  1. The case Saul Lliuya vs German coal major RWE got dismissed and case closed bc
*damage to Saul's property in Peru wd be too small: only a few centimetres of water would reach it
*the flood risk within next 30yrs is too small at 1%.

But: the court also ruled that RWE is indeed responsible and liable for all global damage from its CO2 !! Government permits for emissions do not free the company from responsibility.

And the court quotes the Keeling Curve from 1958ff as proof for the since-then-established fact of #climatechange and hence, liability of fossil fuel producers.

    So, 🇩🇪Ahrtal victims: sue Exxon!
Global victims: sue Shell & RWE into hell!
And the township where Saul lives can also sue RWE – after the flood from the glacial lake has occurred, or once the flood risk is proven to be big enough.

Saul's legal team summarizes key points from the ruling here

Press release by the court – the actual text of the ruling will become available asap/later:

  2. Ruling in the climate case Saul Lliuya (farmer in Peru) vs German coal major RWE got moved from April 14 to May 28 following a "challenge on grounds of bias" (Befangenheitsantrag) by Lliuya against the court-appointed geologist expert Katzenbach! justiz.nrw/presse/2025-04-09

Who made the court hire this shitty guy in the first place, eh? RWE ?? I can't trust these judges!
    RWE is such a villain!
It is well known from past activists' engagements that RWE owns the police in the state North Rhine-Westphalian and are directly responsible for a reporter's fall to death during the dismantling of the tree house village in #HambiBleibt by the police.
So it is utterly conceivable that RWE owns the district court OLG Hamm as well!!

The web quotes a sentence Katzenbach said in court: "The damages to Lliuya's property would be ridiculously low."

Some more ( but not all I read ) of this "expert's" statements in this long thread directly from the court room. Scroll up and down... bsky.app/profile/duycks.bsky.s
