Online invulhulpen voor de DPIA en het IAMA

Bij verwerkingen van persoonsgegevens is het belangrijk om vroegtijdig inzicht te krijgen in mogelijke privacyrisico’s voor betrokkenen. Dit doe je door een Data Protection Impact Assessment (DPIA) uit te voeren. Bij de inzet van impactvolle algoritmes of een hoog-risico AI-systeem is het aanbevolen om de impact op de grondrechten van betrokkenen in kaart te brengen met het Impact Assessment Mensenrechten en Algoritmes (IAMA).  

Een IAMA of DPIA uitvoeren is een multidisciplinair proces. Om verslaglegging te vergemakkelijken en het samenwerken te bevorderen is voor beide assessments een online invulhulp ontwikkeld. De pre-scan helpt je om te bepalen welke assessments gedaan moeten worden.

Invulhulpen voor overzicht, samenhang en tijdsbesparing

Het team Algoritmen en waarborgen en het privacyteam van CIO Rijk en Digitaliseringsbeleid ontwikkelden deze invulhulpen samen met het Chief Data Officer (CDO) Office van het ministerie van Justitie en Veiligheid (JenV) en het Rijks ICT Gilde. De invulhulpen zorgen voor overzicht, samenhang en tijdsbesparing.

Zo werkt het:

• Met een beperkt aantal vragen geeft de pre-scan DPIA/IAMA direct advies over het aanbevolen of verplichte assessment.
• Velden uit de pre-scan worden automatisch overgenomen in de DPIA of het IAMA. Ook binnen de DPIA en het IAMA geldt eenmalig invoeren en meervoudig gebruik. Dat bespaart tijd en zorgt voor consistentie.
• Je kunt afgeronde assessments opslaan en opnieuw gebruiken.
• Opgeslagen assessments kunnen opnieuw worden geüpload, zodat medewerkers verder kunnen waar ze waren gebleven.
• Ben je ingelogd? Dan kun je samen met je collega’s aan het assessment werken.

Dat "Bring Your own" veel nadelen kent heeft deze school wel gelijk in. Waar ze de plank volledig mis slaan is dat de ouders dan maar de ICT en support voor de school moeten betalen. Zo werkt het niet. Als een school specifieke computers met een specifiek OS voorschrijf dient de school dat in te kopen, DPIA's uit te voeren en verwerkersovereenkomsten af te sluiten voor het besturingssysteem en alle andere software die school erop (laat) zetten. Dit is dan gewoon lesmateriaal en moet dus net als schoolboeken aan leerlingen worden verstrekt.

Als een school kiest voor Bring Your own, dan heb je ook het recht om te bepalen wat voor OS en software daarop draait. Je hoeft het beheer van jouw laptop niet aan school over te dragen, net zomin als dat je je huissleutels aan school moet geven.

The EDPB has published a harmonized DPIA template — the first pan-European documentary standard for impact assessments. Open for public consultation until 9 June.
Key insight: a clear separation between design risk (processing works as intended but still poses risks) and incident risk (breaches, attacks, misconfigurations).
The design choices are the risk, before any failure occurs.

Je kunt #DPIA's blijven doen tot je een ons weegt, maar zolang BigTech geld kan verdienen met jouw data zullen ze nooit privacy vriendelijk worden.
Het is niet normaal dat we dit soort #surveillance diensten onderwijzen! Alsof kinderen na school opeens de privacy policy gaan lezen en denken "hey, dat is slecht, laat ik naar een alternatief gaan zoeken"
