  1. A North Dakota judge has said he will order @greenpeace to pay damages to pipeline company Energy Transfer expected to total $345m in connection with protests against the #Dakota Access #oil pipeline from nearly a decade ago, a figure the environmental group contends it cannot pay.

    The long-awaited order is expected to launch an appeal process in the North Dakota supreme court from both sides.

    "Our young people and our elders urged us to protect our water and #UnciMakah (grandmother earth). That is what happened, and is happening still. Our aboriginally-occupied territories extend east to the James River and beyond. That is a historical truth. If Greenpeace can be held liable for telling the truth about Sioux Nation Treaty rights, then we are all in trouble.

    "The construction of Fort Rice on our northern boundary in 1864 was a violation of the Fort Laramie Treaties. This required our Tribe to be vigilant. No one should be surprised that warrior society burials are found in this area, near the pipeline route.

    "And do not insult our cultural experts, who have wisdom over matters most residents of Morton County or bureaucrats at the State Historical Society know absolutely nothing about. Energy Transfer and its lawyers should be ashamed of themselves. Everyday North Dakotans on the jury should know better.

    "When it comes to the excessive police and private security response to the generally peaceful protests at #CannonBall, believe your eyes. The scenes of guard dogs menacing Tribal members are reminiscent of the violence of #WhiteSupremacists in the #DeepSouth during the 1950’s and 60’s, but it was in North Dakota, in this day and age. It was on the news and on the internet.

    "Many of the protesters were Native American veterans of the United States armed forces. Energy Transfer used attack dogs against peaceful protesters and war heroes. But the jury sided with the out-of-state, unlicensed security with the attack dogs, instead of North Dakota veterans who supported Standing Rock.

    "A Texas oil company has come to North Dakota, and its lawyers and propaganda machine are weaving stories about how the Standing Rock Sioux Tribe and our supporters have lied, and how the poor pipeline company, a trillion dollars richer than in 2016 when this all started, should receive extra millions from non-profit organizations. It’s a funny thing about liars – they always accuse everyone else of lying. The Greenpeace trial was marked by secrecy.

    "The court is not making the transcript public. The documents obtained by Greenpeace about Energy Transfer’s terrible safety record are protected by a secrecy order and are not available to the public. The judge exhibited so much bias in favor of Energy Transfer that a team of international human rights lawyers felt compelled to monitor the trial. One prominent monitor stated 'In my six decades of legal practice, I have never witnessed a trial as unfair as the one against Greenpeace that just ended in the courts of North Dakota.'

    Introduction

    1. Peaceful demonstrations are a catalyst for the advancement of human rights. Yet around the world governments are criminalizing dissent and suppressing public #protest, often as a means to protect #CorporateInterests. In this context, indigenous peoples increasingly find themselves as the subjects of arrests, criminal prosecution and police violence when defending the lands they rely upon for their existence and survival from #ResourceExtraction by industries who are operating without the free prior and informed consent of the affected communities.

    2. This report is submitted to the Inter-American Commission on Human Rights (#IACHR) in conjunction with a thematic hearing held during the 172nd period of sessions. At the hearing,
    Commissioners heard directly from those involved in the indigenous-led resistance to the #DakotaAccessPipeline (DAPL) at Standing Rock, North Dakota. This report addresses the criminalization and suppression of protest by indigenous human rights defenders and their allies by United States (U.S.) federal, state and local governments, working hand-in-hand with private security forces [#Blackwater], specifically in relation to the construction and operation of #DAPL by #EnergyTransfer
    Partners and Dakota Access, LLC (Dakota Access) and the connected #BayouBridgePipeline (collectively the “#BakkenPipeline”).

    3. Standing Rock is an emblematic case of #IndigenousResistance to extractive industry that drew attention from around the world as water protectors met on the banks of the #MissouriRiver in peaceful assembly in what was the largest gathering of indigenous peoples in the U.S. in 100 years. Standing Rock is merely one example of how the U.S. government works with industry to approve energy projects carried out without the meaningful participation or consent of
    indigenous nations. Indigenous peoples are left with no choice but to peacefully protest and then are criminalized for their efforts to defend their lands and resources.

    4. Since Standing Rock, there has been an alarming trend by the United States government and state legislatures to criminalize opposition to pipelines and other energy projects. These #AntiProtest and so-called “#CriticalInfrastructure laws” progress towards criminalizing dissent and implicitly condone the use of excessive force towards human rights defenders, often including indigenous peoples and their allies who are at the forefront of resistance to extractive industries. As the international community has acknowledged, these laws are incompatible with domestic and international law. The governments’ use of excessive force and mass arrests to threaten, intimidate, and silence “#WaterProtectors” seeking to defend their lands, resources, and #culture, and the collusion with private security forces, violate fundamental human rights to #FreeSpeech and Aassembly enshrined in international human rights law and the #USConstitution.

    5. The information provided here builds on a 2016 request for Precautionary Measures filed by the #StandingRock, #CheyenneRiver and #YanktonSioux tribes, past Commission hearings on similar matters that remain unsettled, and reports on Indigenous Peoples and Extractive Activities, and the Criminalization of #HumanRightsDefenders. In addition, the United Nations has reported on the situation at #StandingRock through the Expert Mechanism on the Rights of of indigenous peoples. Despite condemnation from these international bodies and mechanisms, water protectors continue to suffer impacts from the criminalization of their dissent, while the United States moves forward permitting new #pipeline projects on indigenous territories.

    "The Standing Rock Sioux Tribe on Monday filed a new lawsuit against the U.S. Army Corps of Engineers arguing that the #DakotaAccessPipeline is operating illegally and must be shut down.

    "The tribe has long opposed the pipeline, also referred to as DAPL, due to concerns that it violates the tribe’s #sovereignty, endangers #sacred cultural sites and threatens to pollute the tribe’s #WaterSupply.

    "The Army Corps of Engineers has jurisdiction over the section of the pipeline that passes under #LakeOahe — a reservoir on the #MissouriRiver — roughly a half-mile upstream from the #StandingRockReservation.

    "The tribe in a 34-page complaint filed in U.S. District Court for the District of Columbia argues the Army Corps flouted federal regulations by allowing the pipeline to operate without an easement, sufficient study of possible #environmental impacts or the necessary emergency spill response plans, among other alleged violations.

    "'We are fighting for our rights and the water that is life for Oceti Sakowin tribes,' Standing Rock Sioux Tribe Chairwoman #JanetAlkire said during a news conference the afternoon of #IndigenousPeoplesDay.

    "The Army Corps of Engineers did not immediately respond to a request for comment.

    "The more than 1,000-mile-long pipeline carries crude oil from the #BakkenOilFields of northwest North Dakota to Illinois, and has been operating since 2017. Its pathway includes #unceded land recognized as belonging to the #SiouxNation under an #1851Treaty with the U.S. government.

    "The lawsuit was triggered in part by a 2024 engineering report that raised questions about the construction of the pipeline crossing below Lake Oahe, representatives of the tribe said Monday.

    "The report calculated that up to 1.4 million gallons of bentonite clay-based drilling mud used in the horizontal directional drilling process was not fully accounted for in construction records. The report notes that there is no clear indication where the fluid migrated, but that it could have seeped into the surrounding soil.

    “'The Corps has failed to act and failed to protect the tribe,' Alkire said of the report’s findings.

    "The report was prepared by engineering consulting firm Exponent for environmental advocacy group #Greenpeace as part of an ongoing lawsuit brought by pipeline developer #EnergyTransfer. Greenpeace commissioned the report to defend itself against Energy Transfer’s allegations that Greenpeace defamed the pipeline during its involvement in protests against DAPL in 2016 and 2017.

    "Standing Rock’s complaint also emphasizes that the Dakota Access Pipeline has still been allowed to operate despite that it no longer has an easement authorizing it to cross under Lake Oahe.

    "The Army Corps approved the easement in 2017, but a federal judge later revoked it in 2020, finding that the Corps violated environmental law by granting it without properly researching the possible environmental impacts of the pipeline.

    "The ban was related to a criminal pollution case against Energy Transfer for two pipelines in #Pennsylvania. Violations alleged in the criminal case included that Energy Transfer had used unapproved additives in the #DrillingFluid used to construct one of the pipelines. The company was convicted of #EnvironmentalCrimes under Pennsylvania law.

    "For this reason, Standing Rock wonders whether the drilling fluid used to bore under Lake Oahe truly contained no toxins.

    "'That’s a question the tribe has — what was in the drilling fluid?' Don Holstrom, an environmental consultant for Standing Rock, said Monday."

While non-profit climate activists who wrote the report reveal the power of #DirectAction, they also assign their campaigns more credit than is due. Particularly by citing significant losses such as #DAPL and #Line3 project in their reports, this statistic tends towards a deluded climate optimism that we view as a path fraught with peril and death. Again, if we’re not being honest with and about the failings of our movements, what does shifting tactics, and more importantly adjusting our overall strategies, toward the end of yet more changing statistics matter? we’re not convinced about making this a numbers game to celebrate the disrupting of 25% of an industry, when we’ve lost over 98% of the battle in a war with such high stakes.     “Last fall, the eyes of the world were fixated on #StandingRock.

    “Among the images burned into the brains of so many abroad were those of Morton County sheriff’s department, joined by law enforcement officers from across the country, bedecked in military gear and armed to the teeth, brutalizing defenseless water protectors for expressing their first amendment rights and freedom of religion. Eyes were opened when mercs sicced vicious attack dogs on women and children guarding sacred burial grounds with their lives. Folks thousands of miles away watched in horror as they witnessed concussion grenades being thrown into crowds and elders being maced in the midst of sweat lodge raids. People will never forget live stream video picked up by mainstream media, showing hundreds of civilians being shot with water cannons in subzero temperatures by a corporate police state army. Some photos of injuries were judged too graphic to post by social media, as they revealed a young woman with a near severed limb and another who’d been blinded in one eye.

    “This was not Iraq or Afghanistan. There was no foreign enemy invading our shores. These events occurred in the middle of the United States, on Lakota treaty lands; and the only thing these innocent people had done was dare to stand in the way of the Dakota Access Pipeline, the same one Bismarck, North Dakota residents rejected due to fears it would contaminate their water supply. This war zone created by Dakota Access and Morton County was meant to subdue Standing Rock residents and water protectors and force them to accept an unwarranted risk to their fresh water and the desecration of ancestral graves, under the barrel of a gun.

    “Here in the states, hundreds of Native Nations and the American public sided with Standing Rock. Scores came to camp along the shores of the Mni Sosa (Missouri River). Others rallied in the local cities, signed petitions, and called the White House. Millions were outraged by the injustice.

    “Yet who is paying for the corporate police state brutality I just mentioned? You are.

    “Senator John Hoeven (R-ND), who accepted money from Energy Transfer Partners (the company behind the Dakota Access Pipeline) and has been vocal in his support of both the Dakota Access Pipeline as well as the Keystone XL pipeline, has announced that North Dakota will receive $15 million in federal funds to reimburse the state for costs incurred as a result of militarizing Barney Fife and company while they pushed the pipeline through for ETP and engaged in the violent, forced removal of water protectors. Hoeven slid said monies into the Department of Justice’s budget as part of Fiscal 2017 funding legislation.

    “By the way, Hoeven sits on the Senate Appropriations Committee and is now the chairman of the Senate Committee on Indian Affairs. Welcome to Custer’s wet dream.

    “The distinguished Senator from North Dakota would have us believe his state was alone in its mission to extinguish #NoDAPL. Nothing could be further from the truth.

    “When Morton County requested backup, law enforcement officials from across the nation came to North Dakota via the Emergency Management Assistance Compact (EMAC). The Sheriff’s Association also showed up in full force.

    “New York Daily News writer Shaun King obtained audio where #EnergyTransferPartners freely admitted that they worked closely with the Sheriff’s Association, and wow, did they ever. They became one and the same.

    #WaterProtectors who lived at camp can attest to #ETP and law enforcement’s collusion and fraternization, but the record speaks for itself.

    “The Sheriffs’ Association has a $3.46 million budget, according to tax forms. Some of this funding comes from corporate sources, like TigerSwan. TigerSwan maintains offices in Iraq and Afghanistan. TigerSwan’s CEO is a former adviser to the multinational private security firm, Blackwater. Blackwater was founded by Erik Prince, a Trump campaign donor and the brother of Betsy DeVos, the US Secretary of Education. Besides funding the Sheriff’s Association, TigerSwan is in charge of Dakota Access intelligence and supervising overall security for the company. Tigerswan works for Dakota Access, while funding and partnering with the Sheriffs’ Association.

    “The Sheriff’s Association purchased military gear from the US Department’s Defense Logistics Agency thanks to the Defense Department’s 1033 program. Think corporate welfare for the defense industry.

    “Wait, there’s more. #EnergyTransferPartners CEO #KelcyWarren offered to reimburse North Dakota and Morton County for costs due to defending the Dakota Access Pipeline.

    “So why are US taxpayers forking over $15 million to North Dakota?

    “Despite the fossil fuel industry’s wishes, America is not an oil company with an army. We should not be bankrolling our own oppression.”

    “’Everyone just saw #oil and saw dollar signs,' a security contractor who worked on the #DAPL project told SOFREP before commenting that Reese, 'wants to be the next #ErikPrince.' At one point, TigerSwan was making a million dollars in profit per month while working on DAPL. No one at the company wanted to see that spigot turn off so some employees provoked the protesters in order to prolong the conflict. ETP was unaware of this as their director of security, Eric Lyons, was inexperienced and took whatever TigerSwan said at face value.

    “Another incident took place when Porter ordered several ex-Rangers to do penetration tests of the protester camps by driving a pickup truck right through their perimeter lines. The former Rangers blasted into Camp 3 where many of the more radical #NativeAmericans were known to be and made a loop through the camp. As protesters moved their vehicles to close off the entrance and trap them, the Rangers drove over a snow bank and escaped. Next, they drove down to Camp 1 and repeated the same tactic. This time the Native Americans drove after them and they got into a high-speed pursuit down the road.

    “This action resulted in the women and children vacating the camps, while those remaining went up to 100% security and prepared for law enforcement and security contractors to come clear the camps, which was never going to happen. The #protesters simply burned through resources and the native American tribe was not in a position to help them since they had spent the water protector donations to the tune of 3.2 million dollars in order to settle their casino debts.

    “‘I know for a fact that the money went into a lot of people’s pockets,' said Eddie Stormcloud who was a leader in one of the #WaterProtector camps and attended many closed-door sessions with the tribal council. Stormcloud also told SOFREP that the true amount of money was closer to nine million dollars rather than the 3.2 reported.  At the end of the day, it seemed that everyone was cashing in on the situation at #StandingRock.

    “‘Porter’s real goal was to keep this thing going as long as possible,' a former TigerSwan employee told SOFREP. 'Some of the protesters wanted to do big actions because they would get more media coverage and more funding. TigerSwan wanted it to happened because their contract would be prolonged. Meanwhile, ETP had no idea.'

    “One of the first contractors on the ground at #DAPL told SOFREP that, 'when TigerSwan came on that was when the shit show started. They came in with this military ideology when it was a police operation. They were almost willing to go in and do things that RGT [Russel Group] would never do because you can’t by law. So the oil company looked to TigerSwan as the authority and a lot of guys went over to them.'

    “The security contractor continued, saying that TigerSwan had an attitude of, 'we are going to walk into a room with a bunch of thugs and will be the biggest thug in the room.'

    “‘They are trying to prolong this as a cash cow,' another contractor lamented.

    “TigerSwan sent an unsigned and undated document from a nameless e-mail address to SOFREP denying the contents of this article.  It reads in part, 'The claims you make have no basis in reality and are completely made up.'  The document goes on to state, 'At no time were there any approved operations outside of the scope of the contract. Just like any dynamic organization, the client’s enterprise team for DAPL would come up with creative ideas to do their jobs differently, but nothing outside the scope of the contract was ever approved.'

    "A legacy brought home from #Iraq and #Afghanistan: The conflict at Standing Rock created a number of precedents for the future of #protests and #counterprotest actions. While companies like #Blackwater were private military companies operating abroad, TigerSwan brought the tactics that contractors and soldiers use in Baghdad to American soil for the first time.

    “'Someone is going to get shot, and then a bunch of people are going to get shot, and then we are going to have a #WoundedKnee III. That’s going to reflect badly on the national guard, on law enforcement, and certainly on private security contractors,' Landon Steele said. 'Guys need to be really leery and really careful and ask the really hard questions when a contract holder calls them and says we have a contract here in the US.'

    “Today, TigerSwan employs contractors running static and roving security patrols for the #MarinerEast2 #ME2 pipeline being built in #Pennsylvania by #ETP. The company also has eyes on the Atlantic pipeline and would like to bid on upcoming security contracts that will need to be fulfilled for the project.

    “TigerSwan’s internal security assessments anticipate protests when the Atlantic pipeline is run through North Carolina and West Virginia.”

    "The Morton County, North Dakota, Sheriff’s Department also recently concluded that another security company, Frost Kennels, operated in the state while unlicensed to do so and could face criminal charges. The firm’s attack dogs bit #protesters at a heated Labor Day weekend protest.

    "Law enforcement and private security at the North Dakota pipeline protests have faced criticism for maintaining a militarized presence in the area.     "According to a summary of the investigation, TigerSwan 'is in charge of Dakota Access intelligence and supervises the overall security.'

    "The Morton County, North Dakota, Sheriff’s Department also recently concluded that another security company, Frost Kennels, operated in the state while unlicensed to do so and could face criminal charges. The firm’s attack dogs bit #protesters at a heated Labor Day weekend protest.

    "Law enforcement and private security at the North Dakota pipeline protests have faced criticism for maintaining a militarized presence in the area. The American Civil Liberties Union (#ACLU) and National Lawyer’s Guild have filed multiple open records requests to learn more about the extent of this #militarization, and over 133,000 citizens have signed a petition calling for the U.S. Department of Justice to intervene and quell the backlash.

    "The Federal Aviation Administration has also implemented a no-fly zone, which bars anyone but law enforcement from flying within a 4-mile radius and 3500 feet above the ground in the protest area. #DallasGoldtooth, an organizer on the scenes in North Dakota with the #IndigenousEnvironmentalNetwork, said on Facebook that '#DAPL private security planes and choppers were flying all day' within the designated no-fly zone.

    "Donnell Hushka, the designated public information officer for the North Dakota Tactical Operation Center, which is tasked with overseeing the no-fly zone, did not respond to repeated queries about designated private entities allowed to fly in no-fly zone airspace.

    "What is TigerSwan?

    "TigerSwan has offices in Iraq, Afghanistan, #Jordan, #SaudiArabia, #India, and #LatinAmerica and has headquarters in North Carolina. In the past year, TigerSwan won two U.S. Department of State contracts worth over $7 million to operate in Afghanistan, according to USASpending.gov.

    "TigerSwan, however, claims on its website that the contract is worth $25 million, and said in a press release that the State Department contract called for the company to 'monitor, assess, and advise current and future nation building and stability initiatives in Afghanistan.' Since 2008, TigerSwan has won about $57.7 million worth of U.S. government contracts and subcontracts for security services.

    "Company founder and CEO James Reese, a veteran of the elite Army Delta Force, served as the 'lead advisor for Special Operations to the Director of the CIA for planning, operations and integration for the invasion of Afghanistan and Operation Enduring Freedom' in Iraq, according to his company biography. Army Delta partakes in mostly covert and high-stakes missions and is part of the U.S. Joint Special Operations Command (JSOC), the latter well known for killing Osama Bin Laden.

    "One of TigerSwan’s advisory board members, Charles Pittman, has direct ties to the #OilAndGasIndustry. Pittman “served as President of #Amoco Egypt Oil Company, Amoco Eurasia Petroleum Company, and Regional President BP Amoco plc. (covering the #MiddleEast, the Caspian Sea region, Egypt, and India),' according to his company biography.

    'Sad, But Not Surprising'

    "Investigative journalist #JeremyScahill told #DemocracyNow! in a 2009 interview that TigerSwan did some covert operations work with #Blackwater USA, dubbed the 'world’s most powerful #mercenary army' in his book by the same name. Blackwater has also guarded #OilPipelines in central #Asia, according to Scahill’s book.

    "Reese advised Blackwater and took a leave of absence from TigerSwan in 2008 in the aftermath of the #NisourSquareMassacre, a shooting in Iraq conducted by Blackwater officers which saw 17 Iraqi civilians killed. TigerSwan has a business relationship with Babylon Eagles Security Company, a private security firm headquartered in Iraq which also has had business ties with Blackwater.

    "'It is sad, but not surprising, that this firm has ties to the US interventions in Afghanistan and Iraq,' Medea Benjamin, co-founder of the women-led peace group #CODEPINK and the co-founder of the human rights group #GlobalExchange, told DeSmog. 'It is another terrifying example of how our violent interventions abroad come home to haunt us in the form of repression and violation of our civil rights.'

    "The North Dakota Bureau of Criminal Investigation and the Private Investigation and Security Board are also conducting parallel investigations to the one recently completed by Morton County. TigerSwan did not comment on questions posed about their contract."
