They were wholly disrespectful of the #StandingRockSioux Tribe, our ancestors, and our youth, who started the movement in 2016 to protect our water from an oil spill from #DAPL. Neither Greenpeace nor anyone else paid or persuaded Standing Rock to oppose DAPL.

    "Our young people and our elders urged us to protect our water and #UnciMakah (grandmother earth). That is what happened, and is happening still. The scenes of guard dogs menacing Tribal members are reminiscent of the violence of #WhiteSupremacists in the #DeepSouth during the 1950’s and 60’s, but it was in North Dakota, in this day and age. It was on the news and on the internet.

    "Many of the protesters were Native American veterans of the United States armed forces. Energy Transfer used attack dogs against peaceful protesters and war heroes. But the jury sided with the out-of-state, unlicensed security with the attack dogs, instead of North Dakota veterans who supported Standing Rock.

    "A Texas oil company has come to North Dakota, and its lawyers and propaganda machine are weaving stories about how the Standing Rock Sioux Tribe and our supporters have lied, and how the poor pipeline company, a trillion dollars richer than in 2016 when this all started, should receive extra millions from non-profit organizations. It’s a funny thing about liars – they always accuse everyone else of lying. The Greenpeace trial was marked by secrecy.

    "The court is not making the transcript public. The documents obtained by Greenpeace about Energy Transfer’s terrible safety record are protected by a secrecy order and are not available to the public. The judge exhibited so much bias in favor of Energy Transfer that a team of international human rights lawyers felt compelled to monitor the trial. One prominent monitor stated 'In my six decades of legal practice, I have never witnessed a trial as unfair as the one against Greenpeace that just ended in the courts of North Dakota.'

Who is looking out for the communities that may be affected by an oil spill? And why didn’t the North Dakota court allow Greenpeace to address these questions at the trial?

    #SLAPP – dieses Kürzel steht für strategic lawsuits against public participation und befasst sich mit einem Phänomen, das sich steigender Beliebtheit erfreut: Klagen, die in erster Linie erhoben werden, um unliebsame Kritik zu unterdrücken. Insbesondere bei rechten Akteuren sind SLAPPs [...] Allerdings wird diese Anti-SLAPP RL oft nicht greifen, gerade, wenn es um SLAPPs von rechts geht. Eine recht offensichtliche Schwäche liegt schon in der Zuständigkeit der EU. Ohne grenzüberschreitenden Bezug liegt keine Kompetenz vor. So greifen die Regeln nur, wenn im konkreten Fall Anknüpfungspunkte in mehr als einem EU-Staat bestehen. Bei nur 9,5% der erfassten SLAPPs lag dieser grenzüberschreitende Bezug 2023 vor. Die Mitgliedstaaten haben nun etwa zwei Jahre Zeit die Vorgaben der Anti-SLAPP RL umzusetzen, ob sie dabei der Aufforderung der EU nachkommen und analoge Regeln für inländische Verfahren erlassen werden, bleibt abzuwarten. Ein noch größeres Problem ist aber, dass die Anti-SLAPP RL zu spät eingreift. Sie enthält nur Regeln für gerichtliche Verfahren, während SLAPPs in aller Regel mit einer – oft teuren – Abmahnung beginnen. Im rechten Spektrum ist dies ein beliebtes Instrument, Hans-Georg Maaßen bekennt sich bspw. offen zur Abmahntaktik. Für die*den Abmahnende*n hat dies mehrere Vorteile: Zunächst kann sie*er so auf einfach Wege und oftmals ohne rechtliche Prüfung auf der Gegenseite eine strafbewehrte Unterlassungserklärung erlangen. Zugleich schüchtert der dort aufgeführte Streitwert und die anwaltliche Gebühr der Abmahnung (die natürlich der*demjenigen aufgelegt wird, deren*dessen Äußerung angeblich rechtswidrig war) ungeheuer ein. Würde es zu einem Verfahren kommen, so drohen die Abmahnungen regelmäßig an, werde es erst richtig teuer. Warum funktionieren SLAPPs von rechts so gut? An dieser Stelle knicken diejenigen, die von (rechten) SLAPPs betroffen sind, regelmäßig ein. Zahlen und schweigen. Wie kommt es, dass Betroffene oftmals hilflos sind?     "The U.S. litigation system is meant to resolve serious disputes. Unfortunately, the high cost of litigation can be weaponized as a means of #harassment and #censorship. That’s become all too common, and the last few decades have seen the rise of what’s known as a #StrategicLawsuitAgainstPublicParticipation, or #SLAPP.

    "At #EFF, as more speech of all types has moved online, we’ve seen SLAPPs proliferate over #DigitalSpeech. SLAPPs get filed against #protesters who oppose #OilPipelines, and regular people doing everyday things like sending #emails to local officials, or even posting an online review.

    "Five years ago, together with Greenpeace and other environmental nonprofits, EFF helped create the #ProtectTheProtest coalition, or #PTP. It’s a group of nonprofits that supports its members and others in their fights against SLAPP lawsuits.

    "One of the lawsuits that spurred the formation of PTP was #ResoluteForestryProducts v. Greenpeace. In this case, a #logging company claimed that Greenpeace’s advocacy for #CanadianForests amounted to a 'global #fraud' that should be punished under civil #RICO laws—U.S. federal laws that were originally intended to go after organized crime.

    "Following a summary judgment hearing last week, the Resolute v. Greenpeace case has finally been put to rest, with a complete victory for Greenpeace. This baseless lawsuit, which lasted seven years, should never have been brought in the first place. We hope Greenpeace’s victory against #Resolute sends a strong message to corporate SLAPP plaintiffs—you won’t win, and your targets won’t stay silent."
