WTF! #HolbrookMA DPW workers arraigned for allegedly attacking sleeping #homeless man

HOLBROOK, Mass. — "Two brothers who work for the Holbrook, Massachusetts, Department of Public Works were arraigned Thursday for allegedly attacking a sleeping homeless man in a town park last month.
"Jesse Baxter, 32, of Holbrook, and Jake Baxter, 28, of Randolph, were charged with assault and battery with a dangerous weapon (shod foot), assault and battery on a person over the age of 60, and witness intimidation.
"A not guilty plea was entered on their behalf.
"They were arraigned in Quincy District Court, where a judge set $1,500 bail for Jesse and $500 for Jake.
"Both men are expected to post bail and were ordered to stay away from the victim and #BrookvillePark.
"They will return to court for a dangerousness hearing at a later date.
"Both Jesse and Jake have been placed on paid administrative leave from the DPW.
"According to a Holbrook police report, officers responded to the area of Linwood Street overnight on June 20 for a report of an injured man knocking on residents' doors and yelling.
"Responding officers found the man covered in blood and bruises.
"According to the man, he was sleeping in his tent in the Brookville Park area around 12:30 a.m. when he was attacked by two men he didn't know." [Allegedly, they were there to attack a DIFFERENT homeless man that they had an argument with.]

"Kaitlyn Schwartz joined dozens of other campers under the Center Street off-ramp on July 13 in packing up her belongings and figuring out where she would sleep next.
" 'This is not living,' she said. 'We’re only surviving.'
"The 23-year-old said she tries to keep a clean camp and look out for others.
" 'I'm trying to make a difference,' she said.
"While she's young, many people living in the #encampments are older and vulnerable. Schwartz said she's been the target of sexual violence and theft and has witnessed drug overdoses.
"Some people lose everything they own when a sweep occurs.
" 'How is anyone supposed to live like this?' she asked."

"In its biggest decision on homelessness in decades, the U.S. Supreme Court today ruled that cities can ban people from sleeping and camping in public places. The justices, in a 6-3 decision along ideological lines, overturned lower court rulings that deemed it cruel and unusual under the Eighth Amendment to punish people for sleeping outside if they had nowhere else to go.
"Writing for the majority, Justice Gorsuch said, 'Homelessness is complex. Its causes are many.' But he said federal judges do not have any 'special competence' to decide how cities should deal with this.
" 'The Constitution’s Eighth Amendment serves many important functions, but it does not authorize federal judges to wrest those rights and responsibilities from the American people and in their place dictate this Nation’s homelessness policy,' he wrote.
"In a dissent, Justice Sotomayor said the decision focused only on the needs of cities but not the most vulnerable. She said sleep is a biological necessity, but this decision leaves a #homeless person with 'an impossible choice — either stay awake or be arrested.' "

Excerpt: "When the weather in the city centre is forecast to drop below zero - as it has repeatedly in recent days - severe weather emergency protocol is called in, meaning that the council increase their outreach to the homeless, offering a warm place to everyone who may be #SleepingRough.
"Users have to be referred there through the council's #RoughSleepers service, either through council officers, other voluntary providers in the Manchester Homeless Partnership or even members of the public.
"The Rough Sleepers team then co-ordinate who is going where, either to council-operated accommodation or sites run by other partners.
"Users have to get there under their own steam, whether it's through their own means or a bus pass or taxi funded by other charities and partners.
"They are free to lie down and sleep, but no drink or drugs are allowed ('it would be unmanageable,' one staff member says) and they must be gone by 8am.
"However, in some instances users stay for several nights in a row, though they have to vacate the space during the day. Some users move into temporary accommodation in the rest of the hotel if a space becomes free."
