Consumer Product Safety Commission wants to collect emergency room patient data warrants a closer look. Under the Trump administration, nothing can be taken at face value...

Basically the move backwards: It used to be that disabled unemployed adults were the only ones subjected to a complete lack of privacy & digital rights, due to structural problems with laws (mostly the #ADA) & general infantilizing of said group of people, but now it's everyone.
Now more specifically a lacking of understanding and to some extent outright lying on law sets and enforcement mechanisms of #HIPPA, which doesn't really protect or enhance medical records privacy, rather the opposite in practice & the Americans with Disabilities Act #ADA which basically runs on a combination of voluntary advanced given adaptive options, and generally publicly given disclosures of medical information with requests for accommodations before formal lawsuits, (which are pretty close to completely impossible in the online sphere).

If you're in legal I'm sure you're interested in compliance. It is exciting after all, lol. Anyway... here are some you need to consider when it comes to compliance and your tech.

"Crucially, this vast trove of prescription records exists in a legal gray zone outside standard medical privacy protections. The questions about HIPAA compliance typically come up when I've discussed this subject. However, once a pharmacy uploads your data to a PDMP, that information is no longer covered by HIPAA privacy rules. Instead, each state dictates who can access the PDMP and for what purpose."

For years, I have filed a HIPPA complaint with the privacy office of every website I go to that has a Google Analytics tag that serves my protected health information, like my doctor, MyChart, labs, pharmacies, home health, case management etc. I get brushed off. It just makes me uncomfortable.
🔗 'Read the Manual': Misconfigured Google Analytics Led to a Data Breach Affecting 4.7M
Personal health information on 4.7 million Blue Shield California subscribers was unintentionally shared between Google #Analytics and Google #Ads between April 2021 and January 2025 due to a misconfiguration error.

🔗 BCBS NOTICE OF DATA BREACH: https://news.blueshieldca.com/notice-of-data-breach
"On February 11, 2025, Blue Shield discovered that, between April 2021 and January 2024, Google Analytics was configured in a way that allowed certain member data to be shared with Google’s advertising product, Google Ads, that likely included protected health information. Google may have used this data to conduct focused ad campaigns back to those individual members. We want to reassure our members that no bad actor was involved, and, to our knowledge, Google has not used the information for any purpose other than these ads or shared the protected information with anyone."

Here’s the data the #NIH can collect from your medical history for its ‘#autism database’
Story by Julia Musto, 4/23/2025
Excerpt: "While it remains unclear exactly what data will be collected, under the presented platform NIH researchers could have access to:
- Americans’ #prescription information, including the type of medication and how they are prescribed
- Data collected during medical studies in a multitude of areas and from public and private institutions
- Data collected from peoples’ #smartwatches, which can range from heart health to sleep patterns
- #Claims from private insurers that can cover items such as lengthy hospital stays, #screening and testing
- Data from the Centers for #Medicare and #Medicaid Services, which includes #referrals to specialists, enrollment, #diagnoses, and more " -
1938 Germany repeated in 21st century America. #JFKjr RobertF. Kennedy Jr. is reportedly building a national database of individuals with #autism by tapping into private #medical records. The National Institutes of Health #NIH is also involved, gathering data from both government and private sources to hand over to the secretary of health and human services #HHS #hippa #privacy #lawfedi #Neurodivergent

@PattyHanson "For those who always cry HIPPA violation, this is a #HIPPA violation.
I worked in the med community for 20 yrs. A patient's records can only be used to facilitate trmt & to seek insurance reimbursement, and even then, there are limitations on who has access to the records.
I've also participated in med studies as the researcher & as a participant. Names & other personal information must be redacted & consent must be obtained, even with HHS.
Contact your providers & say 'no'."

One of the things I cited in a long list of security and privacy problems at the last agency I worked at before setting up my own shop was their permissive use of these online services to convert images taken on the behavior techs' phones to PDF before sending them to admin for inclusion in the patient's charts. I was only there for about eight months, for obvious reasons.

Some class action lawyer is about to get rich, #Microsoft won't notice, and regular people will be more fucked and have worse lives for the remainder of their days.
OR … we could burn the entire industry down. We have 1 week. That isn't much time, but I have these schematics of their exhaust system and there's a port right here …

This feature is instant #HIPPA violation. Does your healthcare system run entirely on Linux desktops? I doubt it. Is your doc using some whitelabel patient portal software and typing in your chart on their Windows laptop/tablet? Almost certainly.
Guess who was the Devil afterall?
