"A senior astronomer has warned that NASA’s #Artemis program must not become a vehicle for unregulated commercial activity in space, arguing that the return of humans to the #moon should be governed by clear international rules — rather than a 'frontier mentality.'"

“Satellite #megaconstellations operated by developed countries are affecting the pristine night skies of other nations, affecting astronomical observations and #Indigenous practices. International regulation that includes the views of Indigenous peoples and appropriate compensation are called for.”

Today CSE filed our Reply Comment with the U.S. Federal Communications Commission challenging Reflect Orbital's application to commercialize the night sky. We maintain that the FCC must uphold legal mandates by requiring a comprehensive environmental review before granting any authority that alters our shared nighttime environment.

Frontier justice: navigating the future legal landscape for private actors in space law

"International agreements covering rocket pollution include the Outer Space Treaty and Liability Convention. They require countries to avoid harmful contamination and to accept responsibility for damage caused by their #space objects. Those principles are reflected by several International Court of Justice rulings and opinions on preventing cross-border environmental harm."

An interesting diplomatic communication today from #France toward #Russia: https://onu.delegfrance.org/france-reaffirms-its-support-for-international-space-law
"France reaffirms its support for international space law, which must be complemented by confidence-building and transparency measures, as well as by the development of norms of responsible behavior.
"In the face of threats, our primary safeguard remains compliance with the international legal regime applicable to outer space, and first and foremost the 1967 Treaty, which is its cornerstone.
"In this regard, France reiterates its concern about the potential placement of weapons of mass destruction in outer space, which would constitute a flagrant violation of Article 4 of the 1967 Treaty, and a major threat to international peace and security.
"In addition, France is involved in ongoing discussions in the competent bodies on ways to prevent an arms race in outer space. The most appropriate approach to this end is the development of norms of responsible behavior that promote mutual understanding and reduce the risks of uncontrolled escalation. These norms could serve, if necessary, as a basis for the subsequent development of new legally or politically binding instruments."

10.30am A hybrid meeting connects Nalani Wilson Hokowhitu (Molokaʻi Nui a Hina, Kanaka ʻAukai, Kanaka ʻŌiwi) & a group at #SpacePlace, with Desna Whaanga-Schollum (Rongomaiwahine, Pāhauwera, Kahungunu, Ngāi Tahu Matawhaiti ki Māhia) in Māhia, with Michelle Maloney, in Meanjin/Brisbane, Australia.
Dr Michelle Maloney is an author on the Australian Earth Laws Alliance’s Declaration for the Rights of the Moon (2021), and joins us to speak about its aims and challenges faced.

"The Dark and Quiet Skies Campaign serves us well to remember that the governance of outer space is not simply about money and geopolitics. The values of science and culture also have a place. As you follow the track of a satellite across the night sky this week, consider what kind of sky and scientific legacy we want to leave for future generations."

Starting the day right with a Tim Tam Slam! Afterwards, I'll have a look at “the dark side” of #SpaceLaw in the session on use of force in space. Really looking forward then to meeting with Open Lunar Foundation.

Space Data as ‘Investment’ in International Investment Law
Outer space is now a dynamic, commercialized arena, prompting economic and legal systems to reassess how value is defined beyond Earth. The rise of private actors has driven new value models, especially around a key 21st-century asset: data. Space-based data,

Next week is all about #spacelaw for me!
On Monday I’ll be participating in the Aviation Week Network Roundtable on the “Golden Dome for America and Implications for the Space Industry”.
On Tuesday I’ll be on the #SpaceTechExpo stage talking about the changes we can expect to the aerospace industry under the new administration and how space companies can adapt to thrive in this “new” ecosystem.

When Neil Armstrong planted the American flag on the Moon, it raised a huge question—who actually owns space? 🌕💼
With asteroid mining, lunar bases, and Mars settlements on the horizon, space law is no longer science fiction. 🌌 But without clear rules, could the final frontier become the next Wild West? 🤯Read more in:

"The fact that the #EU #Space Act establishes some binding measures regarding collision avoidance, information sharing, cybersecurity, and other space activities will break with past reluctance to go down that path and establish a new model. The United States and other stakeholders will find new challenges to their preference for laissez faire-driven space traffic management and space sustainability policies."

"Recognizing #Indigenous knowledge systems as a vital part of humanity’s shared relationship with the cosmos is essential to ensuring that the expansion of space activities is both inclusive and sustainable. By fostering dialogue and integrating Indigenous perspectives into space governance, it is possible to strike a balance between technological progress and the protection of cultural heritage."

"This potential treasure hunt in space has sparked discussions about ownership laws, space ethics, and environmental implications. As these celestial bodies could herald an era where space becomes a frontier for industry and sustainable energy, they invoke questions about the regulation of extraterrestrial resource claims."

More coverage of obtrusive space advertising, by @Gizmodo. "Astronomers are calling for a global ban on space advertising, in hopes that the issue can be nipped in the bud amid a period of rapid commercialization and privatization in spaceflight."

"Once considered a largely peaceful domain, #space is now viewed by many American lawmakers and military commanders as a place where the next major global conflict might unfold," but "there are surprisingly few international agreements to safeguard against military action there — and no established norms."

On the morning of the 14th at #SpaceTechExpo, I will be on a panel discussing the global growth of the aerospace industry, the opportunities and challenges faced by commercial space companies in this developing international marketplace, and the space legal trends emerging in the Unites States and worldwide.
This will be a great conversation about how to build sustainably for our off-world future while navigating uncertainty.

While the #OuterSpaceTreaty offers broad principles to guide the activities of nations, it does not offer detailed “rules of the road.” Essentially, the treaty assures freedom of exploration and use of space to all humankind. There are just two caveats to this, and multiple gaps immediately present themselves. https://edition.cnn.com/2022/01/03/world/space-law-united-nations-partner-scn/index.html

In just a few days I will be on the road again, heading to #ASCEND2023 to present on the future of space governance and connect with tons of other professionals in the aerospace community. (I’ve also got some fun foodie dinners planned since it is Las Vegas.)
If you are going I hope you’ll stop by Forum 108 on Monday, October 23rd at 2:00 p.m. to hear my presentation: Private Entities as Actors in Regional Space Governance Organizations.

One of the reasons #IAC2023 was such a big deal for me was that I got to organize, facilitate, and speak at a Special Session (SpS) devoted entirely to #spacelaw. (Special Sessions provide a much larger stage than Technical Sessions or Interactive Presentations and there is a lot more opportunity to really deep dive into a topic.)

Guess where I’ll be in a month? Hint: It’s the other big international aerospace conference happening in October. That’s right I’m presenting at ASCEND this year!
Catch me on Monday, October 23rd at 2:00 p.m. in Forum 108 for my presentation on "Private Entities as Actors in Regional Space Governance Organizations”.
Let me know in the comments if you are also heading to #ASCEND2023.

Sure, you do mediations, but do you do #aerospace mediations?
Actually, I do.
My unique understanding of traditional #businesslaw, #internationallaw, and #spacelaw allows me to conduct #mediations and #arbitrations geared specifically towards the aerospace industry.
I understand the inherent differences between the working environment at space companies as compared to other businesses and I also appreciate the large investments and years of work that go into all aerospace projects.

#TodayILearnt The framers of the #BrazilianConstitution not only remembered that #SpaceLaw exists but also made legislating it a sole power of the Union (i.e. National Congress).
