DONALD TRUMP IS A RAPIST! (According to U.S. District Court Judge Lewis Kaplan). The judge wrote an order denying Trump's motion to reduce damages, reasoning that forcible digital penetration constituted rape:
"The finding that Ms. Carroll failed to prove that she was 'raped' within the meaning of the New York Penal Law does not mean that she failed to prove that Mr. Trump 'raped' her as many people commonly understand the word 'rape.' Indeed, as the evidence at trial recounted below makes clear, the jury found that Mr. Trump in fact did exactly that."
Although not directly addressed in this order, it would seem to sound the death knell for Trump's counter-claim that Carroll defamed him after the jury verdict by saying he "raped" her instead of "sexually assaulted" her.

I guess they are walking a fine line between wanting compensation w/o wanting to appear greedy.

@terrylingwood While #Trump may have left the country, many of his assets remain in the US. In the event that he loses the trial, the plaintiff, #JeanCarroll will be awarded damages. Seems like a trivial matter to lock up some of #Trumpโs assets to pay the award regardless of his location. Should #DonaldTrump lose the case, he will appeal the outcome. Given his past legal practice this case will be in the courts for years

So now the "uncontroverted evidence" in the #JeanCarroll case is that the rape happened, and #DonaldTrump also sexually assaulted two other women.
In a civil case, the fact finder can typically draw an adverse inference when a witness declines to answer questions (e.g. invokes his 5th Amendment rights).
I know that Judge Kaplan preliminarily rejected Trump's requested jury instruction that he's not appearing out of a sense of civic obligation to save taxpayers & USSS the hassle/expense. But is there any civil jury instruction where neither party calls one of the parties to the stand?
And if there is no specific instruction, is there any prohibition on Carroll's attorneys arguing that Trump's failure to show up and deny the charges under oath is an indication that he did it?

47 years ago I was at the wheel of a car suddenly encountering a firetruck responding to a call and dragging a hose.
No means of avoiding the hose and heavy nozzle flailing on the end of it. Barely time to tell my passenger to duck and close their eyes.
The car was severely damaged. We laughed it off-- at the time.
Decades later I flinch weirdly, break into a little sweat with pounding heart if even a leaf approaches the windshield.
I was way less than raped.
