Copyleft is a legal trick based on copyright laws that instead of restricting everyone from using a piece of software, it guarantees the rights of everyone to use a piece of software. The GPL (Gnu Public License) is the canonical copyleft license, and it is well described on the Gnu website here: gnu.org/licenses/copyleft.en.h

The Linux kernel and GNU operating system are examples of software under the GPL.

F.O.S.S. stands for Free Open Source Software. FOSS is a sort of movement in the collaborative, communal software world where the public works together on mostly copyleft software to solve large and important software engineering problems.

The trend of FOSS is now getting into the collaborative, communal space of hardware engineering, where you're starting to see Free and Open Source Hardware or FOSH appearing more often. Hardware design licenses are still pretty new and many people simply use GPL or CERN has a good hardware license.

That's a lot of complicated legal licensing tricks that can be basically summarized as: "Let's share our designs and work together on technical solutions to large, complicated, important problems."

I was just wondering if you had any opinions on these movements in the software or hardware product design spaces.

I believe that open source solutions to these problems exist. The spirit of this license, I believe, exists to promote the ability of the public to use this software, freely unencumbered.

    Am I missing something?

I don't see a clear answer in the history of the email thread that you've linked regarding the question of how the SSPL does not satisfy the OSD.

I find that there are various people's individual opinions represented in the meeting minutes, but these don't represent the decisions of the OSI (or the FSF).

I am interested in strong copyleft licenses and the SSPL sounds like a strong copyleft license to me, on first reading, as an amateur.

It is not clear to me why it is not a strong (and healthy) open source free software license.

If this information is already clearly summarized somewhere, please point me to that location.

Otherwise, it would be great to hear a brief summary of how the SSPL violates the rules of the OSD.

I haven't received a single clear answer on the question of how the SSPL violates any of the OSD rules.

I've been CC'ing the FSF and OSI on my conversations on this topic, and I hope to hear from them!

    Also, cc'ing @ark74 .

One thing I really value in the SSPL is that it recognizes the fact that a modern "app" is actually a collection of distributed cloud-based services, and the SSPL attempts to roughly categorize those services, e.g. a UI is needed for the user to interact with the app, etc.

In order to copyleft a modern app, a new license is needed. The SSPL looks like it might be the closest thing I've seen to such a license.

I've read the document. Are you referring to this section?

    ---
all programs that you use to make the Program or modified version available as a service, including, without limitation, management software, user interfaces, application program interfaces, automation software, monitoring software, backup software, storage software and hosting software, all such that a user could run an instance of the service using the Service Source Code you make available.
    ---

Do you think this section refers to a specific field of endeavor?

This wording strikes me as possibly useful wording for all kinds of fields of endeavor within the domain of cloud-based computation, which is really included in a lot of daily life and products these days. This wording just seems to refer to cloud-based computation and not any specific cloud-based app or type of app.

For example, I could imagine research scientists, like physicists taking advantage of SSPL software to do large-scale physical simulations.

Also, I could imagine businesses of all types could use SSPL software and cloud-based services without discrimination, as far as I can tell.

The SSPLv2 appears to me to protect the freedom of the users more than the AGPLv3 does.

As a user, I can run the SSPL software on my local machines because the entire SaaS stack that runs it is guaranteed to be FOSS.

As a user of AGPLv3 software, I'm not guaranteed to have the freedom to run the entire SaaS stack on my own machines because it doesn't guarantee that the stack is FOSS.

    @fsf

OK, you are dragging your feet on giving a clear explanation of what you claim to see clearly. It makes me think that you can't give me a clear explanation of how it breaks rule #6 of the OSD.

I just read through this webpage, which shows the difference between the AGPLv3 and the SSPLv2.
    webassets.mongodb.com/_com_ass

I still do not see any specific field of endeavor mentioned in the SSPL. It mentions that if the free software is used and provided as a service, that service must also be FOSS. That doesn't limit the service to be for any specific field of endeavor. The SSPL software could be used for any field of endeavor. What field of endeavor do you see being limited?

You say: "It may also be helpful to compare the SSPL text and the AGPL-3.0 text ... and consider the differences ... that ... makes it ... clear why the SSPL does indeed introduce restrictions on field of use (OSD #6) that the AGPL-3.0 does not have, and therefore does not meet the OSD."

Why? Tell me. What does the SSPL say that places restrictions on field of use?

  11. @pmonks @osi

I'm not thinking of the OSD as a blame game. I'm thinking of the OSD as a logical definition that I can use myself to determine if a license is a "Free and Open Source Software" license. The OSD is a great mental tool for me to use, if I understand how to use it.

The process of applying the OSD to the existing licenses in the world is managed in some part by the OSI. That's awesome. I guess this requires applications and so forth. I think it'd be cool if the OSI just went ahead pro-actively and gave their analysis on all kinds of licenses to better educate the public (me).

It is not clear to me what the opinion of the OSI is with respect to the SSPL. It's also not clear what the FSF's opinion is, if it is the same as the OSI, or not?

It did seem clear from the email thread you provided that the SSPL was not acceptable to the OSI for some reason. That was a judgement made by the OSI and no one else is responsible for that judgement.

  12. @fsf @osi

    Hi FSF and OSI,

Please forgive my layman's understanding of software licenses as I'm not a lawyer.

I'm a software engineer with an entrepreneurial streak.

I've just discovered SSPL as a possible copyleft license that I understand might be a stronger form of copyleft than the AGPL provides, guaranteeing that not only the software itself, but also the software providing the package's services to the public are also guaranteed to be free and open source. In this case, that's a lot of new user freedoms to run the SaaS locally on personal machines at any point in the future with new updated versions available.

I am curious what the OSI and FSF think of the SSPL. Does it obey the FSD? Specifically, does it obey rules #6 and #9 of the FSD?

I am super excited about the SSPL possibly being a stronger copyleft license than the world has yet seen, but that's my inexperience talking probably.

Any pointers you have for better understanding would be greatly appreciated.

    Thank you,
    Bo Morgan

  15. @msw

Thank you for the recommendation to read Lawrence Rosen's "Open Source Licensing: Software Freedom and Intellectual Property Law", July 2004. It was very informative, and clarified a lot of issues for me around licensing, patents, trademarks, copyright, and contract law.

Because it was published in 2004, it only describes the GPLv2 and not the GPLv3 and does not include the AGPL. The strongest open source license in the book appears to be Rosen's own OSL (Open Source License) because of its broader focus not limited to "programs" or "files" as the GPL and MPL do.

Do you have any recommendations for a book to read that includes the newer open source reciprocal licenses and the more modern open source licensing landscape? I am hoping to compare the AGPL and the OSL and possibly newer reciprocal licenses, or understand newer arguments for/against reciprocal agreements.

    Thanks again!

  16. I have switched to Mint Mobile (in the US, in California) and now I have full functionality of calls, texts, cellular Internet, and now multimedia messaging works as well. All of the radios also seem to work, including Wifi and Bluetooth.

Sometimes it loses cellular and needs a reboot, but this seems to be a rarity.

I've got spheres, cylinders, and cubes with reliable intersections, unions, and differences, which was not possible with Open3D.

I'm excited to start a larger design to see how Blender holds up.

  19. Are there software licenses out there that guarantee to the user the ability to receive updates and improvements to a piece of open source software?

I don't know of any license other than the GPL that provides this guarantee to the user.

I know that I'm more motivated to learn a new tool when it is protected by the GPL because of this guarantee that future versions will also be open source.

When I license my own software, I choose the Affero GPLv3 because it provides this extra guarantee to the users, even if the software serving the user is on a webserver.

  20. #introduction

    I fight for the users.

I love programming and thinking and talking about thinking. I have an education (BS, MS, PhD) focused on artificial intelligence and neuroscience.

I'm an advocate of the public academic pursuit of knowledge, the scientific process, peer review, and I see open source software and hardware as an essential part of the scientific process.

I see software user rights, including security and privacy, to be protected mainly by free open source software, specifically software with a copyleft license, i.e. GPL or Mozilla.

I see the democratizing effects of the Internet, including distributed journalism and social networking, to be largely the effect of the collaborative development of free and open source software.

I am interested in free and open source manufacturing, including open source 3D printers and CNC machines. I believe open source manufacturing will be important for distributed manufacturing, allowing local manufacturing and local labor.

I see worker-owned coops as the way to safely transition from a non-democratic authoritarian top-down power structure of a traditional corporation to a democratic work environment, where the workers own the company and elect the board of directors, transitioning to democracy in the workplace.

I believe that socialism is a regulatory response to capitalism.

I believe that laws, money, corporations, and government are social agreements, and I'm in favor of democratic social agreements.

I believe in the organized non-violent boycott as a way to control capitalists and change corrupt systems.

I am a pacifist. I am against violence. I am against citizens keeping guns in cities and towns with children. I am against war.

I try to eat plant-based / vegan foods to boycott the animal industry, to help with the climate crisis, to improve my health, to avoid animal cruelty, and to avoid the extinction of species of plants, animals and ecosystems.

I have been diagnosed with Retinitus Pigmentosa, which is a disease of progressive retinal degeneration. I am legally blind, although I have about 5-degrees of vision remaining in my fovea. I'm interested in researching and developing BCIs (Brain-Computer Interfaces), specifically BCIs that function as vision prostheses that may help with conditions like RP, or the more common degenerative retinal disease AMD (Age-related Macular Degeneration).

I enjoy playing computer games like Age of Empires and Rimworld. I used to program computer games when I was younger and would like to get back to it one day.

I love playing music, especially bass guitar. I've been listening to a lot of Rage Against the Machine and Enya recently.

I enjoy reading books, mostly non-fiction.

I enjoy studying religions. I've found a lot of value in Buddhism, and I meditate often daily.

Nina and I have recently had our first baby, a boy we call Tyoma.

I'm currently working at Brain Computer Enterprises, Cooperative Inc. on FOSH assistive consumer electronics.

    I'm sober.
