@dangillmor The #FelonyMurder statutes are poorly written. A minor criminal who participated in an intended misdemeanor larceny could end up on death row when his partner kills somebody with an unknown gun. OTOH, the energy traders that brought down the California electric grid in 2000 killed elderly people in nursing homes from excess heat and inoperative medical equipment as surely as if they had walked in and shot them. Nobody was charged for these deaths. #WhiteCollarCrime

Important article on vicarious criminal guilt (joint venture and felony murder). The authors find that, empirically, "racial bias has fueled the operation and survival of the rules. ... [I]mplicit racial bias has led to the automatic individuation of white men ... involved in group crimes, while at the same time created automatic de-individuation for Black and Latino men in similar situations." #LawFedi #FelonyMurder

This is the kind of scholarship that I'm here for. The authors take the long-settled criminal legal concepts of felony murder and accomplice liability and expose them for what they are: racist in application and in conception. Quote follows. /1

After spending 8 years in prison, LaKeith Smith finally landed a resentencing hearing for his felony murder charge. The judge didn’t change much.

Editorial from the #DemingHeadlight on #felonymurder:
"...felony murder has been used as a net to convict and confine people peripherally involved in fatal crimes throughout the United States. A task force created by the Minnesota legislature recently found that charges of aiding and abetting felony murder disproportionately targeted Black and Brown defendants, as well as younger people: 63 percent of them under the age of 25 and 9 percent under 18."

Minnesota lawmakers seem to be reckoning with the issue of #felonymurder head on…

LaKeith Smith is finally being resentenced. But he’ll face the same Alabama judge who sent him to prison for felony murder when cops killed his friend.
