  1. This project can be stopped. The Species at Risk Act prohibits damaging any part of critical habitat, redds, or individuals of any listed species without a permit, including the 2 trout species affected here. Canada can issue permits to allow it, but not for the purpose of allowing coal mining. While a counterargument to this view exists, it must be tested in court. Ecojustice needs to take this on.

  2. Lawyer Drew Yewchuk offers a pungent analysis of Canada's long-practiced actions to subvert and ignore the clear requirements of its own law with regard to at-risk species, using the fate of BC's spotted owl as an example.

    pubs.acs.org/doi/pdf/10.1021/a OA

A few issues here: (1) expanded mines are up for approval in BC, (2) Alberta has still not given up on approving new coalmines on the East Slopes, (3) two SARA-listed threatened trout species occur in Alberta downwind from the BC mines in the PAC-contaminated plume.

  8. Yet again the Government of Canada is found to have broken its own Species at Risk Act. “The machinery of government cannot undermine the clear statutory obligations made to the minister," Roy wrote.

  11. Legal scholar Drew Yewchuk skewers the claim of Canadian rule of law and democracy by showing how routine non-compliance (i.e., lawlessness) by our governments subverts both. That's because there is no means of enforcing our laws on governments who break them.

  12. The key point here: Logging the upper Kananaskis will unavoidably damage some part of critical habitat of a protected trout population; will damage its residences; and/or will kill, harm, harass, or take individuals of a SARA-listed species. Any of those are unlawful, offering a means of stopping the logging through court action.

  22. Why are species at risk in Canada still in steep decline, even after being listed under the Species at Risk Act? Because dedicated people like this are completely lacking in our responsible government agencies, except for some within Parks Canada.

  23. Far from being the saviour of at-risk species, Canada's Species at Risk Act is being used as a legal blueprint for obliterating those highly vulnerable species in the service of industry. SARA could be effective at protecting & recovering at-risk species, but only if the Government of Canada chooses to use it according to its stated purpose and clearly written provisions

  24. Wondering where Canada's Department of Fisheries & Oceans (DFO) might be headed in administering the country's Species at Risk Act in Alberta? So am I, after examining lobbying by the Alberta Forest Products Ass'n, which wants to "balance" SARA against loggers' economic interests. Draft report for public review here:

  30. A classic problem with Canada's Department of Fisheries (DFO's) interpretation of the Species at Risk Act (SARA).

    rmoutlook.com/kananaskis-count

While the logging company failed to get a permit for this work, the real problem is that DFO would have given them one, as it almost certainly will, unlawfully, for the additional roads & watercrossings required for its logging operations. All of it potentially impacts legally-protected critical habitat for threatened bull trout.

  37. Lawyer Shaun Fluker critiques EnviroCan's draft Offsetting Policy for Biodiversity with respect to Canada's Species at Risk Act:
    - It doesn't appear to meet SARA s.73 requirements.
    - "Legal mechanisms under SARA for compliance and enforcement, as well as resources to implement such mechanisms, are currently woefully inadequate to meet the level needed to ensure a biodiversity offset meets its objective on habitat harms."
