In 2015, when #CrystalClanton was 20 and working for a #conservative #group allied with the #justice’s #wife, #GinniThomas, Clanton apparently sent #racist #texts to a fellow #employee “I HATE BLACK PEOPLE,” one text read. “Like f--- them all … I hate blacks. End of story.” (In Clanton’s text, the expletive was spelled out.)

1. Trump seeks a “directed verdict;” a ruling saying the AG failed to back up her claims. (doomed)
2. NYAG seeks to bar 3 of 4 Trump experts for relevancy.
3. Defense also floated possibly moving for a mistrial using a bias argument centered on #Engoron’s principal #LawClerk. They’re on thin ice there.

#Engoron: "Don't file that motion, please. I think it's important for the safety of my staff. I am 1,000% convinced, & you don't have any right or reason to complain about my confidential communication."
#Kise: “There's no way to file that motion without referencing the subject matter.”
Engoron: “I'm directing you not to make that motion [...] I'm going to protect my staff, okay."

The trial is deciding the remaining counts of #InsuranceFraud, #falsifying #business #records, issuing #false #financial statements & #conspiracy to commit all of the #fraud.
Justice #Engoron issued a limited #GagOrder after #Trump posted disparaging comments on social media about the judge’s #LawClerk.
Trump violated the order 2X (so far). Last Fri, the judge was forced to extend the gag order to Trump’s attys when they took over the abuse after trump’s had to stop.

FYI: The #Breitbart article that #Trump's attorney insisted on discussing in court today, only cites a SINGLE SOURCE — a twitter user — whose bio is:
"Applying the 69th Amendment to the Internet!"
The user's feed is filled w/ posts & retweets vilifying Justice #Engoron’s #LawClerk much like the one that prompted Trump’s original #GagOrder.
Also, FYI, Engoron said also in court he never received a complaint. It seems to only exist on a website run by the user.

#NYAG's counsel Kevin #Wallace on the whole "sideshow” of the #LawClerk passing notes to the judge:
(exasperated) it is “designed to interrupt our ability to put an end to this! If there's something improper between a judge & a clerk passing notes, you should make your motion now”
That’s when Justice #Engoron said he’d issue a written decision on the matter.

Justice #Engoron tells #Kise et al, that he'd consider their complaints about his #LawClerk to be a continuing objection (that’s when a judge has already overruled the original objection, & instead of attys constantly stopping the trial w/objections, it is preserved as if they did. It's really for appealing).
Engoron: "I don't have any other comments about my staff or how I communicate w/them.”

Kise: "There's a news story out [today]...about particular political contributions made by your court staff...it raises questions of impartiality.”

Yesterday, Engoron warned Trump atty #Kise not to speak about court staff, & noted a pattern of #misogyny in Kise’s behavior toward women in the courtroom.

Both #Kise & #Habba continued to accuse #Engoron’s #LawClerk of bias, claiming that she writes notes to the judge about the defense.
Justice Engoron pounded the table & said, "I have an absolute right to get advice from my principal law clerk.”
He also pointed out that attys pass notes all the time at the defense table (he didn’t claim to know the contents of their notes)
Kise made a remark about his need to report a perceived bias & he has a 1st Amndt right to criticize the clerk.

Learning of those comments, #Engoron — who had previously issued a very narrow #GagOrder barring #Trump from making any public statements about court personnel — summoned Trump to explain exactly what he meant.
Trump said he was referring not to the judge’s #LawClerk, who sits next to him in court, but to #MichaelCohen.
Engoron said he didn’t believe Trump’s explanation. -

Court resumed at 3PM, after delays, once it did, #Engoron noted #Trump’s #socialmedia #post about his #LawClerk. The post was also emailed to millions of people.
Engoron said he ordered the post to be taken down & that #PersonalAttacks on his #staff were unacceptable & would not be tolerated. He said that he previously warned the parties about such #attacks yesterday. He finished: “Consider this a #GagOrder on all parties w/respect to posting or publicly speaking about any member of my staff.”

#Trump had posted on his social media platform a different user's IG post showing #Engoron's #LawClerk at an event where she posed w/Sen Maj Ldr Chuck Schumer. The IG post questioned why she was "palling around" w/Schumer.
Trump's post went farther, referring to the #clerk as "Schumer’s girlfriend" & said she "is running this case against me. How disgraceful! This case should be dismissed immediately."

Trump blasted Judge Arthur #Engoron's #law #clerk on #socialmedia shortly before the lunch break, & then amplified the #attack in brief remarks to reporters afterwards.
(So presumably he posted the first attack while in the courtroom in the presence of his lawyers)
