  1. Justice is often defended as fair. That claim does a lot of work, most of it before anyone realises it’s working at all.
    🎲 philosophics.blog/2025/12/24/t

This essay looks at fairness and commensurability not as moral virtues, but as preconditions quietly installed so that retributive justice can function at all.

  3. CW: New publication: Exploitation and the Desirability of Unenforced Law

In some economic conditions, coercively enforced anti-exploitation laws may harm the people they are intended to help. Under these conditions, legislatures should consider enacting anti-exploitation laws that include a mixture of enforced and explicitly unenforced provisions.

Forthcoming in Business Ethics Quarterly. Open access PDF available.

  4. CW: LGBT rights and "religious liberty" (1/3)

Recent academic and legal discourse in the U.S. mistakenly asserts that there is a conflict between religious liberty and LGBT rights.

Religious exemptions to laws are often justified when the law in question is paternalistic or when the public bears the burdens of an exemption.

We should allow exemptions to drug laws for people who want to use peyote in a religious ritual. Draft laws should allow for conscientious objection.

  13. @aaron_bruhl @jessecross Very eager to see this research on #SSRN (and happy to provide feedback, if you are looking for it). Looking deeper into how #briefs and #courts use #LegalAuthorities in their arguments is my jam. I’m Hugo, a #philosophy and #law #gradstudent at #Stellenbosch Uni in South Africa. Currently working on my LLM thesis in the #legalphilosophy of #animallaw. Broadly, my research draws on #decolonial theory, #criticalanimalstudies , #ecofeminism , and #posthumanism to displace #anthropocentrism as a quasi-transcendental limit of legal discourse.
