Aktueller Nachtrag zur »Bürgerin Donau« (https://ingo.lantschner.name/series/bürgerin-donau/): Während über neue Rechte für die Natur diskutiert wird, schließt der Entwurf des neuen Klimagesetzes (137/ME, Begutachtung bis 30. Oktober) Rechtsschutz ausdrücklich aus. § 16 Abs. 4 erklärt es zum »Selbstbindungsgesetz« ohne subjektive Rechte, laut Erläuterungen ist »ein Rechtsschutz nicht vorgesehen«. Klimafahrplan und NEKP sollen keine Rechtsquellen sein und damit von den Höchstgerichten nicht geprüft werden können. Eine Standortklausel erlaubt sogar, das Zieljahr 2040 zu verschieben.
Das betrifft »zufällig« die Lücke, derentwegen die EU-Kommission seit 2014 ein Vertragsverletzungsverfahren zur Aarhus-Konvention gegen Österreich führt.
Die SPÖ hat den Entwurf mitbeschlossen. Ihre Umweltsprecherin Julia Herr hat zugleich eine der zahlreichen Petitionen eingebracht, die der Natur Eigenrechte in der Verfassung geben wollen. Wie geht das zusammen? Sollen durch den Verfassungsrang solche einfachgesetzlichen Tricks verhindert werden? Doch warum beteiligt man sich dann an der Trickserei?
Scientists for Future haben eine fundierte Stellungnahme zum Entwurf eingebracht. Sie zu unterstützen halte ich für weit sinnvoller, als neue Rechte für die Umwelt zu fordern – auch wenn das eine das andere natürlich nicht ausschließt:
