Hey, is anyone out there looking for a #LawStudentNote idea?

Comparing the arguments here, the decision, as well as the Second Circuit American Girl case could be the start of a nice #LawStudentNote.
-
New #LawStudentNote idea (free to a good home, as always): This story says Illinois has an "anti-troll" law. Does (or should) it apply to any #ScheduleA cases?
Valve's Anti-Troll Law Win Cou... -
Side note: There are a lot of good potential #LawStudentNote topics in here.

Is anyone looking for a #LawStudentNote topic?

But this would make a great #LawStudentNote topic if you (or your students) are looking for one.
-
Anyway, there may be some good #LawStudentNote topics in here.

Are you or someone you know looking for a #LawStudentNote idea? May I suggest:

On my reading list: A new #LawStudentNote argues that design patents are unconstitutional: annualsurveyofamericanlaw.org/wp-content/u... From this issues of the Annual Survey of American Law: annualsurveyofamericanlaw.org/recent-issues/

Anyway, lots of potential #LawStudentNote ideas here.

Anyway, here's a #LawStudentNote idea: Is there actually a "party presentation" problem in cases like Eicher Motors?
-
It's #LawStudentNote season! If you're planning to talk about design patents in your note (and especially design patents for fashion), be sure to check this out:
The Truth About Design Patents -
That's a great question. It would be interesting for someone (not me) to go back and see what the history looks like here. Like, when and how have judges challenged joinder in these cases? Have the arguments changed over time? That kind of thing. Another idea for a #LawStudentNote.
-
Anyway, the Bose joinder decision (and the cases that consider whether or not to adopt it) would still make a great #LawStudentNote. #CivProMatters Bose Corp. v. Partnerships & Unincorporated Associations Identified on Schedule "A", 334 F.R.D. 511 (N.D. Ill. 2020)

This case could make a good #LawStudentNote, by the way. Especially on the Due Process prong. Is offering "allegedly counterfeit items" online really enough to establish personal jurisdiction in a forum?

Again, this could make a good #LawStudentNote: How much control do Amazon sellers actually have over their product pages and storefronts? What does that mean for arguments about joinder, personal jurisdiction, etc?
-
I still think this would make a great #LawStudentNote, by the way.

Observation: This isn't an issue I've followed as closely as some others. But it's really important; email service is a key reason why the #ScheduleA model works. This could be another great starting place for a #LawStudentNote.
-
Adding to this #LawStudentNote idea: How much latitude to Amazon sellers have in choosing *where* to sell? I just read something suggesting they could choose to sell to some U.S. states and not to others. I'm pretty sure that's not correct. But it's relevant to the issue of personal jurisdiction.
-
Related #LawStudentNote idea: How do Amazon seller account disbursements actually work? A lot of the arguments in these cases are premised on the idea that they're like bank accounts and money can be withdrawn at any time. My understanding is that, at least for most sellers that's not true.

#LawStudentNote idea, free to a good home: How much latitude do Amazon sellers actually have in creating their listings/pages (I understand it's not much) and how does/should that affect the joinder arguments in these kinds of cases?

Any students out there looking for an IP and/or Civ Pro #LawStudentNote topic?
May I suggest: Joinder & "Schedule A" https://www.scribd.com/document/768564445/Yang-Joinder-denied-1-24-cv-07257

@patentlyo.com Tagging this as a great #LawStudentNote idea

I still think this issue (Bose or no Bose?) would make a good #LawStudentNote idea.

#LawStudentNote idea: Does the "swarm" joinder theory set forth in the Bose case make sense for #ScheduleA cases? If so, what kind of showing should be required of the plaintiff?

See also Roadget v. Schedule A, 2024 WL 1858592, at *1 (N.D. Ill. Apr. 29, 2024) (distinguishing Bose).

By the way: Email service, including the propriety of serving #ScheduleA defendants in China via email, remains an awesome potential #LawStudentNote topic
-
This motion to dissolve, from a #ScheduleA trademark case, provides a good overview of the issues with email service: https://www.scribd.com/document/689635551/Colourpop-v-Schedule-A-Green-Market-Motion-to-Dissolve
(And as @hewittlaw has noted before, this would be a great #LawStudentNote topic.)

P.S. There's probably a good #LawStudentNote in here

Anyway, there might be a #LawStudentNote about how the MPEP needs to change after Tam/Brunetti, if anyone is interested.
