  1. So. To try to use controversy and #bikelash to distract from the Centurion data breach and UCP electoral boundary gerrymandering scandals, the UCP are rolling out anti-bicycle legislation on Monday.

Insiders say it will use the #Notwithstanding Clause to circumvent the supreme court ruling that prevented Ford from ripping out bike lanes in Ontario.

Talk about low-bar callous disregard for safety: literally throwing people (kids!) in front of buses (& trucks). All to distract us from UCP perfidity.

    We won't take the bait.
    We will take the lane.

We'll stay calm, deflect back to #Centurion breach of 2.9M Albertans' privacy, the election boundary #gerrymandering, the UCP-fomented attacks on Canadian confederation, and pedal on.

  2. I just read Cody Mallette's vigorous defense of the notwithstanding clause in the National Post. It seems thoughtful and balanced, but it's bullshit.

You can bet your ass off that these right wing proponents of legislative bodies superceding jurisprudence or actual inalienable human rights would go to pieces if any province invoked s33 to strip property rights rather than just abuse marginalized communities and children.

    Notwithstanding, Rights are worthless

  3. @gnomon

Use the notwithstanding clause to remove the Alberta and Saskatchewan governments, and call elections.

    Sauce: goose, gander.

  4. Meanwhile, the same numpties keep invoking the #NotWithStanding clause saying something like, “you shouldn’t have included it if you didn’t want us to use it!”

  5. @KristopherWells

Premier Smith has repeatedly said the Legislature needs to have and use the #NotWithStanding clause because *they* are “accountable” to Albertans. I am glad to hear LaGrange’s constituents are working to hold her to account for their terrible laws.

  7. RE: c.im/@BBC/115611166632194901

Cutting court backlogs by … abolishing a human right, honoured since Magna Carta.

From a government that just released thousands from prison because there's no room for those already convicted.

And Canadian governments are using the ludicrously named #notwithstanding clause to suspend its Charter of Rights and Freedoms

My friends, we have to fight this battle for our rights all over again.

  8. @cbcnews

    Way to go Alberta!
    Recall petitions underway for:

Rajan Sawhney (Calgary-North West), - Minister of Indigenous Relations
Myles McDougall (Calgary-Fish Creek) - Minister of Advanced Education
Dale Nally (Morinville-St. Albert) - Minister of Service Alberta and Red Tape Reduction
RJ Sigurdson (Highwood) - Minster of Agriculture and Irrigation
Ric McIver (Calgary-Hays) - House Speaker
Muhammad Yaseen (Calgary-North) - Associate Minister of Multiculturalism
Demetrios Nicolaides (Calgary-Bow) - Minister of Education and Childcare
Nolan Dyck (Grande Prairie) - Parliamentary Secretary for Indigenous and Rural Policing
Angela Pitt (Airdrie-East) - Deputy Speaker

Sign a petition if you are in one of these ridings, volunteer to collect signatures, or start a new one! Smith has defended the use of the #NotWithStanding clause on the grounds that legislatures are accountable to the people, let’s show them what accountable means…

… keep up the good work!

  9. The #UCP gov of Alberta claims the #NotWithStanding clause was put there to prevent judicial over-reach. They have that exactly wrong and backwards:

The Charter of Rights and Freedoms was formulated precisely to prevent bigoted numpties from trampling all over the fundamental rights of unpopular minorities in int name of the majority, and the clause is there only because the bigots of the day wouldn’t have let it pass without a loophole.

They claim that in using the notwithstanding clause they are maintaining the ‘supremacy of the legislatures’ because they are ‘accountable’ to the electorate… great: let’s hold them to account.

Sign a recall petition if there is one in your riding, and if there isn’t - consider starting one. And as they show themselves to be too thin-skinned for so much ‘accountability’, be ready to hit the streets and show them what true accountability looks like.

  10. #UCP :

The #NotWithStanding clause is part of the law, we have every right to use use it as we see fit.

    also UCP :

The #RecallLaw that we passed wasn’t meant to be used *that* way, you can’t do that!

  11. @gvwilson

Smith claimed that “an overwhelming majority of Albertans” supported the three policies targeting trans people.

This is not true, but even if it were true it is precisely the reason that we have the Charter of Rights and Freedoms in the first place: to prevent a minority from being targeted and persecuted by a hostile majority.

The concept of rights are meaningless if they are not universal expressions of the inherent value of life protected principles by reciprocity, justice, and fairness.

#IDoStandWithTrans people in Alberta, not the #UCP government
    #TransRightsAreHumanRights #NotWithStanding

  12. I encourage every Albertan (and Canadian really) to listen to what UCP MLAs have to say about the notwithstanding clause, it boils down to something very simple:

We support the Canadian Constitution, and that includes the notwithstanding clause, because we believe those rights were never actually meant to be for everybody. We’ll be the judge of who gets rights and who doesn’t.

Their position really is that simple: rights aren’t for everyone.

And that’s why *every* Albertan - every Canadian - should be working to get these people and their ideological cousins (in Ottawa and elsewhere) out of office and as far from any influence in society as possible as quickly as possible.

  13. thank you Canadian Bar Association #CBA for speaking out about this #UCP #DanielleSmith flagrant abuse of the #Constitution #NotWithstanding clause!

  14. A word to organized labour in Alberta and beyond:

The last time there was a general strike in Canada, it wasn’t the result of months of talks and careful planning, it followed a steadily worsening situation, only a few weeks of individual separate strikes, and then coalesced within hours but lasted six weeks.

Don’t waste the movement that is happening, when people are ready to move, your job as organizers is to help them move in productive and coordinated ways, not to stop their movement.

    #LetsMove #ABPoli #Strike #NotWithStanding

  15. Very disappointed by today’s ‘announcement’ by Gil McGowan representing the AFL and the Common Front.

Alberta needs action and needs action NOW.
Not just conversations, not just talk.

Maybe a general strike can’t happen this week, but *something* needs to happen this week, and something as big or bigger than has happened yet.

McGowan spoke about ‘using all the tolls at their disposal’ - our biggest asset right now is A LOT of people who are very angry, upset, and ready to take a hit to express that and THAT is the the most valuable tool at their disposal.

I hope enough people express their dismay and disappointment that McGowan will understand that he has things backward: normally it takes lots of conversations and organizing to motivate people to come out - that motivational work has already been done by the government.

We just need a framework to step out into. Watch what happens tomorrow when student walk out… the feeling, the motivation is there.

    ACT NOW

and now we need ⚡ ACTION ✊

  17. hey #ableg #Notwithstanding #TeacherStrike folks, just came across this:

"Save the Charter" campaign, run by Forward Canada.

Is it legit? Zain Velji is involved, so looks legit to me, but best to double check these things. Already has >11k supporters.

    👉 savethecharter.ca/ 👈

please boost if you think it is legit!! something HAS to be done on a broad spectrum - responses from the AFL, Unions, the public.

  18. @SonofaGeorge

If the #NotWithStanding clause can be used preemptively without limit or review, then we simply don’t have most of the Charter.

  19. @Lynnd @Paulatics

    Close it down.

Carney, use the Notwithstanding Clause to call an Alberta election.

Notwithstanding good for the goose, notwithstanding good for the gander.

  20. Reading up on the #Notwithstanding clause of the Canadian Charter of Rights & Freedoms. I'd missed that there is an active case on it before the Supreme Court of Canada, in reference to Québec's "securalism" law (which prohibits public servants of all types from displaying signs of religious affiliation, including by wearing turbans or hajibs).

This is a good overview of the current arguments in that case, from the CBC's Aaron Wherry earlier this month (not yet updated to include mention of the Back to School Act passed late last night by the Alberta legislature & made law today):
    cbc.ca/news/politics/supreme-c

It gives some context to why that Act included broad strokes (s13-14) forbidding any sort of court challenge or official review of its constitutionality. The Alberta government's recent opinion in the SCC case is that use of the notwithstanding clause is "intended to be an authoritative determination by the legislature," shielded from any judicial review into political matters.

  21. Important to note that as the #UCP blows up Labour rights for Canadians, Premier Smith is in the UAE and will be all week. Seems like she doesn’t think Alberta workers or teachers are important enough to face directly.

    #ABPoli #Labour #NotWithStanding

  22. @britt

Teachers, Parents Notwithstanding that Alberta's Government is Broken, Notwithstanding the moral failure, notwithstanding the incompetent UCP, notwithstanding they don't care about your child's education....

Ignore them, support teachers, blockade the schools.

Whatever you do, ask teachers first.

  23. The Charter is not just a law, it is an expression of Canada’s most basic and deepest values. “Notwithstanding” the Charter means “I don’t share these values”. Any and every politician or government that proposes its use should face such an extreme backlash that no one would dare consider it.

  24. @Paulatics

The UCP will invoke the notwithstanding clause, declaring boldly and loudly that they do not stand with our children, they do not stand with charter rights, they do not stand with human rights, they do not stand with common decency.

My commitment is to the with-standing clause:
I stand with trans youth, I stand with trans adults
I stand with their charter rights, I stand with their human rights.
    I stand with common decency.

  25. In my home province of #NewBrunswick our autocrat #oilExec #premier #blaineHiggs is attempting to #criminalize #drugAddiction and #homelessness. He's already threatened to use the #NotWithstanding clause to force his new "mandatory addictions treatment" bill through.

We have ZERO space in addictions programs.
We have ZERO free beds in hospitals.
We have a BRAND NEW jail being built that no one knows why.

The people on our streets will be rounded up and left to rot in overcrowded lockups where they will NOT receive adequate medical treatment, nor the financial and social services they **ACTUALLY NEED**.

It's actions like these that have caused A DOZEN of his own party members to resign.

Let's all stand up against this dehumanizing attack!
