  6. Sec. of State #ShennaBellows: #DOJ demand for #Minnesota #voter data shows #ICERaids tied to #elections

    Lauren McCauley
Mon, January 26, 2026 at 9:02 AM EST

Excerpt: "Bellows, a Democrat running for governor, has twice rejected requests to provide the DOJ with sensitive voter data, including driver’s license numbers, partial social security numbers and full dates of birth, along with names of officials who handle the list’s maintenance, the number of ineligible voters the state identified due to noncitizenship and voter registration applications from specific time periods, among other information.

"The DOJ has argued the data is necessary to assess states’ compliance with the statewide voter registration list maintenance provisions of the #NationalVoterRegistrationAct.

"Maine is now among the states being sued by the federal government over its failure to comply.

"In a motion to dismiss filed last month, the state argued that the lawsuit should be discharged because the DOJ failed to support a valid legal case as to why it is justified to such information, and that its data requests violate federal privacy law.

"The motion also noted voter registration databases contain information about people’s choice of political party and in which elections they chose to vote, which are activities protected by the #FirstAmendment. Bellows and other secretaries of state have also raised concern about the federal government using voter records for citizenship probes.

"In a statement Sunday, Bellows said, '#Maine will never turn over our voter rolls as a ransom payment to get ICE to end its #unconstitutional assault on our state.

" 'Our founders designed a system where states and local governments, not the federal government, oversee elections to safeguard us from exactly this — a #tyrannical, #PowerHungry president trampling on our #ConstitutionalRights,' she wrote."

  7. #ShennaBellows says Trump's call for federal #elections takeover is blatantly #unconstitutional

    #MainePublic | By Steve Mistler
    Published February 3, 2026

"Maine Secretary of State Shenna Bellows said Tuesday that President Donald Trump's call for a federal takeover of elections is blatantly unconstitutional, but a threat that should be taken seriously given moves his administration has already made.

"Bellows, a Democrat who is also running for governor, says the president's comments on a right-wing podcast about commandeering elections in 15 unnamed states fit a troubling pattern. That includes an effort by the Department of Justice to obtain states' private voter data, which Bellows' office is fighting alongside Oregon in federal court.

"Minnesota Secretary of State Steve Simon also pushed back after receiving a letter from Attorney General Pam Bondi suggesting the immigration surge there would end if officials complied with the DOJ, a request he described as 'apparent ransom.'

"Bellows said those moves, along with the FBI's recent raid of election offices in #FultonCounty #Georgia, suggest Trump is trying to preempt voter backlash to his policies in coming #elections.

" 'The president fears big losses in the 2026 and 2028 and is trying to set the stage for federal interference in our elections,' she said.

"Under the #Constitution, states govern American elections. But Trump has frequently made unsubstantiated claims that Democrats exploit the decentralized system to rig outcomes."

  8. #DemocracyNow - “No Means No”: #AZ Secretary of State Calls for #Resistance as #Trump Pushes to “#Nationalize#Voting

    February 04, 2026

"As President Trump suggests the federal government should 'nationalize' and take over the elections process from the states, we speak with #Arizona Secretary of State #AdrianFontes. He is the former county recorder for Maricopa County, Arizona, and oversaw elections there in 2020. The #JusticeDepartment has sued Arizona and over 20 other states [includng #Maine] for their full #VoterRegistration lists. 'No means no,' Fontes says in response to the Trump administration’s encroachment on state authority. 'We should not be handing over any of our personal identifying information to the president. Not only should we not be doing it, but it’s against the law for me to fulfill the request from the Department of Justice.' "

  9. As for the part of the #law that lets people sue #federal agents for violations of the #Illinois #Constitution, the 2 professors wrote, “that provision won’t stand” under the #SupremacyClause.

Still, Vikram Amar said, such #StateLaws can serve a larger purpose.

“In the spirit of #federalism. Not only can #states experiment in this way, but doing so would likely lead #Congress to address the problem,” he said.

  10. Citing Professor Amar’s article, Judge Walker concluded that “nothing would stop a #state from creating a new cause of action allowing plaintiffs to directly allege federal constitutional violations.”

The #Illinois #law did that, but in imperfect fashion, acc/to a critique from Vikram David Amar, a law professor at UC Davis (& Akhil Amar’s brother), & Jason Mazzone, a law professor at the University of Illinois Urbana-Champaign.

  11. Whether that is correct is a complicated question in light of another federal #statute, & it has not yet gotten sustained #judicial attention. But Judge Justin Walker, who was appointed to the US Court of Appeals for DC by #Trump, did consider the matter in a 2023 concurring opinion in a case arising from a #protest outside the White House in 2020.

  12. #States can’t just generally regulate #ICE conduct, because the #federal government gets to regulate that,” he said. “But states *can* provide remedies against federal officials when federal officials violate federal constitutional rights.”

  13. The #Trump admin promptly sued #Illinois, saying the #law violated the #Constitution’s #SupremacyClause, which generally prohibits #states from enacting measures at odds with #FederalLaw. Whether to allow lawsuits against #federal agents for violating the federal #Constitution, the admin’s complaint said, “is a policy choice for Congress.” [ridiculous]

Professor Amar said aspects of the IL #StateLaW might be problematic, but that its core idea is sound.

  14. That is where #state lawmakers come in, Professor Amar said.

“Sometimes the #federal government will misbehave,” he said, “& you can’t count on #Congress always to rein the federal government in.”

His article drew on 2 principles often associated with #conservatives: #federalism & #originalism.

“This is exactly what the framers imagined: state law protecting us against federal abuses,” Professor Amar said.

  15. #SCOTUS tried to address the gap in 1971 in Bivens v. Six Unknown Named Agents, allowing the victim of an #unconstitutional search by #federal agents to sue them. But the court has essentially abandoned that approach, saying instead that #Congress must act if suits against federal ofcls are to be allowed.
[I personally don’t see this SCOTUS dealing with the issue given their stance on expansive #ExecutivePower]

  16. His central point for present purposes was that #state #legislatures can authorize lawsuits against #federal officials for violating the #Constitution. If that is right, such #StateLaws would close an odd gap in #FederalLaw that—broadly speaking—allows such suits against state & local officials, like police officers, but not against #federal ones, like #ICE agents.

  17. The article has, in truth, been quite influential. It has been cited, for instance, in 7 #SCOTUS opinions. But it was also 96 pages long & touched on many issues.

“I was actually trying to do a bunch of different things — & get tenure,” Professor Amar, now a leading constitutional scholar at Yale Law School, said of the article, “Of #Sovereignty & #Federalism.”

  18. #ice #statesrights #justice
The point has been made that state prosecutions would be pushed to federal courts. But the problem here is the corrupt federal prosecutor’s refusal to bring cases against ice/cbp/hsi brutality and murder. Federal courts have not been too unreasonably sympathetic with this regime. I think getting these cases onto the docket is half the battle.
