  2. @tony The #UKgov has only 2 possible levels of appeal:

1/ to the Court of Appeal (#EWCA)
2/ to the Supreme Court of the United Kingdom (#UKSC). The #HomeSecretary #ShabanaMahmood says she wants to appeal, but I dunno if leave to appeal has been granted.

Both levels of appeal would probably take ~18–24 months to get a final answer from UK courts.

However, if the UK courts back the govt, then #HudaAmmori could appeal to the European Court of Human Rights (#ECtHR). Probably another 2–3 years.

  9. @ChrisMayLA6 Yes! That reliance on the #EU to avoid domestic debates also applied to the #ECHR. e.g. both gays in military and #genderRecognition were explicitly based on #ECtHR rulings rather than on democratic debate, even tho both were easily winnable at home.

And of course, the UK has never tried to de-imperialise. Most Brits are staggeringly ignorant both about imperial history and global revulsion at #BritishEmpire.

Both Labour & Tories speak of Britain "leading". Imperial entitlement

  15. The European Court of Human Right is 'more necessary and relevant' now, says the #ECtHR's outgoing UK judge Tim Eicke KC. lawgazette.co.uk/news/ecthr-mo

Tim Eicke is of course right. But the #ECHR is under sustained attack from the #UK's billionaire-owned media, and opinion polls give 50% of the vote to parties committed to leaving the convention: #ReformUK and the #ConservativeParty.

The #LabourParty (#LINO) is only lukewarm about the convention. It looks like defeat has already been conceded 😞

  16. Detailed analysis of Caster Semenya case at Verfassungsblog:

“Caster Semenya was wronged, and Switzerland – due to the inaction of the Swiss Federal Supreme Court (SFSC) – was held responsible by the Grand Chamber (GC) of the ECtHR….

This conclusion to a long judicial marathon is an important vindication for an athlete who saw her career destroyed by a process that violated her right to a fair hearing.”
