New #SCOTUS Disclosures Show 2023 Was a Good Year for Several Justice-Authors' Bank Accounts

"Four Supreme Court justices supplemented their income with payments from their book deals, three accepted money for teaching, and only two accepted any reportable gifts in 2023, according to financial disclosures released Friday. Justice Alito was the only sitting justice to request an extension.
"These disclosures are the first to be released since the Court announced its adoption of a Code of Conduct (Nov. 2023) and the first since the Pulitzer Prize-winning investigation from ProPublica was published (Apr. 2023&ff). Given the wide array of data in the reports, it’s difficult to ascertain whether recent ethics scandals have changed the justices’ behavior. In fact, there are some conflicting signs.
"According to #ClarenceThomas’ disclosure, he did not accept any gifts of private plane travel or resort stays from #HarlanCrow or any of his other prior benefactors in 2023. The only gift he accepted was $2,000 in 'photo albums' from the outgoing executive director of the Horatio Alger Association, Terry Giroux, and Giroux’s wife, Barbara. (Justice Jackson’s gifts are noted later in the release.)
"What’s more, Thomas wrote at the end of his report that his 2019 FDR “is hereby amended to include the following entries under the reimbursement section, which was inadvertently omitted at the time of filing,” and he lists a one-night stay at a hotel, with free food, in Bali and a four-day, three-night stay at #BohemianGrove (though he doesn’t write “Bohemian Grove”).
"On the one hand, amendments like these show growth and are appreciated. On the other hand, ProPublica reported that Thomas flew to Indonesia on a private plane for his summer jaunt, and from this omission in the appendix, it appears that either Thomas made another error or he believes neither travel on a private plane owned by a friend (though it’s really owned by his friend’s company, #HRZNARLLC) nor overnight stays on a yacht owned by a friend (really Crow Holdings, LLC) to be reportable."

Clarence Thomas Faces Recusal Call From Democrats After Wife's Comment

September 10, 2024"Democrats on the Senate Judiciary Committee have called on #SupremeCourt Justice #ClarenceThomas to recuse himself from cases involving a religious legal group after his wife reportedly thanked the conservative organization for its efforts to block Supreme Court reform.
"Thomas, a conservative appointed by former President #GeorgeHWBush in 1991, has been one of the justices at the center of calls for court reform after it was revealed that he has accepted millions of dollars in gifts from some top #RepublicanDonors without disclosing the items and #LuxuryVacations to the court. Questions of Thomas' impartiality were also raised after his wife, conservative activist Ginni Thomas, pressured officials to overturn the 2020 election results in favor of former President Donald Trump.
"Investigative outlet #ProPublica first reported last week that #GinniThomas recently praised conservative legal group #FirstLibertyInstitute in an email to the firm's president and CEO, Kelly Shackelford, for the organization's work in opposing change to the High Court."

Mon 12 Aug 2024"The US air force is refusing to comply with an order to clean drinking water it polluted in Tucson, Arizona, claiming federal regulators lack authority after the conservative-dominated US supreme court overturned the 'Chevron doctrine'. Air force bases contaminated the water with toxic PFAS '#ForeverChemicals' and other dangerous compounds.
"Though former US Environmental Protection Agency (EPA) officials and legal experts who reviewed the air force’s claim say the Chevron doctrine ruling probably would not apply to the order, the military’s claim that it would represents an early indication of how #polluters will wield the controversial court decision to evade responsibility."

Jun 28, 2024"Since the New Deal era, the bulk of the functioning US government is the administrative state — think the acronym soup of agencies like the #EPA, #FCC, #FTC, #FDA, and so on. Even when Capitol Hill is not mired in deep dysfunction, the speed at which Congress and the courts operate no longer seems suitable for modern life. Both industry and ordinary people look to the administrative state, rather than legislators, for an immediate answer to their problems. And since 1984, the administrative state largely ran on one Supreme Court precedent: #ChevronUSA, Inc. v. Natural Resources Defense Council (#NRDC).
"That decision has now been overturned. Admin law is not always interesting, but the simple fact is when it comes to the day-to-day, agencies are the most impactful part of the federal government. No single policy writer at The Verge can fully articulate the impact of Friday’s Supreme Court decision and how profound its effects will be. The administrative state touches everything around us: net neutrality, climate change, #CleanAir and water, and what scant #ConsumerProtections we have.
"While the practice had been in place for decades before, it came to be known as Chevron deference after a 1984 case: Chevron v. NRDC. The Supreme Court ruled in favor of Chevron, allowing the #RonaldReagan administration’s #industry-friendly Environmental Protection Agency to stick with a lax interpretation of the #CleanAirAct.
"Over the years, Chevron deference has enabled federal agencies to tackle all sorts of issues that legislators have yet to cover — from addressing greenhouse gas emissions causing climate change to regulating broadband access. As the conservative legal movement to disempower the administrative state grew, Chevron deference became — in certain circles — shorthand for #GovernmentOverreach.
"Before its decision to overturn Chevron, the Supreme Court had already dealt a blow to federal agencies’ regulatory authority by strengthening the 'major questions' doctrine in its 2022 decision in West Virginia v. EPA. According to the major questions doctrine, a federal agency shouldn’t have the leeway to craft regulation on an issue of major national significance if Congress hasn’t explicitly allowed it to do so in legislation.
"The same bloc of six #conservative justices that formed the majority in West Virginia v. EPA also overturned the longstanding precedent of #RoeVsWade — an even older case than Chevron — in the same month. When two cases calling for an end to Chevron deference worked their way up to the Supreme Court this year, the writing was on the wall — and once again, those same six justices overturned Chevron.

Supreme Court Justice Clarence Thomas received millions in gifts over 20 years, group says

June 7, 2024"#SupremeCourt #JusticeClarenceThomas has accepted more than $2 million in gifts over the last 20 years, according to a new analysis, far eclipsing the value of those received by his fellow justices.
"A report released Thursday by the advocacy group #FixTheCourt said the value of 93 gifts to all of Thomas’ fellow justices between 2004 and 2023 were totaled $248,000, while Thomas alone received 103 gifts worth $2.4 million.
"In addition to that haul, Fix the Court flagged another 101 'likely gifts' to Thomas worth nearly $1.8 million stemming from free luxury travel and lodging he received from #billionaire #HarlanCrow and others."

"Under that lower court decision, a protest organizer faces potentially ruinous financial consequences if a single attendee at a mass protest commits an illegal act."
