#Heller (2008) is the original sin and until it is overturned there will continue to be #2ndAmendment decisions by this #scotus that will exacerbate #gunviolence. #Rahimi is an aberration.

Currently planning a piece on why parties should be fighting for #Heller to be overruled. The heart of the matter: that decision was lawless, utterly ungrounded in text, precedent, or history. It has led to an equally lawless ruling about the right to carry firearms outside one's home and to Bruen itself. 3/

While criticizing #Heller for its radical reinterpretation of the right to bear arms, she notes that it at least afforded lower courts a basis for forging a uniform approach to deciding the constitutional validity of firearms regulation. (That approach was thrown out by #Bruen.) Now, competing historical analyses will consume courts' time and attention. 23/

According to the #Rahimi Court nothing in #Heller created an unbounded right to keep handguns in the home and nothing in #Bruen disturbs the government's authority to regulate firearms possession by those who have been found to pose a credible threat to the physical safety of others. 7/
