A TROCA juntou-se com várias ONG europeias e internacionais, na subscrição da declaração “Impedir que oligarcas russos processem em resposta às sanções”, que apela a um acordo mútuo entre União Europeia, Reino Unido, Suíça e Ucrânia, para pôr fim à ameaça de casos ISDS baseados em sanções.

Em 2025, a TROCA produziu e publicou um Folheto e uma Brochura no âmbito da campanha europeia, com informação relevante sobre o mecanismo ISDS nos acordos multilaterais e bilaterais de livre comércio.
Materiais a serem utilizados nas actividades a desenvolver pela TROCA, na campanha deste ano, que visa o fim do ISDS, pela protecção das pessoas e do Planeta.

Continuamos expostos à ameaça de casos julgados em “tribunais” paralelos, envoltos em secretismo e sem as garantias de transparência e idoneidade asseguradas pelos tribunais nacionais. Por isso, a TROCA defende que o Governo Português rescinda ou renegocie todos os tratados bilaterais de investimento portugueses que contêm cláusulas ISDS.

No dia 13 de Março, a TROCA entregou em mão, no Ministério dos Negócios Estrangeiros, carta de pedido de audiência sobre os BITs sujeitos a ISDS
A TROCA já contactou também com o Ministério da Economia e vai continuar o seu trabalho, junto do governo, para Portugal deixar de incluir o ISDS nos tratados de investimento. -
Hoje no Público: “Caso BES: secretismo na primeira audiência do processo ISDS contra Portugal”
Em 2025 abre-se a oportunidade do governo português denunciar quatro dos tratados bilaterais de investimento (BITs), antes da prorrogação, sendo que nove podem ser sempre terminados.
Portanto, a solução para o problema da arbitragem ISDS é rever ou cessar os tratados que o prevêem. -
No dia 1 de Setembro, saiu no jornal Público um artigo de opinião da TROCA, dedicado ao primeiro caso ISDS contra Portugal. Este caso (Suffolk and others v Portugal), que a TROCA tem acompanhado nos últimos anos, está relacionado com o processo de resolução do BES, pelo qual dois fundos americanos se dizem lesados, apesar de só terem adquirido os seus créditos meses depois do evento pelo qual reclamam danos.
