Chile: Harassment and Isolation of Lucas Hernández at Santiago Sur Prison

Lucas Hernández, transferred more than a month ago to the Santiago Sur Central Prison, is subjected to constant harassment and 24-hour daily isolation in an overcrowded punishment section where he shares a cell with more than twenty inmates—conditions imposed in retaliation for his political activism. Although a court ordered his release from isolation following an appeal by his defense team denouncing these rights violations, the Chilean prison administration has delayed the process by failing to provide the required reports and has still not implemented the court order. Faced with this daily psychological torture, urgent calls are being made to increase solidarity actions to demand an end to his isolation and harassment.

After More than 3 Months, the Trial Against Brothers Lucas and Aldo Hernandez Concludes

This Monday, November 3, the trial against Aldo and Lucas Hernandez concluded, with them being sentenced to 21 and 12 years in prison respectively. This followed more than three months of hearings, during which the powerful apparatus attempted to secure an exemplary punishment for both brothers.

On July 21 of this year, amidst protests and numerous acts of solidarity, the lengthy trial against Aldo and Lucas Hernandez began at the Santiago (In)Justice Center. The prosecution, comprised of the Public Prosecutor’s Office, the Ministry of Public Security, and the Chilean Gendarmerie, initially demanded intolerably excessive sentences, ranging from 20 years in prison for Lucas to 90 years for Aldo Hernandez.

Following the reading of the verdict on October 3rd, the plaintiffs requested a sentence of 32 years and 1100 days for Aldo and 18 years and 800 days for Lucas. The defense requested a sentence of 26 years for Aldo and 12 years for Lucas. Finally, on November 3rd, the sentences of 21 years for Aldo and 12 years for Lucas were handed down.

The sentences, detailed in a document of over 400 pages, addressed three incidents: 1- The attack on the General Directorate of the Gendarmerie in December 2021, 2- The raid on a residence in Loncura, and 3- The raid on a residence in La Victoria.

Aldo Hernandez was found guilty of the attack on the Gendarmerie Directorate, but acquitted of the charges of minor injuries to prison guards and receiving stolen goods. He was also found guilty in relation to the items found during the raid in Loncura (count 2), but acquitted of all charges related to the raid on the La Victoria residence (count 3). Lucas, for his part, was convicted of most of the crimes related to the La Victoria residence, but acquitted of the charges of weapons manufacturing and manufacturing explosive devices.

From Aldo’s defense team, attorney Washington Lizana, speaking with La Zarzamora, stated:

“Our overall assessment is positive. While we didn’t fully achieve all of the defense’s objectives, if we analyze it in relation to the prosecution’s case and the prosecution’s demands, we’ve returned to a more reasonable situation—I think that’s the right word. We have to start from the premise that the prosecution’s case against Aldo and Lucas began with a request for a sentence of over 100 years in Aldo’s case and 26 years in Lucas’s case… It involved several crimes charged by the prosecutor—16 crimes grouped into three separate incidents: one incident on December 27, 2021, involving the placement and detonation of the National Gendarmerie Directorate by two people traveling on a motorcycle, and several related offenses, plus two incidents that occurred on December 22, 2022, during various raids and searches. Various properties related to the investigation of incident number 1. Incident number 2 was linked to items found at a residence in the Quinteros district, and incident number 3 to items found at a residence in Pedro Aguirre Cerda. Sixteen charges were brought against Aldo Hernandez, of which the court acquitted him of ten and convicted him on six: two from incident number 1 and four from incident number 2. The court acquitted him of all charges related to incident number 3. In this sense, the sentence partially accepts the Public Prosecutor’s request, amounting to 20 percent of the total sentence sought.”

Regarding the outcome of this trial and the increased sentences handed down in recent trials of our comrades, he added:

“It’s progress; it wasn’t ideal, nor was it the objective of this defense, but it puts the situation, the framework of criminal prosecution, in a more reasonable scenario. In that sense, it’s important to consider that this trial is taking place within a social context characterized by a punitive fervor, an overreaction by the media and various state bodies, the criminalization of political and social organizations that confront the state, in more direct confrontation, and the manipulation of public opinion in this policy of intensifying criminalization. It was a difficult scenario, and we had seen that in recent years, in the latest cases related to these crimes, the sentences had reached irrational levels. For example, in the case of Camilo Gajardo, in 2017-2018, there was an oral trial regarding that young man, and the prosecution in this same court obtained a 43-year sentence. In this same court, a couple of years ago, the conviction of Francisco Solar for 86 years also emerged. So, of course, the prosecution, based on those criminal convictions, intensified its sentencing demands, its punitive claims, its criminal prosecution strategy, and wanted to repeat the same scenario here in the same court with significantly increased sentences, with charges of multiple offenses. I believe that with this ruling, the court has put things right.

It’s worth remembering that both brothers were arrested on December 22, 2022, at their home in the La Victoria neighborhood, after being investigated by the South Metropolitan Prosecutor’s Office in connection with the 2021 attack on the Gendarmerie Directorate. The investigation was carried out by OS9, GOPE, and Labocar to incriminate the brothers, who were considered persons of interest at the time. It is also important to mention that these raids were witnessed and experienced by children, who were exposed to the violence of the repressive forces, which could have been avoided.

Following this reading of the sentence, further legal action is not ruled out, pending its study and analysis.

It is the desire to send us affection, the movement of the body that goes on to develop acts of propaganda, action and solidarity that makes us write these lines. We approached that freedom in that fire on July 10 outside the USACH, our names sound in the streets of this city, also on that wall in Montevideo, Uruguay on which anonymous comrades wrote at night, they expressed that ideas will be a real threat, in those solidarity letters of different comrades who experience confinement just like us and send us pushes of conviction for these days of trial, also that oxygen that we breathed on the first day of trial with the rally outside the courts, where comrades, brothers, family went to accompany us and shout loudly our names and those of those who are in the prisons of this State, and who filled the entrance with papers, propaganda vindicating us, even the most filthy gendarme knew that we are not alone.

Here we do not play at being a revolutionary, here our lives go happily as we give ourselves body and soul to strike against the tyrannical and oppressive enemy of our people and popular people. Prison is only a method and silent tool of the state to break the will of the people, but the conscience is never silent and that keeps us unbreakable in the face of any attempt of the miserable gears of this oppressive force. Attack on the Transantiago bus last Friday, June 20 in Conchalí in solidarity with the anarchist comrades Aldo and Lucas.

In the early hours of December 22, 2022, in an operation that was carried out in the metropolitan region and Valparaíso, different buildings were raided, resulting in 4 arrests. The order from the southern prosecutor’s office was to find and arrest the Anarchist comrade Aldo Hernández, who is accused as the alleged perpetrator of the attack on the national directorate of gendarmerie in December 2021. In these raids, the Anarchist comrade Lucas Hernández was also arrested.

More than 2 years after their arrest, the comrades are awaiting the trial against them, which will be on July 10 in the early hours of the morning.

(Chile) Update on Anarchist Comrades Aldo and Lucas Hernández

It’s been more than two years since that 22nd of December in 2022, the day of various raids orchestrated by the Metropolitana Sur High Complexity Prosecutor. Six households were raided, five of these in the Metropolitan Region and one in the Valparaiso Region, all registered by police groups OS9, GOPE and LABOCAR, resulting in six arrests, four of which led to pre-trial prison. Two of these were brothers and comrades Aldo and Lucas Hernández, who throughout the following months remained under investigation for the explosive attack on the National Police Headquarters of Chile. Aldo is accused of having placed the device, as well as facing violations of the Arms Control Law, and Lucas is also accused of various violations of the arms and explosives control Law.

Months later, the comrades were asked to attend a hearing to be re-formalized, and both were charged with the manufacture of weapons and explosive devices for various items found in the home raided in Pedro Aguirre Cerda.

In this process we have seen how the prosecution has used trickery and dirty games to attempt to harm and intimidate those surrounding the accused with imprisonment, seeking information and even denunciations in order to complete the investigation and to be able to prove their accusations. The result of the harassment has been negative, since all the detainees after the raids have remained dignified and trustworthy faced with the mediocre attempts of the Prosecutor Claudio Orellana, demonstrating complicity and loyalty to the principles of anti-authoritarian comradeship in practice.

Across the months, the comrades have lived various and different realities of prison, since from the beginning they were separated, trying to break their family ties, depriving them from having contact and sharing the same physical space for more than two years.

Now the comrades await the preparation audience of the oral trial, which has already been postponed on two occasions for legal reasons. After awaiting trial for over two years, the comrades remain unable to reunite for reasons of security, violating their rights of conserving the family ties that bond them.

In this trial, they risk being given exemplary sentences; for Aldo the prosecution requests a 90 year sentence and for Lucas a 26 year sentence. We call these exemplary because this excessive quantity of years only aims to intimidate the environment and those who decide to return blow with blow without turning the other cheek, nor awaiting illusive and idealized opportune moments to go for our enemies. The comrades maintain intact their integrity and impetus to continue contributing to strengthening the anarchic path outside and within prison. They cling fiercely to their ideas and values, bringing along various comrades who have been deprived of their freedom just like they have, making their ideas a real threat for the range of nefarious conducts inside prison and practicing carceral solidarity, remaining strong against prison and its jailers within their own houses (prisons).

Power continues to deal blows; reprisals are part of the daily life/captivity of our brothers. The last update was Aldo’s transfer to unit 2 of maximum security in “La Gonzalina” prison, on December 24 of last year, changing the carceral regime for him. Currently he is being kept with a schedule of 21 hours of lockup and 3 hours on the range, this added to restrictions such as the prohibition of electronic apparatuses (TV, kettle and radio). This transfer resulted from a raid carried out in unit 12 (unit in which Aldo was held for 2 years) on December 18 during which the personal information of the 16 national police wounded in the attack on the headquarters carried out on December 27, 2021 was found inside Aldo’s cell. This information which was found contained in the respective investigative files of the case, was the motive for which the high authorities of La Gonzalina decided on his isolation.

Violentist practice is more valid than ever, and it is blood to pump the hearts of our brothers in prison. Each unerring action, propaganda gesture, reveals the vulnerability of a predatory system that sustains itself through a false security that’s no more than a mask that can be burnt off, in reach of our hands full of conviction and courage.

Actions such as attacks with arms-bombs on institutions-police-machines that protect the interests of power and the rich are only one demonstration of this, so that the fear is felt by those who capture us, the bullets have names and addresses. May our energies be capable of creating what our imagination once thought, so that each idea in the minds of those who see the violentist struggle as possible overflows.

Fire and death to the spectator, the scavenger, the martyr and the vulture.

Freedom for all those who remain convinced, true and courageous against domination!

Motivated by inequality and love for their peers, neighbors, families and comrades, those desires for justice in the face of so much abuse that, as yesterday, is still present today, and as new generations learn from the history of those who fought before, detaching ourselves from arrogance, we must learn from the successes and mistakes in order to be more prepared against the reprisals of power. On the 29th, the street is ours, on the corners of the towns the scene of confrontation is generated.

A warm hug to those who take to the streets, to those who feel the duty to respond to the bullets, which killed several of our people, such as Sebastián Overluij, Norma Vergara, Emilia Bau, residents like Anibal Villarroel, respond and break the homicidal silence that killed 81 burned prisoners, or Macarena Valdés, Alejandro Castro, Daniela Carrasco, Santiago Maldonado, to fight the brutality that killed Araceli Romo and Pablo Vergara, Matías Catrileo, the FPMR commanders José Miguel and Tamara, teachers with their throats slit, there are so many names that there would be no paper left. In the memory of those who lived and died dignified and with their principles, irreducible, because they are the dead of yesterday and who in other times fought the same enemies that we continue to face in the present and that continue to kill with impunity.

To break with comfort and intend to carry out the conflict, on this path there are different trenches, we have to know which one we are in and from there be able to contribute from good sense and humility, each gesture is a bullet, which one day can go through the bodies of those responsible, because in memory we also have to have the name of those who were the murderers of our dead like William Vera, Francisco Jara Jarpa, like the owners of RP Global, or the agents of the state, and the list would go on because there are many who enjoy impunity, the murderers are, live, and move peacefully through their neighborhoods, those who repress the people who protest in the towns and the prisoners in the prisons. There are so many lives to avenge, there are so many lives taken that so much blood cannot be thrown into oblivion.

Something has to be done, you can’t spend it talking or waiting for moments, ideas without facts are just straw mill, they are mental masturbations, there is a lot to do, little to talk about, that is why we are afraid to educate ourselves, to learn, to be more strategic, to know how to recognize our mistakes and those of our comrades and learn from them, because nowhere do we find them nor do they give us a manual. It is natural to err, but improving is the work, to make us more dangerous and capable of facing and rising to the occasion and continue fighting against this system of bad distribution and domination, in the memory always of our dead!
