I heard back from the City Administrator’s Office/Portland Solutions.

Their explanation is that the site was assessed as a campsite because pitched tents were present. Staff also noted that the tents appeared to be associated with a protest, but the City’s position is that the protest messaging does not change the campsite/removal process when the action is based on content-neutral factors like pitched tents in a pedestrian plaza, ADA access, maintenance access, and public space rules.

They also said the site was scored as high impact under the Impact Reduction Program’s assessment process, which triggered the work order for the notice.

I want to be clear that I’m sharing the City’s explanation, not endorsing the sweep or making a legal determination myself. Councilor Kanal remains strongly opposed to sweeps and continues to believe the City should be moving away from these practices. Based on what we received, the City is treating this specific notice as an application of its campsite and public space rules rather than as an action based on the content of the protest message.
