  2. A quotation from Thomas More

But doubtless Plato was right in foreseeing that unless kings became philosophical themselves, they would never take the advice of real philosophers, drenched as they are and infected with false values from boyhood on.

[Sed bene haud dubie praeuidit Plato, nisi reges philosophentur ipsi, nunquam futurum, ut peruersis opinionibus a pueris imbuti, atque infecti penitus philosophantium comprobent consilia.]

Thomas More (1478-1535) English lawyer, social philosopher, statesman, humanist, Christian martyr

  8. A quotation from Horace

Whene’er you lecture, be concise: the soul
Takes in short maxims, and retains them whole:
But pour in water when the vessel’s filled,
It simply dribbles over and is spilled.

[Quidquid praecipies, esto brevis, ut cito dicta
    percipiant animi dociles teneantque fideles:
omne supervacuum pleno de pectore manat.]

Horace (65–8 BC) Roman poet, satirist, soldier, politician [Quintus Horatius Flaccus]
Epistles [Epistularum, Letters], Book 2, ep. 3 “Art of Poetry [Ars Poetica; To the Pisos],” l. 335ff (2.3.335-337) (19 BC) [tr. Conington (1874)]

  10. But I've seen some outside of an educational context as well. This one is absolutely horrific. It's another case of a #lawyer using an LLM to generate #court filings of one type or another, without even checking its output to see if the brief makes sense, cites actual case #law, etc.

This is a #sanctions order from a #judge in this particular case. It is gripping reading.
    cases.justia.com/federal/distr

In short: the lawyer was caught submitting briefs with "hallucinated" #citations, either to cases that did not exist, or to cases that were unrelated to the legal point the citation was being used to uphold. An opposing #counsel contacted their firm about such an incorrect citation, and the firm did some cleanup, did some continuing legal education, instituted an "AI" policy, instructed the #attorney about what was forbidden, etc. And then that attorney ... just kept on doing it. Even after judges started noticing problems in submissions, this lawyer just kept doing it.

It was so bad that it basically caused the #implosion of the law firm.

    Incredible.

  11. How Jack Smith’s strongest case against Donald Trump collapsed

Seeking to get the classified documents case to a jury before the 2024 election, the special counsel made a fateful decision that some in his office saw as a misstep.

  16. #Scene: a well-dressed man working at a desk in an office with floor-to-ceiling glass and a view of the city.

[phone rings twice before he picks up the receiver]

    Man: Ken White, general #counsel.

    [pause]

    Man: Hello? Is anyone there?

[Someone responds. The voice is obviously electronically disguised, but sounds male. He speaks ominously.]

    Caller: We have her.

    Man: What? Who has who?

Caller: ... We have your wife.

Man: Is this a joke? Who is this?

Caller: This is the guy who has your wife. She didn't make it to work this morning.

    Man: What? Why?

[Man picks up his cell phone and starts texting his wife. He sends "Everything ok?"]

Caller: She's fine, and you can help keep her that way.

Man: What are you talking about?

[Phone dings with a reply text. It just says "I told you we have her."]

Caller: Ransom, Mr. White. I know exactly what you're worth, and you're going to follow my instructions and send it all to me.

    [White looks scared and horrified]

Man: You #kidnapped my wife? For #ransom?

    Caller: Yes, Mr. White.

    [pause]

Man: You don't know what you've done - I'm glad I'm not in your shoes. Good luck!

    [White hangs up]

Opinion | #Trump’s latest #admission on #FoxNews is great news for Jack #Smith

Just days after special #counsel Jack Smith obtained a superseding #indictment against former President Donald Trump for attempting to #overturn the 2020 #election the former #president claimed in a Fox News #Interview that he had “every right” to do so. The question now is: can that public #statement be used against him at #trial The answer is yes.

  18. A #Venezuelan govt controlled bank in #Miami was embattled in a #shareholder court case with #political implications that challenged directors of the #banking empire connected to the #Maduro regime. A #jury found on June 27 that two directors breached their fiduciary duty of care to the bank and hit them with a fine, but a fraction of the $27 million sought by #litigants. “The jury only awarded damages amounting to less than 3% of what the plaintiffs were seeking—$800,000, instead of the $27 million requested at trial. That’s essentially a slap on the wrist from the jury,” said defense #counsel Evan Stroman, a partner at #DiazReus.

“Any day where you help prevent an illegal authoritarian regime in #Venezuela from penetrating the United States banking system and hold those accountable for assisting that regime is a good day,” Derek E. León, the #plaintiffs' attorney, said.

  24. #Sadow, whose website describes him as a “special #counsel for white collar & high-profile defense,” is well known in #Atlanta #legal circles. His prominent clients include rap artists Rick Ross & T.I., singer Usher & former NFL player Ray Lewis.

  26. Woodward is #counsel of record for #Nauta, & for some period of time also #Taveras — it’s unclear if he will continue. Many details in the #SupersedingIndictment leave the strong impression that Taveras is cooperating w/the #SpecialCounsel in some capacity — particularly the evidence surrounding his alleged convos w/ #DeOliveira about the server.

“This is not rocket science,” Gillers said. “You can’t represent a cooperator & someone fighting an #indictment [like Nauta] in the same transaction.”

  27. In 2020, the #Trump campaign reported paying hundreds of millions of dollars to two companies, one set up by a former campaign manager and the other by campaign officials.
Neither the campaign nor the companies themselves reported specifically what the money was being spent on.
The #Campaign #Legal #Center filed a complaint to the F.E.C., accusing the Trump campaign of using the companies as “#conduits” to #conceal other vendors.
The commission’s #general #counsel recommended that the F.E.C. find that the campaign had broken the law by misreporting payments, and begin an #investigation into the Trump campaign’s relationships with vendors and subvendors.
But the commission #deadlocked last year in a vote on the matter, which meant no action could be taken.
The Campaign Legal Center sued the commission, but a federal judge — while expressing sympathy for the desire of transparency — dismissed the case late last year, saying that the commissioners had discretion.
“It is a lot easier to follow the money when you have a paper trail,” the judge opened his opinion.
The Campaign Legal Center has appealed.

  28. Former Donald Trump campaign official #Mike #Roman is cooperating with prosecutors from #special #counsel Jack Smith’s team in the ongoing #criminal #probe related to efforts to overturn the 2020 election, two sources familiar with the matter told CNN.

One of the sources said that the agreement, known as a #proffer #agreement, means that Roman may not have to appear before the grand jury but could instead speak to prosecutors in a more informal setting. Under such an agreement, prosecutors generally agree not to use those statements against them in future criminal proceedings.

  29. Prosecutors are prepared to hit Trump and his allies with new charges

The prosecutors’ decision on whether to seek additional charges from a grand jury — and where to seek them — will depend in part on whether they feel the Trump-appointed district judge overseeing the case against him in the Southern District of Florida, #Aileen #Cannon, is giving undue #deference to the twice-impeached, now twice-indicted former president.

The team of federal prosecutors working under #Special #Counsel Jack #Smith is currently prepared to add an “additional 30 to 45 charges” in addition to the 37-count indictment brought against Mr Trump on 8 June, either in a superseding indictment in the same Florida court or in a different federal judicial district.

In either case, they would do so using evidence against the ex-president that has not yet been publicly acknowledged by the department, including other recordings prosecutors have obtained which reveal Mr Trump making incriminating statements
