Besonders absurd finde ich diesen Kommentar:

"Soll man nun um sicher zu gehen jetzt vor jeder Bergtour, die man mit Freunden im Österreich macht, einen Haftungsausschluss unterschreiben lassen?"

Erstens, wenn du so denkst, halte dich bitte von unseren Bergen fern. Zweitens, ich glaub ja eher nicht, dass sich Staatsanwaltschaften bei strafrechtlichen Ermittlungen von einem Haftungsausschluss beeindrucken lassen.

Rechtzeitig umdrehen, Freund*innen nicht alleine und geschwächt zurücklassen, rechtzeitig die Bergrettung alarmieren. Das machen unzählige Bergsteiger*innen jedes Jahr so und landen dann eben nicht vor Gericht.

Ich finde es übrigens absurd, wie viele Kommentare unter dem ZEIT-Artikel zum Großglockner-Fall die österreichische Rechtslage ignorieren.

"Er war doch kein Bergführer"
"privat unterwegs"
"finde es schwierig, dass die Verantwortung für das eigene Handeln und Tun komplett von der Frau auf den Mann übertragen wurde" (Das stimmt einfach nicht, da hat sich jemand gar nicht mit der Urteilsbegründung beschäftigt!)

Es ist im österreichischen Recht nun mal so, dass es bei größerer Erfahrung eines/einer Beteiligten zu rechtlicher Verantwortung kommen kann.

Und der Richter hat von der Eigenverantwortung der Verstorbenen gesprochen UND von der Verantwortung des Angeklagten, das widerspricht sich ja auch nicht.

Der Angeklagte sowie die Staatsanwaltschaft haben nun drei Tage Zeit, Rechtsmittel anzumelden.

Das Urteil (nicht rechtskräftig) im Fall des Mannes, der im Jänner 2025 seine Freundin in der Nähe des Gipfels des Großglockners zurückgelassen hat, und wegen grob fahrlässiger Tötung angeklagt wurde:

Wegen der Gerichtsverhandlung zum Fall Großglockner muss ich daran denken, dass wir uns ja manchmal über Leute lustig machen, die (z.B. auf niedrigeren Bergen oder wegen "überraschenden" Schneefalls) die Bergrettung rufen.

Aber die tun da, im Gegensatz zum Angeklagten, das richtige.

Ich habe mir fest vorgenommen, solche Fälle nicht mehr zu belächeln. Bitte ruft im Notfall die Bergrettung!

Reading discussions about yesterday's Grossglockner news (about the Austrian whose girlfriend died of hypothermia close to the peak of Grossglockner in january and who has now been charged with grossly negligent homicide) I think that maybe we have to remind people that:

- It's a 3798 m mountain (12 460 feet). It's dangerous in a windy winter night, but it's not the Mount Everest death zone when it comes to height and oxygen and the risk of high altitude sickness. Don't know why people would bring up Everest as a comparison.

- It's absolutely not relevant what the law says in other countries or what the law "typically" says in someone's opinion. It's only Austrian law that matters here.

- Just because other people were murdered in the mountains doesn't mean that was the case here. The case was investigated and the authorities decided to indict him for grossly negligent homicide so they don't think there was an intention behind it.

South Tyrol 2024. Day 3: We visited the second largest mountain of the Alps, the Großglockner. Quite a stretch to get there, but worth it once or twice. And of course there's the Edelweißspitze right next to it which you can drive all the way on top of! So we did that too. There are some nice turns there! And aside from a bit of drizzle once or twice the weather was good too.
