De madrasa en de universiteit
Mustansiriya-madrasa, Bagdad[Dit is het laatste van acht blogjes over het ontstaan van het islamitisch recht. Het eerste was hier.]
In het vorige blogje beschreef ik hoe de ulama, de islamitische rechtsgeleerden, enkele jaren vervolgd waren geweest door de kalief. Dit was vanzelfsprekend traumatisch en het is logisch dat ze zich begonnen te organiseren. In eerste instantie gebeurde dat in de vorm van een gilde. Wie toetrad, moest de gebruikelijke drie rangen doorlopen: eerst was hij leerling ofwel mutafaqqih; na het afronden van zijn studie gold hij als gezel of sahib; blonk hij uit, dan kon hij meester ofwel mufti worden.
De madrasa
In tweede instantie versterkten de geleerden zich door deze gilden om te vormen tot een waqf, wat kan worden vertaald als “religieuze stichting”. Deze beheerde een groot vermogen, dat garandeerde dat de geleerden hun onafhankelijkheid konden handhaven. Vaak werd het kapitaal verworven door middel van een legaat of een andere schenking. Daarbij kon de schenker als voorwaarde stellen dat zijn afstammelingen bepaalde rechten zouden uitoefenen, wat handig was voor politici die hun kinderen wilden voorzien van geleerde raadsheren. Zulke rechtscolleges werden aangeduid als madrasa.
Steeds was het dagelijks bestuur en het beheer van de goederen opgedragen aan het gilde als geheel. Alle leden van het instituut, dus ook de studenten, hadden zitting in de vergadering van geleerden, dat het dagelijks bestuur opdroeg aan een voor een jaar gekozen voorzitter, de ra’is al-madhhab.
Tot zover de formele kant van de islamitische scholen. De kern van de studie zelf bestond uit het voortdurende debat tussen de geleerden. Dát was immers de manier om de ijma’, de consensus der geleerden, vast te stellen. Daarom was het van belang dat de lesprogramma’s duidelijk waren afgebakend en er scherpe eisen werden gesteld waaraan moest worden voldaan om te worden toegelaten tot een hogere wetenschappelijke rang. Niet iedereen mocht onderwijs geven of een bijdrage leveren aan de consensusvorming der geleerden: de lesbevoegdheid stond bekend als de ijazat at-tadris van de mufti.
De universiteit
De Amerikaanse arabist George Makdisi (1920-2002), over wie ik al eens blogde, heeft erop gewezen dat we hier in feite het ontstaan zien van het doctoraat: een erkenning, door andere geleerden, dat men een vakgebied voldoende beheerst om eraan te mogen bijdragen. In de wereld van de islam was dit een noodzakelijke ontwikkeling. Dáár was de consensus der geleerden immers van belang om de orthodoxie vast te stellen, dáár was een systeem van gekwalificeerde professionals noodzakelijk. Dat het doctoraat in de Middeleeuwen ook werd overgenomen in West-Europa, is echter opvallend: in het christendom, waarin concilies, synodes en kerkelijke autoriteiten bepaalden wat de juiste leer was, was het doctoraat in feite overbodig.
Er is echter meer aan de hand. De rechtsscholen hadden eigen middelen en konden daarmee de traditie van permanente discussie doorgeven aan toekomstige generaties. De madrasa’s konden daarmee een norm worden van wetenschappelijke rationaliteit. Dat de islamitische rechtswetenschap is gebaseerd op aannames die voor niet-moslims niet bewezen zijn, doet aan de rationaliteit van de rechtsvinding niet af.
U begrijpt het al: de vonk sprong over naar de universiteit in West-Europa. Terwijl er al kloosterscholen en andere onderwijsinstellingen waren, begonnen geleerden zich te organiseren als gilde, met eigen financiën, met omschreven lesbevoegdheden, met een universiteitsraad, met een gekozen rector en met methoden die waren geïnspireerd op die van de ulama. De introductie hiervan was een van de opvallendste aspecten van de Renaissance van de Twaalfde Eeuw, waarin de Europese cultuur zich verrijkte met het islamitische erfgoed.
