OTOH pick middle sized chains (in #automotive there's pretty much a duopoly between #LKQ / #EuroCarParts and #GSF ) and they have a diverse staff - many women in frontline roles driving vans for deliveries, and lots of #BritishAsian and other ethnic minority workers in positions of senior management....

I suspect that, under current law, the Federal Circuit would say "no."

Do we really think it will take until "late 2024 or early 2025" to get a decision in #LKQ, though?
For comparison, it was less than a year between the order granting en banc review in Goddess and the en banc decision in that case.
