  2. I got nominated in the Credit The Creators newsletter! 🎉

I submitted my latest video last week, and I was absolutely delighted and honoured to have been one of the four creators selected for a poll for next week’s Featured Creator! This was my most ambitious video yet, one that I was very nervous to release due to the subject matter, so I couldn’t be happier with the engagement and support it’s been getting! 😄💚

Thank you so much to @jjjacksfilms‬ and his team for picking me, and best of luck to the other three creators chosen! If you’d like to vote for me, subscribe to the Credit The Creators newsletter and find the poll for Week 29 (Voting is for two days only, so make sure to get your vote in ASAP)!👇

  5. Comedy and satire could get new boundaries with new NZ Bill

It is surprising that New Zealand has been slow to recognise such exceptions - given it has been the origin of John Clarke, Footrot Flats, the Flight of the Conchords, What We Do in the Shadows, Wellington Paranormal, Meet the Feebles...

  6. A rare copyright win for the public – but a small one, only in Canada, and possibly temporary

It is extraordinary that within the copyright world it is accepted dogma that legal protections for this intellectual monopoly should always get stronger – creating a kind of copyright ratchet. One of the manifestations of this belief was the WIPO Copyright Treaty, signed in 1996, which extended copyright in important ways. A key element was the prohibition of any […]

  7. 'The Federal Court of Canada has issued a landmark decision (Blacklock’s Reports v. Attorney General of Canada) on copyright’s anti-circumvention rules which concludes that digital locks should not trump fair dealing. Rather, the two must co-exist in harmony, leading to an interpretation that users can still rely on fair dealing even in cases involving those digital locks.' michaelgeist.ca/2024/06/huge-w #copyright #digitallocks #TPMs #fairdealing @mgeist

  9. I wonder if anyone is operating a podcast that republishes any public debate among election candidates or leaders. So people can subscribe and get all the debates in one feed. If they are, I wonder how copyright might impact them?

Let's say it's someone who lives in Aotearoa. Podcasting from an onshore server, with no advertising or any other revenue. Would they be protected by Fair Dealing?

  10. CW: Long thread/22

But what about #FairDealing (similar to #FairUse)? Linkletter argued that linking to a video that shows that Proctorio's assurances to parents and students about its products' benign nature were contradicted by the way it talked to educators was fair dealing. Fair dealing is a broad suite of limitations and exceptions to copyright for the purposes of commentary, criticism, study, satire, etc.

  11. @mgeist In this fiscal year 95% of Guelph's $8.5M acquisition budget will be spent on electronic resources.

What I think is amusing about the copyright lobby is that any extra cost we have to incur in copyright clearance is less money we will be able to spend on new content. In our case an early victim would probably be the popular reading collection aka the very creators who are often the most vocal about the detrimental impacts of #FairDealing

  12. It's #FairDealing week and I'm best pleased to see this article asking for a little bit of respect for the jurisprudence handed down by the Supreme Court.

"spending on licensing and materials has steadily increased to approximately $400 million a year. While the judiciary has grasped the reality of the situation, legislators and policy makers continue to hear self-serving narratives about problems that do not exist in a kind of marrying of goblin mode with gaslighting."

  14. @chicagonz thanks! I dressed up as Poison Ivy a while ago to discuss #TM and #Copyright protection of characters, and the application of #FairUse / #FairDealing to #Cosplay which went down well!

  15. @law #LawFedi Following the post above, in an act of shameless self-promotion I published an article on fanfiction earlier in 2022 - check out the article on my open access page:

I'm always interested in opinions about fanfiction - especially whether it should be permitted, but strictly non-commercial? And are there other issues with Real Person Fics?

    > And unless you have copyrighted you messages, there's nothing to claim for.

Even if you have, they have to be published for #copyright to apply, and the research these folks are doing would most likely be protected by #FairUse/ #FairDealing.

  17. It's #FairDealingWeek 2020 (24 - 28 February). Fair dealing copyright exception enables people to use copyrighted works for certain purposes (like research or educational use) w/o requiring special permission from the copyright holder. Find out more fair-dealing.ca -- #FairDealing

  18. Canadians have opposed extending #copyright in other trade agreements. Yet the government perversely agreed to that in the new NAFTA. When/if CUSMA gets ratified, it means a 20 year dry spell before new work enters Canada's public domain. Good read on #FairDealing here: lib.sfu.ca/help/publish/schola
