This project can be stopped. The Species at Risk Act prohibits damaging any part of critical habitat, redds, or individuals of any listed species without a permit, including the 2 trout species affected here. Canada can issue permits to allow it, but not for the purpose of allowing coal mining. While a counterargument to this view exists, it must be tested in court. Ecojustice needs to take this on.

Far from being the saviour of at-risk species, Canada's Species at Risk Act is being used as a legal blueprint for obliterating those highly vulnerable species in the service of industry. SARA could be effective at protecting & recovering at-risk species, but only if the Government of Canada chooses to use it according to its stated purpose and clearly written provisions
