We lost many of our best, #Lakota Warrior Woman #DebWhitePlume, our longtime friend #KleeBenally, our French translator #ChristinePrat, and many more. But thanks to those who keep sharing their work, we keep Censored News going. This summer our page views increased by millions, thanks to their labors of love.

A Morton County jury on Wednesday ordered Greenpeace to pay hundreds of millions of dollars to the developer of the #DakotaAccessPipeline, finding that the #environmental group incited illegal
behavior by anti-pipeline #protesters and defamed the company in the late 2010s.

"During closing arguments on Monday, the lead attorney representing #EnergyTransfer told jurors that Greenpeace’s actions caused between $265 million and $340 million in damages to the company. He asked the jury to award Energy Transfer that amount plus additional punitive damages.

"The nine-person jury delivered a verdict in favor of Energy Transfer on most counts. The verdict brought to a close a more than three-week trial in Mandan.

"The jury began deliberating Monday afternoon after hearing testimony from dozens of witnesses, including current and former Greenpeace employees, #IndigenousActivists, Energy Transfer representatives and law enforcement.

Murders, #megaprojects and a ‘new Panama Canal’ in Mexico

#Activists suspect murders of 15 #Indigenous community members are linked to their opposition to a proposed megaproject.

Mexico City, Mexico – "The murders bore all the hallmarks of drug cartel executions. Fifteen victims – all members of the Ikoots Indigenous community – had been beaten, shot, and their bodies burned in a field just outside Huazantlan del Rio, a village in the municipality of San Mateo del Mar in Oaxaca, southern Mexico, in late June. An as-yet-unknown number of people were also 'disappeared'.

"At first the local government, headed by Mayor Bernardino Ponce Hinojosa, blamed the killings on a shadowy figure and an unnamed organised-crime group. Officials also acknowledged intra-community grievances and political infighting, caused by dissatisfaction with municipal elections and tension over last October’s mayoral election, which Ponce Hinojosa won.

"San Mateo used to be governed by an Indigenous 'popular assembly', which made decisions by consensus and served on a one-year rotation. But in 2017, this changed to a ballot-based electoral approach, leading to tensions that increased after the mayor’s disputed 2019 win.

"The Ikoots, most of whom consider the popular assembly to be the legitimate source of authority in the region, allege that the vote was fraudulent. They also accuse the mayor and a local businessman of being complicit in the wave of violence, sources told Al Jazeera, speaking on condition of anonymity for fear of reprisals.

"Meanwhile, a collective of 15 civil society and teachers’ organisations, the National Coordination of Education Workers (CNTE), has accused the Cartel de Jalisco Nueva Generacion (CJNG) – one of Mexico’s most violent and territorially-ambitious cartels – of committing the murders.

"The allegations came in the same week that the CJNG was accused of the attempted assassination of Mexico City’s chief of police in an ambush with heavy weapons in which three people were killed.

"Although CNTE gave no evidence to support its accusation, many in San Mateo believe the claims because the cartel had already been active in their Istmo region, which boasts a wealth of mineral resources and a strategic location.

"The Istmo (or Isthmus in English) spans the states of Oaxaca and Veracruz at the narrowest point between the Pacific and the Atlantic. It is the site of the controversial 'Interoceanic' or 'Transistmico' corridor project, initiated by the government of Andres Manuel Lopez Obrador and opposed by many Indigenous communities."

"South Dakota’s governor and attorney general today backed down from their unconstitutional attempts to silence pipeline protestors. In response to a lawsuit we filed alongside the ACLU of South Dakota and the Robins Kaplan law firm, the state has agreed to never enforce the unconstitutional provisions of several state laws that threatened activists who encourage or organize protests, particularly protests of the #KeystoneXL [#KXL] pipeline, with fines and criminal penalties of up to 25 years in prison.

"The settlement agreement reached today and now headed to the court for approval is an important victory for the right to protest. It comes soon after a federal court temporarily blocked enforcement of the pieces of the laws that infringed on First Amendment protected speech, and makes the court’s temporary block a permanent one.

"The laws include the #RiotBoostingAct, which gave the state the authority to sue individuals and #organizations for 'riot boosting,' a novel and confusing term. The court warned against the laws’ broad reach, noting that the laws could have prohibited:

- Sending a supporting email or a letter to the editor in support of a protest
- Giving a cup of coffee or thumbs up or $10 to protesters
- Holding up a sign in protest on a street corner
- Asking someone to protest

"Under the First Amendment, that is impermissible.

"The court rightly recognized the stakes of this case. And it put these #AntiProtest efforts in perspective, asking 'if these riot boosting statutes were applied to the protests that took place in Birmingham, Alabama, what might be the result?' The answer: 'Dr. King and the Southern Christian Leadership Conference could have been liable under an identical riot boosting law[.]'

"Indeed, South Dakota’s unconstitutional anti-protest efforts echoed the suppression of past social movements. From the start, South Dakota Governor Kristi Noem called on 'shut[ting] down' 'out-of-state people' who come into South Dakota to 'slow and stop construction' of the pipeline. Her harmful calls were reminiscent of government attempts throughout our history to delegitimize and minimize significant #SocialMovements as the work of 'outside agitators,' including Reverend #MartinLutherKingJr.

"South Dakota’s quick and costly retreat (they’ll have to compensate plaintiffs for attorney’s fees under the settlement agreement) should serve as a lesson for other legislatures considering similar efforts to silence dissent.

"In the last few years, we have witnessed a legislative trend of states seeking to criminalize protest, deter political participation, and curtail freedom of association. These bills appear to be a direct reaction from politicians and corporations to some of the most effective tactics of those speaking out today, including water protectors challenging pipeline construction, Black Lives Matter, and those calling for boycotts of Israel. These legislative moves are aimed at suppressing dissent and undercutting marginalized and over-policed groups voicing concerns that disrupt current power dynamics.

"But the First Amendment guarantees people the right to voice their opposition. This includes our clients — four organizations (the #SierraClub, #NDNCollective, #DakotaRuralAction, and the #IndigenousEnvironmentalNetwork - #IEN) and two individuals (#NickTilsen with NDN Collective and #DallasGoldtooth with Indigenous Environmental Network) — all of whom are protesting construction of the Keystone XL pipeline and encouraging others to do the same.

"Construction of the Keystone XL pipeline may be imminent. Pre-construction activities resumed this month, and a hearing on the new Draft Environmental Impact Statement for the pipeline, which will serve as the basis for approval of any future permits, is coming up next Monday.

"With the laws we challenged proclaimed unenforceable, protesters and protectors no longer have to worry about incarceration or fines as they protest against the construction. That is, at a minimum, how democracy should work."

"Federal Judge Diane Humetewa, Hopi, is the first federal judge to halt the lithium permits being given out by Interior Sec. Deb Haaland. Humetewa granted a temporary restraining order halting an Australian company's lithium drilling at #Hualapai's Sacred Spring.

"Now, U.S. District Judge Humetewa will rule on whether to make it permanent. Humetewa is the first to ask attorneys to submit arguments concerning the federal laws that protect historic and archaeological sites and the environment.

"Judge Humetewa gave lawyers on both sides until next Tuesday to summarize their arguments and more specifically respond to questions she asked about the government’s compliance with the #NationalHistoricPreservationAct and the #NationalEnvironmentalPolicyAct.

"#Biden's Justice Dept attorneys joined the drillers in court to argue for the drilling to proceed. And the #NavajoTransitionalEnergyCompany, a tribal enterprise in Farmington, NM, plans to do the drilling. CEO #VernLund has joined the board of the Australian-owned company #Hawkstone / #ArizonaLithium of Perth, Australia.

"In a separate case, the #TohonoOodham and #SanCarlosApache have filed a lawsuit against Interior Sec. Haaland for the bulldozers now destroying ancient village sites, #burial places and #MedicineGrounds in southern #Arizona. A Tucson federal judge refused to halt the destruction by the #SunZia Transmission Lines, for a wind energy project that plans to take electricity from New Mexico to California. The wind energy company, #PattenEnergy, is owned by the #CanadianPensionFund.

"The lithium drilling continues at the #Paiute Massacre Site in northern Nevada by the Canadian-owned #LithiumAmericas / #LithiumNevada. #Paiute and #Shoshone elderly and mothers have been charged in a court case for defending the grounds where their ancestors remain. #Haaland said she supports the #LithiumMining.

"#ApacheStronghold filed a case before the U.S. #SupremeCourt [#SCOTUS] this week, to halt the planned destruction of their ceremonial place, #OakFlat in Arizona, targeted for a massive copper mine by Australia's #RioTinto and #BHP, and pushed by the Biden administration. Rio Tinto already blew up 46,000 years of sacred #Aboriginal teachings in caves in #Australia. Rio Tinto was forced to admit widespread sexual attacks in its mines, with the highest number in Australia and #SouthAfrica."

"'We keep us safe!' is an abolitionist assertion that the state or some paternalistic organization will not protect us from #colonial, #fascist, #WhiteSupremacist, #Queerphobic attacks, so we must organize and defend ourselves and those we are in community with.

"We cannot leave this slogan to be an empty gesture or posture. It must be conveyed with the necessary training and organizing to address the hyperpoliticized and conflictual environments that we organize in.

"While we cannot anticipate and prevent all fascist assaults, if we pronounce that 'we keep us safe,' we can and must do what we can to organize and be prepared. Liberal and 'radical' non-profit managers constantly decrying the 'inactions of cops' does not keep us safe, it only invokes further police violence. Additionally, calling on colonial politicians to respond to fascist violence as a 'hate crime,' is really a call to further the carceral state and its institutional violences (courts, prisons, more policing, etc).

"On September 28th, 2023 #JacobJohns, an #Indigenous person was shot by Ryan Martinez, a colonial invader and #MAGA fascist at an action called to confront the re-establishment of a monument to the genocidal colonizer Juan de #Oñate in so-called Española, New Mexico. This shooting occurred under the same watch of an organization that hosted a previous anti-Oñate monument action in 2020 where #ScottWilliams was shot and severely injured.

"From #HeatherHeyer, #JosephRosenbaum, and #AnthonyHuber to many more who have been injured or killed while resisting authoritarian nationalism (aka fascism), these deadly attacks are occurring within a context of historic, ongoing, and escalating colonial violence.

"Since 2020, groups based in occupied New Mexico organizing anti-monument actions have been directly challenged for putting people at serious risk. Calls that have been made for more organized security have been denounced by inexperienced organizers in these groups.

"These issues and considerations are not new, the #BlackPantherParty for Self Defense and #AIM initiated armed patrols and armed resistance in the face of state, white supremacist, and colonial terror. Amorphous entities such as #Antifa and #BashBack have continually mobilized street warfare in defensive and proactive ways. These groups have long recognized that we cannot merely rely on 'safety in numbers,' (though numbers do help) our enemies are more organized than that, so why aren’t we?

"We cannot pronounce liberation without simultaneously preparing and mobilizing defense.

"As everyone should be doing #MutualAid, everyone should be prepared for #MutualDefense. We cannot depend on any organizers or organizations to simply do this for us. If 'We keep us safe,' we better fucking mean it.

"As Goldfinch Gun Club stated, 'Community defense has to be about #solidarity and uplift mutual aid, not just arming vulnerable peoples. By the time someone starts shooting, everyone has already lost. The best defense is #ABetterWorld. It’s possible. We have to believe that.'"
