    📍Zine #1: Community Struggle and Political Repression in Eloxochitlán de Flores Magón. The Case of Miguel Peralta Betanzos (2017):

    This conflict has always been complicated and difficult for many of us to understand. Communal forms of organization were present that not all of us knew or understood. The existence of a struggle over community resources. The legacy of Magón. Different family members have been involved in the conflict. Above all, the evident division of the people between the representative authorities of the state and the community assembly.

    It was difficult to analyze all of this from the outside, with little information and with some doubt: What would an anarchist have to do with a conflict that could be reduced simply to an electoral dispute? Soon we began to unravel the situation and something was becoming more and more clear: there was one side, the state, putting to use its repressive resources against the community assembly.

    Thus, the reduction of the conflict to an electoral dispute pointed to something much larger: the struggle of the people and the community assembly was not for the mere presence of a “false” municipal president. It was rather for the autonomy of the people and the strategies they developed to maintain themselves outside of the state.

    📍That ruling should have put an end to the political persecution against him. However, on June 12, 2026, we were notified that the case of Miguel has returned to the Supreme Court, as the court accepted a motion for review filed by the accusing party—the State Congresswoman Elisa Zepeda—against the ruling granting him absolute freedom.   5. Update on the Case of Mazatec Anarchist Miguel Peralta

    In Eloxochitlán de Flores Magón, deep in the Sierra Mazatec mountains, there is no forgetting and there is no surrender. There is memory, rage, and a community that doesn’t ask for permission to exist. In the face of a system of “justice” that seeks to destroy the community, the response has been resistance and solidarity, weaving the pathway of freedom.

    For more than a decade the community of Eloxochitlán de Flores Magón has been standing up to institutional racism, wresting from the state little by little what belongs to them: freedom. Because nothing has been a gift. Everything achieved has been through struggle in the streets, in front of the court houses, in the tribunals, in front of the prisons, in the protest encampments that resist attrition, in the autonomous spaces, collectives, and individuals who have joined the call for freedom.

    As is already well-known, this case derived from manipulation. It was fabricated from the positions of power of Elisa Zepeda, Manuel Zepeda, the Public Prosecutor of Huautla, and an entire network of interests of the government of Oaxaca in 2014. It was not an error, but rather a strategy.

    And nonetheless the community and many others who are part of this struggle continue resisting.

    Today, April 30, we remember the day that Miguel was detained. Twelve years ago, they snatched from him his freedom. Today, more than 12 years later, despite favorable rulings, the legal situation remains bleak.

    On February 20, 2026, the First Collegiate Court of Oaxaca, which in 2023 issued a timid ruling, recognized this time what we have always sustained: this is a fabricated case with witnesses planted for personal interests in exchange for political favors. This victorious sentence is historic because it also recognizes that the testimony of Elisa Zepeda is implausible.

    On March 3rd, the Third Circuit Court—the same that revoked Miguel’s freedom in 2022—was obligated to recognize his innocence against all accusations, confirming that the crimes of homicide and attempted homicide do not exist.

    What has been achieved isn’t a favor granted by the system, but the result of years of struggle, of refusing to remain silent, of refusing to give up.

    Recently, the State Congresswoman Elisa Zepeda has been moving her pieces with cold calculation, activating her networks of influence and her financial machinery of misinformation to try to consolidate her lies and position herself. She has filed an appeal with the Supreme Court against the recent resolution from the Collegiate Court in Oaxaca, despite lacking the standing to do so. The Supreme Court already ruled on the case and the State Congresswoman never before presented an appeal to defend the arguments that she is now putting forth. She lost that opportunity. Furthermore, according to the constitution, there is no issue on which the Supreme Court can rule. The Collegiate Court only did what the Supreme Court ordered them to do in 2024.

    The decision on whether or not to proceed with Elisa Zepeda’s appeal falls on the President of the Supreme Court, Hugo Aguilar Ortiz. Since there are no legal or sociopolitical grounds for granting yet another judicial favor for the cacique family, the appeal must be dismissed.

    Yet, we are not ignorant of the relations of power and influence that exist between Elisa Zepeda Lagunas, her lawyers from the organization Litigio Estratégico Indígena, and the President of the Supreme Court, Hugo Aguilar Ortiz. We are not ignorant of the Mexican State’s ongoing war against Indigenous community organization, autonomy, and territorial defense. If the appeal proceeds at the Supreme Court, we know that it is a consequence of these relations of power and influence, and not of any legal merit.

    Regardless of the outcome, the resistance will continue. We know that this still isn’t over.

    On February 20, the court in Oaxaca again ruled on an appeal in the case of our compañero and friend, Miguel Peralta Betanzos.

    For more than 12 years the Mazatec people have resisted and countered the cacique attacks against their territory and community.

    On Friday, the First Collegiate Court for Criminal and Labor Matters in the State of Oaxaca issued a “partial” ruling on the case:

    ABSOLVING Miguel of the charge of attempted homicide.

    LEAVING OPEN HIS PROCESS for the charge of homicide.

    In both cases, the arguments provided by the legal defense and the evidence were more than sufficient to not only understand Miguel’s innocence but also to demonstrate the absurdity, capriciousness, and arrogance of the accusations of the cacique Zepeda Lagunas family against members of the community assembly.

    - To all those who have supported and shown their solidarity, we appreciate your presence and attention!
    - To the legal defense who have put so much sweat, effort, and determination into this case, thank you so much!

But for compas who are being persecuted, or living on the run, it is difficult to articulate it all, every emotion. It is somewhat like existing without a clear identity. Being on the run means living constantly with tension. Being on the run means not sleeping well. Being on the run means living daily uncertainty, with the constant risk of being detained. Many things can happen along the way.

    Regarding the legal resolutions, or how our legal process has progressed over the last decade. We, or at least I, have always doubted the system of justice in Mexico, in Oaxaca, in Huautla.   12. Continúa el llamado a la solidaridad con Miguel Peralta Betanzos

    Ya pasaron más de tres meses que fueron otorgados al Primer Tribunal Colegiado de Oaxaca para resolver el amparo en el caso 631/2022 del perseguido político Miguel Peralta Betanzos. Como de costumbre, el Estado incumplió sus propias normas para desgastar a lxs compañerxs que enfrentan procesos legales, a sus familiares, a sus comunidades y a sus compas. Ahora parece que la audiencia y la resolución del Tribunal vendrán hasta las próximas semanas de enero o febrero. Aunque tampoco confiamos en la palabra del Estado.

    Es importante destacar que éste es uno de los últimos recursos jurídicos que le quedan a Miguel Peralta para librarse de la persecución política por parte del Estado mexicano. Para esta resolución hay múltiples resultados posibles. Uno es que se confirme su condena original de 50 años de prisión. Otra es que se le absuelva de todos los cargos y se le conceda la libertad absoluta. Mucho está en juego...

    Convocamos a todas las personas a acompañar a la familia y compañerxs de Miguel a las afueras del tribunal para exigir que se estudie de fondo el caso y en consecuencia se le otorgue libertad absoluta para poner fin a la criminalización contra él y su comunidad.

    Nos encontraremos a las afueras de los juzgados de distrito del Estado de Oaxaca, mejor conocido como el “queso”.

    El caso de nuestro compañero Miguel Peralta Betanzos, indígena mazateco, anarquista y defensor comunitario quien desde hace mas de diez años libra una lucha al lado de su comunidad por la defensa del territorio y autonomía se encuentra en un momento decisivo, ya que el Primer Tribunal Colegiado en Materias Penal y de Trabajo ubicado en San Barolo Coyotepec, Oaxaca, entre los meses de octubre y diciembre, emitirá una resolución jurídica del amparo directo 631/2022. Este es el último recurso para Miguel.

  16. Miguel Peralta Betanzos is a community organizer and anarchist from the Mazatec community of Eloxochitlán de Flores Magón, Oaxaca. Together with his family and community members, for more than a decade, Miguel has faced criminalization, imprisonment, and persecution from the Mexican State for his struggle against cacique-political party power in defense of the autonomy and self-determination of his community.

    Following a sociopolitical conflict that exploded into violence in Eloxochitlán de Flores Magón in December 2014, caused by a cacique attack on the community assembly, Miguel was detained in April 2015 on fabricated charges. In October 2018 he was sentenced to fifty years in prison.

    Following an appeal and nearly a month on a hunger strike, in October 2019, Miguel was absolved of all charges and released. During the four years and six months Miguel was in prison, he was active in the struggle against prisons and for the freedom of the other political prisoners of Eloxochitlán.

    More than two years after his release, on March 4, 2022, the Collegiate Court in Oaxaca revoked Miguel’s freedom, confirming again his original fifty-year sentence and issuing an arrest warrant against him. Since then, Miguel has been displaced from his community, living beneath political persecution.

    On November 6, 2024, the Supreme Court of Justice of the Nation ruled on an appeal in Miguel’s case. Instead of ordering his absolute freedom and ending the political persecution against him, the Supreme Court returned the case to the Collegiate Court in Oaxaca ordering that court to rule again on the case. The new ruling is expected sometime in late 2025.

    It is important to mention who is responsible for the repression in Eloxochitlán: the cacique Manuel Zepeda and his daughter, the state representative, Elisa Zepeda Lagunas. Occupying positions of power and mobilizing the repressive apparatus of the state, they have terrorized the community for more than ten years.     Zine #1: Community Struggle and Political Repression in Eloxochitlán de Flores Magón. The Case of Miguel Peralta Betanzos

    This conflict has always been complicated and difficult for many of us to understand. Communal forms of organization were present that not all of us knew or understood. The existence of a struggle over community resources. The legacy of Magón. Different family members have been involved in the conflict. Above all, the evident division of the people between the representative authorities of the state and the community assembly.

    It was difficult to analyze all of this from the outside, with little information and with some doubt: What would an anarchist have to do with a conflict that could be reduced simply to an electoral dispute? Soon we began to unravel the situation and something was becoming more and more clear: there was one side, the state, putting to use its repressive resources against the community assembly.

    Thus, the reduction of the conflict to an electoral dispute pointed to something much larger: the struggle of the people and the community assembly was not for the mere presence of a “false” municipal president. It was rather for the autonomy of the people and the strategies they developed to maintain themselves outside of the state.

    Fanzine #1: Lucha comunitaria y represión política en Eloxochitlán de Flores Magón. El caso de Miguel Peralta Betanzos (2016)

    El conflicto siempre se presentó como algo complicado y poco entendible para muchxs de nosotrxs. Se atravesaban formas comunitarias que no todxs conocíamos y comprendíamos; la existencia de una lucha por los recursos comunitarios; el legado magonista; se presentaban varixs actorxs encontradxs que eran familiares y; la evidente división del pueblo entre las autoridades representantes del Estado y la Asamblea Comunitaria.

    Fue complicado analizar todo esto desde afuera, con poca información y con dudas al respecto pues, ¿Qué tendrían qué hacer unxs anarquistas ante un conflicto que podría reducirse a una cuestión electoral? Cosa que pronto fuimos desmarañando y nos iba quedando cada vez más claro algo: había un lado, el del Estado, ocupando sus recursos represores contra lxs miembrxs de la Asamblea Comunitaria.

    Así, aquella reducción del conflicto a una cuestión electoral apuntaba a algo mucho mayor: la lucha del pueblo y la Asamblea Comunitaria no era por la mera presenciade un presidente municipal “espurio” sino por la autonomía de los pueblos y las estrategias que elaboran para mantenerse al margen del Estado, sus órganos represores y su control.

  23. Solidaridad con Miguel Peralta

    Miguel Peralta es un defensor comunitario y anarquista de la comunidad de Eloxochitlán de Flores Magón, Oaxaca. Junto a familiares e integrantes de su comunidad, durante casi una década, Miguel se ha enfrentado a la criminalización, encarcelamiento y persecución por organizarse por la autonomía y la autodeterminación contra el poder caciquil-partidista.

    A raíz de un conflicto sociopolítico en la comunidad de Eloxochitlán de Flores Magón en 2014, Miguel fue detenido en abril de 2015 bajo cargos fabricados. En octubre de 2018 fue condenado a 50 años de prisión. Tras la interposición de un amparo, y casi un mes en huelga de hambre, en octubre de 2019 Miguel fue absuelto de todos los cargos y puesto en libertad.

    Mas de dos años después, el 4 de marzo de 2022, la Tercera Sala Penal de Oaxaca revocó su liberad, condenándolo de nuevo a 50 años, y liberando una orden de aprensión en su contra. Desde entonces, Miguel ha sido desplazado de su comunidad, teniendo que vivir bajo la persecución política.

    En enero de 2024, la Suprema Corte de Justicia de la Nación admitió un amparo relacionado con su case y se espera la fecha de audiencia y resolución. Mientras tanto, seguimos llamando a la solidaridad con Miguel Peralta y la comunidad de Eloxochitlán de Flores Magón, Oaxaca.

    A casi 5 años de la salida de prisión de nuestro compañero Miguel Peralta la persecución continúa. ¡Libertad absoluta ya!

    El próximo 14 de octubre se cumplen 5 años de que se logró la salida de prisión de Miguel, pero no así su libertad pues en marzo de 2022 el juzgado de Huautla, Oaxaca, le revocó su libertad condenándole nuevamente a 50 años de prisión, desde esa fecha hasta ahora nuestro compañero sigue en una situación de persecución política por lo que queremos hacerles la invitación a las radios y medios libres, los colectivos autónomos, anarquistas, anticarcelarios, las comunidades y barrios en lucha, a sumarse a un cadenazo radial contra la prisión y en solidaridad con el perseguido político Miguel Peralta. Pueden participar con un bloque radial de media o una hora. Igual pueden mandarnos material de audio para subirlo a la transmisión. Vamos a compartir historias, experiencias, y casos actuales de represión del Estado y lucha contra el sistema y sociedad carcelaria.

  27. Legal Situation of Indigenous anarchist Miguel Peralta Betanzos

    What is currently happening?

    Indigenous Mazatec community organizer and anarchist, Miguel is one of 35 members of the community assembly of Eloxochitlán de Flores Magón, Oaxaca, who have faced political persecution and/or imprisonment following a campaign of cacique repression, torture, and terror which came to a head in December 2014.

    October 2019. After just over four years and five months in prison on fabricated charges, following growing pressure from the streets and almost a month on a hunger strike, Miguel is freed from prison.

    March 2022. The Supreme Court of the State of Oaxaca revokes his freedom ordering a new arrest warrant, again imposing a 50-year prison sentence, forcing him to flee from his community.

    August 2022. Los Otros Abogadoz, Miguel’s legal defense team, file an appeal against the resolution.

    September 2023. The magistrate judges resolve the appeal, returning his legal process to the cross-examination stage, rolling it back more than seven years, which again he would have to face from inside prison.

    His legal defense team files for revision, soliciting the Supreme Court of the Nation (SCJN) to review and rule on the appeal.

    January 2024. The Supreme Court of the Nation accepts to review the appeal and has three months to rule on the case.

    The legal situation of Miguel Peralta is still unresolved. He continues being persecuted by the state, subject to a legal process orchestrated and controlled by politician Elisa Zepeda Lagunas in coordination with other state authorities. We demand that the Supreme Court take account of the different human rights violations that have maintained the compañeros of Eloxochitlán imprisoned and persecuted for more than nine years. We demand a sentence of absolute freedom for Miguel.
