Sąd Najwyższy UK orzekł dziś, że „płeć” w kontekście prawa antydyskryminacyjnego oznacza płeć w sensie biologicznym.
W internecie spodziewajcie się okrzyków, że to „likwiduje ochronę osób trans”.
To nie jest prawda.
Osoby trans są w tym prawie chronione pod cechą „zmiany płci” (gender reassignment). Osoba która przeszła (jakkolwiek rozumianą) zmianę płci nie może być traktowana gorzej niż analogiczna osoba, która jej nie przeszła. To się nie zmienia. Osoby trans pozostają chronione.
Sąd stwierdza też wprost, że osoby trans są również chronione przed dyskryminacją ze względu na *postrzeganie* ich jako danej płci.
Tak więc, cały czas:
Kobieta, która podda się tranzycji i obecnie identyfikuje się jako mężczyzna (transmężczyzna) nadal nie może być traktowana gorzej:
— niż porównywalna kobieta, wg kryterium zmiany płci, przez to że poddała się tranzycji (a np. pracodawca jest transfobiczny i nie chce takich „dziwaków”);
— niż porównywalna kobieta, wg kryterium płci, przez to że jest odbierana jako mężczyzna (a np. pracodawca „woli” mieć jako sekretarkę kobietę niż mężczyznę i dlatego nie zatrudni transmężczyzny);
— niż porównywalny mężczyzna, wg kryterium płci, przez to że jest kobietą (i np. pracodawca chce ją dyskryminować bo może zajść w ciążę).
O co więc chodzi w wyroku?
Wyrok dotyka zupełnie innej kwestii, mianowicie: czy kobiety mogą mieć chronione miejsca tylko dla kobiet, czy mogą mieć kobiece schroniska dla bezdomnych, kobiecy sport itd.
Brytyjskie prawo dyskryminacyjne mówi: tak, mogą, przy zachowaniu pewnych warunków.
Sąd wskazał natomiast, że przy innej niż biologiczna definicji słowa „płeć” te warunki stają się niemożliwe do spełnienia.
Innymi słowy: przy definicji innej niż biologiczna, dopuszczalność jakichkolwiek miejsc tylko dla kobiet — nawet w sensie obejmującym transkobiety — efektywnie zniknęłaby z prawa, bo warunku tej dopuszczalności byłyby nieosiągalne.
Dlaczego ktoś miałby tego chcieć?
