The Court's preferred amici don't see any support for an emergency motion to stay. Instead of acting like there's an emergency, Trump waited almost 3 weeks to file and instead of explaining why this is an emergency Trump only threatened to speak to the court's manager, like a common Karen. (Doc 119)
Accordingly, the Court gave its amici until 2026/08/14 to respond to the now-not-an-emergency motion to stay pending appeal. (Doc 120)

The Republican holdouts, Sens John Cornyn (TX) & Thom Tillis of (NC), had vowed that they would not confirm #ToddBlanche for the role unless he provided written assurances that the #DOJ had formally killed a planned $1.8B #SlushFund to pay #Trump allies who claim they were unfairly persecuted by the government.
The senators also insisted that Blanche narrow the scope of the sweeping #immunity from #IRS scrutiny granted to Trump, his family & their businesses under the same agreement.

Judge Brinkema said the case remained open because #ToddBlanche & the #DOJ refused to file an affidavit under penalty of perjury “that they will not take any action to create or operate” the payout fund & that it “will not proceed in any manner, under any name.”
Blanche has pushed back against such demands. Even as he promised lawmakers in June that the #SlushFund was dead, he said that “I’m not committing to putting anything in writing.”

In testimony in May, #ToddBlanche told senators there was “no mechanism” for a legal review of the agreement creating the fund. He argued documents had never been submitted to a court for scrutiny because the case, a lawsuit #Trump filed against the #IRS over the leak of his tax returns, was dismissed.
