Now that the vast majority of US citizens are barely living week to week on the verge of falling into financial insolvency at any moment, and many having to even able to access food for themselves and their families; the very companies responsible for creating those conditions have now moved over here and have been working hard to create those same conditions and outcomes in the hopes that threatening us with removing or delaying access to the latest iPhone, or having access to fewer camera filters, would be convincing enough enough for us to trade our rights, environment, and economic future for in exchange. Sadly it seems there is an entire population of people in #Brussels who have fallen for this second rate faustian bargain.

Prezes Urzędu Ochrony Konkurencji i Konsumentów (UOKiK) wydał decyzję zobowiązującą platformę Booking.com do wprowadzenia istotnych zmian oraz przyznania rekompensat swoim klientom.
Urząd zakwestionował sposób, w jaki serwis informował użytkowników o tym, od kogo tak naprawdę wynajmują nocleg, co mogło naruszać ich prawa. Jeśli korzystałeś z platformy w ciągu ostatniego półtora roku, możesz być uprawniony do otrzymania korzyści.
Postępowanie Prezesa UOKiK wykazało, że Booking.com nie informował w sposób jasny i jednoznaczny, czy dany obiekt noclegowy jest oferowany przez przedsiębiorcę, czy przez osobę prywatną. Jest to kluczowa informacja, ponieważ w przypadku rezerwacji u osoby fizycznej, konsumentom nie przysługuje pełna ochrona wynikająca z prawa konsumenckiego (np. prawo do odstąpienia od umowy). Dodatkowo, niejasny był podział obowiązków między platformą a wynajmującym, co utrudniało m.in. składanie reklamacji.
Jak zdobyć rekompensatę?
W odpowiedzi na zarzuty, Booking.com zobowiązał się do przyznania rekompensat poszkodowanym użytkownikom. Oto, co musisz wiedzieć, by z nich skorzystać:
- Kto jest uprawniony? Rekompensata przysługuje osobom, które dokonały rezerwacji na Booking.com w okresie od 1 stycznia 2023 r. do dnia wprowadzenia przez firmę zmian wynikających z decyzji.
- Co trzeba zrobić? Należy złożyć reklamację do Booking.com, powołując się na decyzję zobowiązującą wydaną przez Prezesa UOKiK. Reklamacja musi dotyczyć jednej z kwestii poruszonych w decyzji, np. braku informacji o statusie wynajmującego.
- Co można zyskać? Forma rekompensaty zależy od Twojego poziomu w programie lojalnościowym Genius:
- Użytkownicy na poziomie 1 i 2 otrzymają awans o jeden stopień w programie Genius, co może przełożyć się na większe zniżki.
- Użytkownicy na poziomie 3 otrzymają 40 zł do wykorzystania na rezerwacje w serwisie Booking.com.
Platforma zobowiązała się do wprowadzenia zmian, które zwiększą przejrzystość ofert. Oznacza to, że przy każdej ofercie będzie musiała pojawić się czytelna informacja o tym, czy wynajmujący jest przedsiębiorcą, co pozwoli konsumentom na podejmowanie bardziej świadomych decyzji. Działania UOKiK to część szerszej akcji egzekwowania unijnej dyrektywy Omnibus, w ramach której do podobnych zmian na swoich platformach zobowiązali się wcześniej m.in. Allegro, Amazon czy Zalando.
