Former CIA Official David Rush, $77,000 in False Leave Claims and a $40 Million Gold Mystery

Rush was arrested in May after investigators found more than 300 gold bars worth over $40 million at his Virginia home, alongside roughly $2 million in cash and 35 luxury watches.
THE $77,000 QUESTION
Rush’s formal criminal charge is rather less cinematic than the mountain of bullion. According to an FBI affidavit, he allegedly claimed 744 hours of military leave after leaving the Navy Reserve in 2015, resulting in approximately $77,000 in compensation.
That alleged timesheet fraud is central to the charge of theft of public money. The important legal distinction, however, is that the $77,000 and the gold are not simply one combined criminal charge.
As of September 2026, Rush has formally faced one count connected to the alleged theft of public funds. His lawyers have disputed aspects of the government’s case, and the gold’s precise legal status has become increasingly important.
In September, federal prosecutors and Rush’s defence team told a Virginia federal court they had reached a tentative plea agreement in principle. They requested additional time, with the indictment deadline extended to October 8.
THEN THERE WAS THE GOLD
The FBI says agents searching Rush’s Virginia home found approximately 303 one-kilogram gold bars, worth more than $40 million at the time, plus cash and luxury watches.
The extraordinary part is how investigators say the gold entered the picture. Between November 2025 and March 2026, Rush allegedly requested significant quantities of foreign currency and tens of millions of dollars in gold for purported work-related expenses.
Investigators later could not account for the assets. The FBI search on May 18 reportedly recovered the bullion at Rush’s home.
There is another layer. Investigators alleged that Rush had misrepresented parts of his educational and military background, including claims concerning university degrees and Navy service. He had worked for the CIA for years and held a senior-level position with top-secret clearance, according to reporting based on court documents.
Reports have also described an alleged fake classified programme used to justify requests for gold and foreign currency. Some details remain protected because the case involves classified information, which makes the usual courtroom transparency rather more complicated.
And that brings us to the genuinely unresolved question: exactly what happened to the $40 million worth of gold, and under what authority was it obtained?
According to AP, Rush’s lawyer has maintained that the gold is unrelated to the theft charge. The government, meanwhile, has alleged a connection between the bullion and government resources.
So, yes, the headline practically writes itself: former CIA official, fake credentials, fraudulent timesheets, hundreds of gold bars and millions in cash.
But legally, the story is still developing. A tentative plea agreement is not a conviction, and the final facts may remain partly obscured by classified material.
