“L’accusa è sempre la stessa: abuso di posizione dominante. Le due sentenze contro #Google, però, hanno origini e fondamenti diverse. La prima, in ordine cronologico, è quella emessa dal Tribunale per i brevetti e il mercato di Stoccolma, che ha accordato un maxi risarcimento di 1,7 miliardi di euro a PriceRunner, piattaforma di comparazione dei prezzi controllata dalla svedese Klarna. Secondo il collegio giudicante, Google avrebbe infatti sfruttato il suo motore di ricerca web per favorire il servizio Google Shopping, penalizzando il concorrente. La sentenza è ancora appellabile.
La vera mazzata per l’azienda di Mountain View, però, arriva dalla Corte di Giustizia Europea. Nella giornata di ieri, infatti, i giudici hanno respinto l’appello di Google in merito a un provvedimento della Commissione Europea del 2018, che aveva condannato l’azienda per le pratiche anti-concorrenziali sul suo sistema operativo per smartphone #Android. Qui le cose si fanno più complicate. Le accuse, infatti, riguardano le condizioni imposte da Google ai produttori di smartphone che utilizzano Android.
In teoria il sistema operativo sviluppato da Google è infatti distribuito con licenza open source e, di conseguenza, dovrebbe lasciare un certo margine di libertà a chi decide di implementarlo.
Secondo la Commissione Europea, però, l’azienda avrebbe imposto ai produttori una serie di vincoli per garantirsi notevoli vantaggi sugli eventuali concorrenti. Tra questi gli accordi di distribuzione, che imponevano ai produttori di dispositivi mobili di preinstallare l’app di ricerca Google Search e il browser Chrome sui dispositivi come condizione per poter ottenere la licenza per utilizzare il suo app store ufficiale Play Store.
Non solo: Google avrebbe anche imposto degli “accordi anti-frammentazione”, cioè un impegno da parte dei produttori a non installare versioni di Android non approvate dall’azienda stessa, pena l’essere tagliati fuori (ancora una volta) da Play Store.
Infine, nel mirino della Commissione sono finiti gli “accordi di condivisione dei ricavi”, che prevedevano una partecipazione dei produttori agli utili pubblicitari generati dai servizi di Google solo se avessero garantito una sorta di esclusiva all’azienda di Mountain View, impegnandosi a non preinstallare nessun sistema di ricerca concorrente. Tradotto in soldoni, il patto potrebbe essere riassunto così: “se mi dai il monopolio delle ricerche sui tuoi dispositivi, ti do una fetta dei guadagni”.
Insomma: il “sistema operativo libero” di Google non sarebbe stato così libero. Anzi: per utilizzarlo, i produttori di smartphone avrebbero dovuto legarsi mani e piedi allo sviluppatore e, soprattutto, garantire di non acconsentire ad alcuna apertura nei confronti di eventuali concorrenti.
La sentenza, al di là della sanzione record da 4,1 miliardi di euro, ha un impatto più ampio. In sostanza, il respingimento dell’appello di Google e della controllante #Alphabet nei confronti della decisione della Commissione Europea rappresenta una secca bocciatura delle strategie di business della società guidata da Sundar #Pichai.
La logica a cui si è ispirata Google è sempre stata, infatti, quella di fornire la licenza di utilizzo del sistema operativo gratuitamente (o a prezzi irrisori), contando sul fatto che la sua diffusione fosse uno strumento per far convergere gli utenti verso i suoi servizi.
Ed è proprio da questi ultimi che la società ha sempre ottenuto i reali ricavi, generati attraverso i soliti strumenti di profilazione e la conseguente vendita di pubblicità “mirata” agli inserzionisti.
La stangata della Corte di Giustizia Europea arriva a pochi giorni dalle esternazioni di Donald #Trump, che lo scorso 26 giugno ha postato su Truth Social l’ultimatum diretto ai paesi Ue minacciando dazi del 100% a chi avesse osato penalizzare le big tech mande in Usa attraverso lo strumento della Digital Services Tax. Non è escluso che la sentenza della Corte possa diventare un ulteriore casus belli tra l’Europa e gli Stati Uniti. Nel momento in cui scriviamo, il 47esimo presidente Usa non ha ancora proferito verbo sulla vicenda. Difficile, però, che si lasci sfuggire l’occasione -

My impression is that Sundar Pichai and his hand-picked division heads don't care about users, or truth, or injury to the innocent, or harm to the sites they now prefer to not direct any traffic to so long as they can still train their "AI" from their content -- just so long as the "engagement metrics" point in the right direction, to satisfy the "line goes up forever" stock-analyst types .
It is completely evil, but a banal evil that is difficult to get the media to report on (even if they weren't conflicted by ownership and sycophancy).
I don't see Google coming back from this without a clean sweep of the executive suite, and the board isn't independent enough to even consider that.

— including AI kingpin Sam #Altman; Disney CEO Bob #Iger and a coterie of his potential successors; plus all of the usual suspects like Apple’s Tim #Cook, Meta’s Mark #Zuckerberg, Google’s Sundar #Pichai, media moguls Rupert #Murdoch and #Oprah Winfrey and many others, including David #Zaslav, the CEO of CNN’s parent company Warner Bros. Discovery, according to Bloomberg and Variety.
(A spokesperson for Warner Bros. Discovery confirmed Zaslav would attend.)There are also some notably absent names from the guest list this year.
There’s Buffett, who is normally a fixture at the event but who is nearly 94 and, perhaps, happy to let his spryer successor, 62-year-old Greg #Abel, handle the high-altitude trekking and chit-chattery. Less likely but still half-seriously rumored is that Buffett is avoiding the shindig after the press last year picked up on his wife, Astrid, complaining about having to pay $4 for a cup of coffee.
Also absent this year is Elon #Musk, who might seem like a shoo-in until you imagine him winding up on a rafting trip with a bunch of CEOs whom he publicly urged,
less than a year ago, to go f— themselves.While we expect plenty of chatter about artificial intelligence, the Succession-level drama about Iger’s succession plan, and the head-spinning negotiations that led to the Paramount-Skydance merger, there is one giant elephant — or donkey — in the room this year.
Questions about President Joe #Biden’s ability to campaign have wealthy donors and Democratic officials in a tizzy.
And it would be hard to imagine that a gaggle of elite media moguls would sit around the fire with their s’mores and bourbon and not speculate about potential replacements on the 2024 ballot.That could make the week particularly important for three governors on the guest list this year: Gretchen #Whitmer, Josh #Shapiro and Wes #Moore, all of whom have been floated as potential Biden replacements, even as the president forcefully denies that he’s contemplating dropping out.
The political intrigue is, well, intriguing. But it’s also a timely reminder to zoom out and consider just how powerful the US has let its billionaire class become, and how events like Sun Valley amplify the inequities in America that are so systemic we hardly bat an eye at them.
