralized mechanism. The campus has to function like a city with systems and processes. The following is the plan:

Distribute the faculty into interdisciplinary groups that directly relate their research with an industrial application. For instance, a material scientist and a biologist brought together for, say, manufacturing soft materials.

Let’s say you identify ‘N’ such unique groups depending upon the size of your fraternity, each with around 10 faculty members, of which two step up as coordinators for their group. Now, create a training program for these ‘2*N’ faculty members, so they can sensitize and train the rest of the faculty from their group as per the group’s scope and requirement. The university’s innovation cell helps the coordinators with a customized training plan, relevant material, access to equipment, tools, etc.

Now all of these trained faculty then train the PhDs and Postdocs working under them who then become the point of contact for undergraduate and postgraduate students who choose which group they align more with and associate accordingly.

This entire process has to be tracked through a central portal. Further, regular support has be provided to anyone across the hierarchy to pitch in an offline engagement, like, inviting an industry professional or a scientist relevant to their group, or going for a factory tour, etc. Students should be able to earn credits, and this initiative-taking can be further incentivized as leadership training where faculty earn points towards their career advancement and recognition.

Each group runs decentralized but centrally tracked and supported bootcamps, which even members from different groups can participate in, based on their interests, and the schedule is published well in advance, along with learning outcomes and actionable insights that come out of each session, because this program shouldn’t just checkmark the list of activities done for the sake of visibility, but should actually result in tangible action plans at the end of it – be it technology transfer, or a DeepTech startup, or a better understanding of the real world that leads to better research output and industry collaborations.

The program should also self-sustain, so that every year, with new admissions, the program continues as part of the culture of the university, and the alumni engage with their group members even after graduation.

This celebration of science and technology solves for the long term that India desperately needs. Further, in parallel, centralized awareness campaigns have to be organized where you don’t ask students to come to the innovation cell, but the administration goes to them – in labs, in mechanical shops, in canteens and hostel mess, etc. to engage with the future of India.

  19. The Price of Access

By Cliff Potts, CSO, and Editor-in-Chief of WPS News
Baybay City, Leyte, Philippines — July 21, 2026

    The Mechanism Being Examined

This essay examines a practice that shaped the modern Chinese economy more than any single trade deal: conditioning market access on technology transfer.

For decades, foreign firms seeking access to China’s market were required—formally or informally—to share intellectual property, technical processes, or operational know-how. This was not incidental. It was structural.

The result was one of the largest transfers of technology in modern history.

    How the System Worked

Access to China’s domestic market was rarely unconditional.

Foreign companies were often required to:

    • enter joint ventures with local firms
    • share source code, designs, or manufacturing processes
    • localize production under regulatory supervision
    • train local partners who later became competitors

In theory, these arrangements were voluntary. In practice, refusal often meant exclusion from the market.

The choice presented was simple: share technology or stay out.

Why This Was Not Normal Trade

In open-market systems, firms compete on innovation while retaining control over proprietary knowledge.

China’s approach inverted that logic. Technology was treated as an entry fee rather than a competitive asset. Market access became leverage.

This was not free exchange. It was conditional participation in a system where the state retained ultimate authority.

    Legal Versus Practical Coercion

Defenders of the system argued that technology transfer was “negotiated,” not forced.

    That distinction collapses under scrutiny.

When a state controls licensing, approvals, courts, and regulatory timelines, “negotiation” takes place under asymmetric power. Delays, denials, or regulatory pressure functioned as enforcement tools even when no explicit demand was written down.

Coercion does not require a signature to be effective.

    What Was Transferred

    Over time, foreign firms transferred:

    • manufacturing techniques
    • industrial automation processes
    • semiconductor and electronics know-how
    • telecommunications and networking expertise
    • software and system architecture

Some transfers violated export controls. Others complied with the letter of the law while undermining its purpose.

Once transferred, the knowledge could not be reclaimed.

    The Long-Term Consequences

    The consequences unfolded gradually.

Chinese firms moved up the value chain.
    Foreign competitors lost advantage.
    Supply chains re-centered around China.

By the time governments began reassessing the risks, the dependency was already embedded.

What began as market access became strategic vulnerability.

Why This Matters for the Philippines

    The Philippines continues to balance:

    • foreign investment needs
    • technology access
    • industrial development goals

Understanding how technology transfer can be embedded into access terms is critical. Short-term gains can carry long-term costs if leverage is misread.

This is not an argument against investment. It is an argument for clear-eyed terms.

    Why This Fits the Series

Bad faith is not always hidden in fine print. Sometimes it is embedded in system design.

When market access is conditioned on surrendering future competitiveness, the imbalance may not be visible at signing—but it becomes obvious over time.

This essay explains how that imbalance was normalized.

    What Comes Next

The next essay will examine intellectual property enforcement asymmetry—what happens when rights exist on paper but fail in practice.

    The record continues.

  20. RE: aus.social/@oscarjiminy/116819

'technology transfers from the US in particular were absolutely critical to seeding the development of what became the industries that these countries were very famous for in subsequent decades. Now, what’s interesting about the cases of Japan, South Korea and Taiwan — and I think this is the big contrast with China, and this sets the stage for what makes China’s case so interesting and so important — is that in the case of Japan, South Korea and Taiwan, they were of course close cold war allies of the US'
