#ICYMI In a 94-page opinion yesterday, a 4-1 majority #Pennsylvania #CourtDecision has ruled that counties cannot simply toss out any mail-in #ballots due to missing , hard to read or incorrect #handwritten dates on their outer return envelopes.
Enforcement of previous #RNC endorsed requirement violated the state constitution’s Free and #EqualElections Clause and resulted in the erroneously directed #disqualification of over 10,000 mail-in ballots statewide alone during the 2022 midterm elections.
The #DNC filed in support of the challenge that was originally brought by the #BlackPoliticalEmpowermentProject who also had a federal case claiming the law contravened a provision of the #CivilRightsAct but that case was stopped in the #ThirdCircuit. #RepublicanParty operatives vowed to take it to PA's #SupremeCourt within 72 hour limit to file a legal challenge.

From a layman's view of the 14th amendment, even if Trump wins the election, he still can't be president. The amendment doesn't mention being on the ballot, only holding the office.
If a party chooses to run a candidate that will not be able to assume the position if they win, that is on them. They wasted their efforts. If 99% of the voters write in the name of a 4-year-old, they would still not be seated as the President.

The *justices* focused instead on whose job it is to enforce §3 of the #14thAmendment, neatly excluding themselves from the equation. Instead, they kicked the issue of who should bar those who have taken an oath to the #Constitution & then engaged in #insurrection from holding office to #Congress.
