Health insurance company uses a third party provider of telehealth services. That provider has a clause in their privacy policy that ALLOWS THEM TO USE YOUR DATA FOR MARKETING. They call this "legitimate interest". Our data protection regime is broken. #Privacy #DataProtection

"A new class action lawsuit accuses OpenAI of sharing data including user chat queries and personal identifying information like emails and user IDs with the tech giants — and targeted advertising behemoths — Meta and Google, without obtaining proper user consent.
Filed yesterday in California, the lawsuit claims that OpenAI’s data-sharing with Google and Meta violates the California Invasion of Privacy Act, known as CIPA, as well as the Electronic Communications Privacy Act. It points specifically to OpenAI’s integrations with Meta Pixel and Google Analytics, which are data-tracking and collection tools that facilitate targeted advertisements.
The data-tracking model described in the lawsuit — often referred to as “surveillance capitalism” — is the business that the modern internet is built on today. And OpenAI, like countless other tech companies, does include language in its privacy policy noting that it does collect, store, and share a range of consumer inputs and personal information."

Hey EU friends 👋
Google's new reCAPTCHA logs which certified device visited which site and when. Across millions of websites. Without meaningful consent.
That's not just sketchy. That might be illegal under GDPR.
Time to ask some questions. Ep 26 tells you where to start.

Just declined to fill out a date-of-birth on a form. It's for my accountant to be able to ask for information on my account, on my behalf, under my instruction. The form required his date of birth. I cannot imagine why a UK financial institution needs the date of birth for a man called Dave who lives somewhere in Brisbane - and what it would do with it even if they had it.
I've gently pointed them to the UK's Data Protection Act 2018, which says that all data retention should be "necessary". Knowing his date of birth really isn't, in this case.
(Also, I don't know it).
(Also, they wanted it in a form sent via email. Via email! FFS.)
The worst that will happen is that I have to ask for the information myself, and I've done that for the last ten years anyway...

Text-based constraints are behavioural guardrails. An access control prevents an action. A behavioural guardrail requests that an action not be taken. One is architecture. The other is a politely worded suggestion.

"Europol, the European Union’s (EU) police agency, operated a shadow data repository containing vast amounts of sensitive personal information and used it for years beyond its lawful scope, according to internal documents and whistleblower accounts.
Described by former officials as a “shadow IT environment”, the system lacked basic security or data protection safeguards required under EU law. It was used to store and analyse highly sensitive data – phone records, identity documents and geolocation information – including details of people who were not suspected of a crime.
This investigation by Solomon, Correctiv and Computer Weekly, based on leaked emails, internal reports and testimonies from former officials, found that in practice, the system became the agency’s primary environment for large-scale data analysis, despite lacking essential controls over who could access or modify the data.
For the first time in the agency’s history, several former high-ranking officials have come forward to reveal that the use of this shadow environment to store vast amounts of data – and the use of a clandestine intelligence tool known internally as the “Pressure Cooker” – had been concealed from the EU’s top privacy watchdog until 2019.
“They protect the law while breaking it,” one former senior official said of Europol."
