New Zealand is pursuing copyright changes to meet free trade agreement obligations and other reform ideas. The Paramount–Warner Bros. merger is facing more challenges. I'm not sure how this could be actioned, but imagine that copyright and trademark law was reformed to recognise the editorial staff of academic journals as its owners. Not the publisher who distributes them.
That way the editorial staff have decision-making power over whether the articles published in their journal are open access, and what style. If the publisher was unhappy with their decisions, they could move to a different one.

One simple change to copyright law that would make a huge difference is making exclusive licenses unenforceable. Here's an example.
After decades of consolidation, an oligopoly of 3 corporations control licensing for the majority of the world's recorded music (Universal, Sony and Warner). If an artist wants their music distributed by one of them, they have to sign over 100% control of their music licensing rights.

Like the Right to Repair, we have a Right to Archive. Copyright laws around the world must change, to make it clear that noncommercial archiving of born-digital, published artifacts is Fair Use/ Dealing, and exempt from all copyright claims.
The alternative is to let the powerful run their own versions of the Ministry of Truth, and stuff any digital artifact that's inconvenient to them down the memory hole.

In a win for fair use and public access to information, a US Federal judge in the Northern District of California has ruled in Bartz v. Anthropic PBC (3:24-cv-05417) that training AI on copyrighted works is protected by fair use.
However, unfortunately, the judge also ruled the Defendant's downloading and storage of pirated books was unlawful.

Gonna be blunt here… the fact AI has given large companies an incentive to want copyright/trademark/IP law reformed should probably be seen as a positive.
All those complaints about Disney and the RIAA, and Nintendo trying to take down fan projects and people losing millions to unfair court cases and legal demands… and now we may see that change.
By sheer greed and technological ‘luck’, we may see these companies tear each other to shreds.

Just because people used to think the Earth was flat didn't make it true, but that's what an #LLM from the Middle Ages would have told you. Let that sink in for a moment before you read on.
I'm sure there are #AIexperts who can explain this with more mathematical accuracy than I can, but from a social perspective this is the current existential problem we face with LLMs, #AI #datasets, and all the rest. While you can tune these engines to be more "creative" in a non-human sense, when you're talking about ingesting or even sampling vast quantities of data there's a strong tendency for #regressionTowardTheMean.
In layman's terms, when Google or #OpenAI suck up the whole Internet and feed it every social media post they can lay their hands on, the end result can't be a curated expert opinion. Instead, what you get is a linguistic representation of the average response based on n-grams and statistical probabilities, possibly supplemented with real references in a #RAG system or entirely made up because they seem linguistically plausible in others. Either way a language model, regardless of size or complexity, is just filling in the blanks based on statistics, probabilities, and (sometimes) explicit rules or collaborative engines to do things like filter out profanity and known-bad responses.
Without #XAI, sensible #AIgovernance, and #copyrightreform various commercial interests are a lot closer to dumbing down AI systems than they are to making them smarter. AI systems have a lot of potential, but our current market-driven approach incentivizes all the wrong behaviors by both for-profit companies and the #ML systems and resulting data sets that they're monetizing.
AI systems can become expert systems that support human endeavors, but not if we allow them to be entirely autonomous systems that parrot back some variation of "Most people say…". As a global society, we need to do better than that. We can, and we must!

In other words: Getting paid a reasonable amount from the model providers would incentivise people to be part of the training data.
Getting also paid from using the models creatively incentivises their use, and this is where copyright reform is most needed.
Instead of remaining a grey area forever, as the industry would sure be happy about, we need legal category for the remix as legit piece of art, not bastardisation.

As to my motivation, looking forward to people making MORE contributions to AI training instead of hiding their work away to protect it from being stolen.
I am not looking for copyright violations, but a new paradigm, where generative models feed back into the creative economy.

Most of the people who saw this movie when it first came out nearly a century ago are probably dead, and only now is it public domain.
I don't want the same to happen to works I've seen today. It's about time to undo the damage Disney and the copyright regime have done.
