  27. @atrupar The modern era father of this age-old idea that the judiciary must serve the regime or The Leader in full and without question is Carl Schmitt, the the Nazi ideologue who created the pseudo-rational legal framework for the Third Reich known as Legalism.

    This is great for despots since it removes any normal legal recourse the people might have to oppose unaccountable authoritarian leaders.

    In fact it is just a flick of a pen away to make the very act of opposing the regime illegal, and punishable by whatever measures the regime sees fit... And voilà, crushing all dissent is now not only virtuous but a *legally required* act!

    Cue to "I was only following orders..."

    Incidentally, the Chinese communist party turned to Carl Schmitt's legalism in early 2000's in search of a raison d'être for their continued dictatorship after actual 'communism' had failed as an ideology. Schmitt's ideas also meshed well with CCP's newly re-introduced ethno-nationalist and imperialist dogma, so what's not to like.

    The MAGA ideologues pulling strings behind trump and the Project 2025 are, quelle surprise, also enamoured with Carl Schmitt...

    After the dismal and murderous failure of the regime's communist economics, CCP found new raison d'etre in totalitarian nationalism with klepto-socialist characteristics. hitler's 12-year reich called it #nazionalsozialismus, but we know it as #nazism.

    Just like the initial late 1800s European nationalism was imported to messy late-imperial China (hello KMT!) from Germany along with marxism a few decades later (hello CCP!), the clueless communists went back to the source to scavenge for solutions and realized how effing effective nazism had been, at least in terms of CCP's needs.
