...not totally specific as each individual case's situation will, naturally, be different.

The same holds true for these specialized government agencies.

Who on earth 🌎 came up with this absolutely witless idea?
The legal basis is, IMO, even thinner than for the trashed #ISLT*.

Do you know which lawyer (probably funded by the #FederalistSociety, I presume) came up with this stupid idea?

  3. @vecrumba @kcarruthers

...Everyone has his price.--And some people are up for grabs all the time (#ClarenceThomas, e.g..)

This said, Volkris is one of the good ones.

This shows, how good the #Federalists are, unsurprising, though, as a legion of the smartest US lawyers is connected to them some way or other.

They do have their intellectual nadirs, too, though. :)
#ISLT was such a non-starter, even for people who are not constitutional lawyers.

  5. Also: The #J6 committee’s criminal referrals will make it harder for the Supremes to endorse that “independent state legislature” rubbish. #ISLT

  7. CW: Lawrence O'Donnell on Beer Kavanaugh boozing w/ right wing freaks

"Stephen Miller is arguing to the Supreme Court, in writing, that any state legislature should be able to control the electoral college votes in that state, no matter how the citizens of that state voted for president." #ISLT

Yet "Brett Kavanaugh thinks that's perfectly okay to go to a right-wing party, with the right-wing extremist who has a case pending before the Supreme Court." #SCOTUS crooksandliars.com/2022/12/odo

  9. This is my Moore v. Harper #ISLT thread mentioned by Slate’s Emily Bazelon on @SlateGabfest this week.
And they linked to this tweet on my concern about limiting remedies.
The Democrats’ lawyer Verrilli conceded (wrongly!) this clause may limit judicial remedies to fix gerrymanders and racist districting. State legislatures would win a game of chicken: the last map they draw wins, even if racist and illegal: twitter.com/jedshug/status/160

  11. This lays out in easily accessible terms the danger of the so-called "Independent State Legislature Theory" that was argued at the #SupremeCourt today. Well worth the read to understand what's at risk from those extremists who defend it. slate.com/news-and-politics/20 #ISLT #democracy #elections
