If you have missed it, Google is closing down the Android ecosystem Apple style by requiring every app be signed by them. How do you get your app signed then? By accepting their ToS and paying them a fee. Which is of course in stark violation of EU DMA. But this will affect the entire world, and kill indie/open source apps as we know it.

Apple i Meta mają być ukarane za rzekome naruszenia DMA

Reuters poinformował, że unijne organy antymonopolowe prawdopodobnie nałożą na Apple i Meta Platforms kary finansowe za domniemane naruszenia przepisów Digital Markets Act (DMA).

Obie firmy od zeszłego roku znajdują się pod lupą Komisji Europejskiej z powodu potencjalnych naruszeń tych regulacji, które mogą skutkować grzywnami sięgającymi nawet 10% ich globalnych rocznych przychodów.

DMA, obowiązujący od maja 2023 roku, ma na celu ułatwienie użytkownikom przechodzenia między konkurencyjnymi usługami online oraz zapewnienie mniejszym firmom możliwości rywalizacji z gigantami technologicznymi.

Według źródeł bliskich sprawie, unijny organ antymonopolowy koncentruje się na zapewnieniu zgodności z prawem, a nie na surowym karaniu, co tłumaczy decyzję o nałożeniu stosunkowo niskich kar.

Apple kończy erę 64 GB pamięci

Wśród powodów wymieniono krótki okres trwania domniemanych naruszeń – DMA wszedł w życie w 2023 roku – oraz obecny klimat geopolityczny. Ostateczna wysokość kar nie została jeszcze ustalona, a decyzja może ulec zmianie, jednak źródła wskazują, że rozstrzygnięcie spodziewane jest jeszcze w marcu.

Meta w swoim raporcie dotyczącym zgodności z DMA stwierdziła, że mimo starań napotyka na żądania regulacyjne wykraczające poza literalne zapisy prawa. Z kolei Apple w raporcie z 7 marca podkreślił, że zmiany narzucone przez DMA zwiększają ryzyko dla użytkowników i deweloperów, otwierając drzwi dla złośliwego oprogramowania, oszustw i scamów.

Sprawa budzi zainteresowanie także w kontekście gróźb prezydenta USA Donalda Trumpa, który w lutym zapowiedział wprowadzenie ceł wobec krajów karzących amerykańskie firmy, co może wpłynąć na dalszy przebieg negocjacji między UE a USA w kwestii regulacji Big Tech.
