  2. "Our submission suggested that Ofcom should consider whether the provider may violate the laws of a third country in complying with a technology notice. There is no such requirement in the Act, and it was not mentioned in Ofcom’s guidance. The guidance did note that a technology notice will only be imposed in relation to the operation of a service in the UK or as it affects UK users of the service. But there are serious concerns over whether an accredited technology could target only UK users on a global communications service without sweeping in the communications of users in other countries (and thus triggering a potential conflict of laws). We advised that a requirement should be added to the guidance that Ofcom should consider conflicting liabilities on the service provider before issuing a notice. In response, Ofcom amended the guidance to state that it will consider a potential conflict with foreign law, so long as such a conflict is raised by the provider.

This is an issue which I think has been overlooked in much of the commentary (academic and policy) on this power and similar proposed powers debated in the EU child sexual abuse regulation. Most of the services that are within scope of technology notices (and the proposed EU ‘detection orders’) are global services. I expect it would be technically difficult, not to mention costly, for these service providers to figure out how to scan the communications of only UK users. Further, how are we identifying a ‘UK user’—someone who is in the UK, a UK citizen, a UK resident, etc? Limiting the interception or scanning of communications to UK users may play politically, but in practice, it seems infeasible."

  18. great breakdown of Sony's compliance with Online Safety Act's ID verification requirement (because it should be called for what it is) and awful choice of provider youtu.be/BU7NIVWJigM

one thing missed: as far as I understand, Sony's "age verification" by phone number is deceptive bc it clearly states that it'll use "owner of the phone contract" details. which means PAYG SIM card owners are locked out.

  30. @bluetea now 5 years ago you’d say I was a member of the tinfoil-hat wearers if I suggested that the UK #OSA as an extension of the 2010 Digital Economy Act (now 2017 DEA <en.wikipedia.org/wiki/Digital_>) was compromised by external influence from foreign actors now being rolled out in many Western democracies.

You would have also dismissed the fact that laws would be passed, compromising citizens of many countries through identity exposure along with their Internet usage. Identity is the key.

Now we see the sponsor of that bill in 2009, an English peer, a traitor, #Mandy,
former member of #HouseOfLords with extensive ties to foreign influence. This individual is now PNG.

It doesn’t take an Einstein to see the shadow influence on Western democracy: <en.wikipedia.org/wiki/Peter_Ma>

While the D.H.S. is flooding platforms with subpoenas to unmask anti-I.C.E. accounts and the Heritage Foundation wants to use KOSA to censor LGBTQ+ and abortion content, Dems and Republicans are working hard to abolish you're right to online anonymity, empower state attorneys general to mass censor any content online, and funnel tons of money and you're personal data to Peter Thiel

  36. I wrote a quick #playdate app prototype, sleepmate, that uses the accelerometer to detect when I'm sleeping on my back vs side sleeping. This is useful to know as I have mild #osa that worsens when I'm on my back. It requires that you strap the playdate to your chest while you sleep 😅...but it seems to work!
