  2. Justice Brett #Kavanaugh & Chief Justice #JohnRoberts broke from their #conservative colleagues in siding with Pitchford.

    Justice Neil M. #Gorsuch wrote a dissenting opinion, joined by Justices #ClarenceThomas, Samuel A. #Alito Jr. & #AmyConeyBarrett.

“Put simply, Mr. Pitchford’s account of a muzzled defense team is hard to square with the record. But even if it were a plausible account, that still would not be enough,” Gorsuch wrote.

  3. In 2019, #SCOTUS reversed the conviction of another #Black #Mississippi man, Curtis Flowers, whom #DougEvans also prosecuted in a capital murder case. Flowers was tried 6 times. The justices found, 7-2, that Evans — now retired — had worked relentlessly to keep Black people off the #jury.

  4. For two decades, Pitchford had argued his conviction was not valid, pointing to what he said were racially biased selections of the jurors who heard the case. Only one of the 12 jurors was #Black — in a county that was 40% African American, according to Pitchford’s filings. More troubling, Pitchford says, is that those jurors were selected by #DougEvans, a prosecutor with a history of maneuvering to keep Black people off juries.

  5. It is the second time #SCOTUS has effectively thrown out a #capital case after the same #Mississippi prosecutor was accused of excluding #Black #jurors.

Pitchford was convicted of murder in 2006 & sentenced to death by a jury in Mississippi. It was his partner who fatally shot shop owner Reuben Britt with a .22-caliber pistol during the armed robbery, acc/to court filings. Pitchford, who was 18 at the time of the robbery, was accused of being an accomplice.

  6. #SCOTUS Thursday sided with a Mississippi man who was sent to #DeathRow for his role in the murder of shopkeeper, upholding a lower court’s decision to vacate his conviction because of potential #RacialBias in #JurySelection.

In a 5-4 vote, the court found #TerryPitchford, who is #Black, did not have the opportunity to challenge the dismissal of 4 Black potential #jurors.

  7. Mediaite: Almost Half of Jury Pool in Musk Trial Tossed After ‘So Many’ Said They ‘Hate’ Him . “Elon Musk may have been contemplating snacking on a few earthworms after a brutal treatment by a jury pool in San Francisco, with almost half of the prospective jurors being disqualified because they declared their hatred for the tech CEO — one even went so far as to say he wanted to see […]

  8. In #HunterBiden’s trial, jury selection highlights #UnitedStates’ drug epidemic

The nation’s political divisions were also laid bare as 6 men & 6 women were chosen….

#JurySelection for the trial of #POTUS #Biden’s son Hunter turned into an impromptu but painful indictment of the nation’s drug epidemic, w/person after person telling the court of their loved ones’ battles w/ #addiction.

  9. The judge overseeing the #HunterBiden case is nearly done w/ #JurySelection, having narrowed the field down to 32 potential candidates, from which defense lawyers & prosecutors will use peremptory challenges to end up w/a dozen #jurors & 4 alternates. It is increasingly likely that jury selection, which began Monday morning, will finish by the afternoon.

  10. A man set himself on fire on Friday afternoon near the Lower Manhattan #courthouse where #JurySelection continued in the #criminal #trial of #Trump.

The man doused himself w/a liquid around 1:35PM ET in Collect Pond Park, across the street from the courthouse. Onlookers screamed as bright orange flames engulfed the man. It was unclear what motivated his action.

  11. So that was definitely more important than monitoring #TrumpTrial #JurySelection.
    For sure.

    #BabySquirrel bests #Trump any day.

#Adorable #squirrel video (look how little compared to pen cap!) attached:

  12. The prospective #jurors left for the lawyers discussion, some may be brought back in for individual interviews. The defense & the prosecution may both seek to strike jurors "for cause." If they can't do so, they will use their limited number of peremptory challenges, which allow them to excuse jurors w/o a reason.

Those who survive challenges will be seated on the jury unless this process has given them the concerns articulated above.

  13. #Trump's lawyer, Susan Necheles, confronted many prospective #jurors about their #socialmedia activity, clearly the lawyers know things about them, a lot of which was not stuff they were asked in open court. They clearly have people doing deep dives on these people. It’d be pretty hard to not have concerns that their identities will be *leaked*

  14. Another prospective juror interviewed by Necheles, says she is very "centrist." She says she appreciates #democracy & a diversity of #political opinion. But, says, "I really don't think this case is about my #personal politics, this case is ultimately about the #evidence & the #facts presented." She concludes by saying that her family background "comes from #totalitarian regimes," & that bc of that, she believes in "innocent until proven guilty."

  15. The latter prospective juror's voice reportedly shook as she basically insulted Trump. She says of his personality: “It's not my cup of tea”

    [I’d probably be less diplomatic]

#Trump is staring at her from the defense table.

  16. Necheles is all but cross-examining certain prospective jurors about their #socialmedia posts & #personal info.

One juror said she fiercely disagrees w/ #Trump politically but has no feelings personally.

Necheles asked if the prospective juror's husband had written a ‘book opinion’ about Trump. The juror said that her husband does write book reviews.

    (Sheesh)

  17. #Trump will likely be pleased w/Necheles's #VoirDire. She questioned the #credibility of those who are expected to testify against Trump, & made a reference to #MichaelCohen, suggesting that some #witnesses might want to seek “revenge” (the title of a Cohen books) on Trump. Cohen’s book is specifically named on the questionnaire.

Trump gives the hairy eyeball to jurors when Necheles suggests that a witness may be lying if they change the details of their story.

  18. Steinglass wrapped up by asking whether any of the 18 prospective jurors would have trouble finding #Trump #guilty if prosecution proves its case. He asks each individually. Not one expresses any concerns about doing so.

Susan Necheles, defense, is up. She begins by saying she has “the honor of representing President Trump."🤮

This could backfire if any prospective jurors are irked by hearing Trump referred to in the “dear leader” way he insists.

    #criminal #law #JurySelection #TrumpTrial

  19. Steinglass explains the concept of “accessorial liability.” He uses the same analogy he did on Tues: a husband hiring a hitman to murder his wife, he asks prospective #jurors if they would understand the husband to be #guilty of the #crime. Today, though, the #defense lawyers object. #Merchan overrules, & the hitman question stands.

Steinglass managed to compare #Trump coordinating the falsification of docs w/a husband putting out a hit on his wife.

    #criminal #law #JurySelection #TrumpTrial

  20. “We’re going to ask you to be patient as we walk you through all those documents in what sometimes may seem like excruciating detail.”

The potential jurors, called on individually by Steinglass, said they could do that.

#Trump is reportedly staring intently at the jury box as the #VoirDire goes on. He (again) shakes his head as Steinglass references someone being “criminally liable” for the acts of others.

    #criminal #law #JurySelection #intimidation #harassment #JuryTampering #TrumpTrial

  21. Meanwhile, another prospective juror who had earlier said he had strong feelings about how the #criminal justice system has treated #Trump has now said he “misinterpreted” the question & has no such beliefs.

  22. #TrumpTrial #jurors’ concerns

#JurySelection began w/a sworn in juror getting dismissed over doxxing concerns.

“I definitely have concerns now. One of them especially being the aspects of my identity have already been out there in public. Yesterday alone I had friends, colleagues & family push things to my phone regarding questioning my identity as a juror.”

  23. Jury question 23:
"Without telling"us the name(s), do you take any medication that would
prevent you from being able to concentrate or pay attention during the
    proceedings or during the deliberations?"

With Trump repeatedly falling asleep shouldn't be answering this too?
